GOVERNMENT REGULATION
of 5 November 2003
laying down rules on the use of the income of the Land Fund of the Czech Republic to promote the restoration of hives
The Government orders pursuant to § 15 paragraph 7 of Act No. 569 / 1991 Coll., on the Land Fund of the Czech Republic, as amended by Act No. 308 / 2000 Coll. and Act No. 313 / 2001 Coll.:
§ 1
(1) The Land Fund of the Czech Republic will transfer an amount of CZK 80 000 000 to support the restoration of hives for hives killed as a result of the adverse winter period of 20031) ("the renewed hives") to the Czech apiculture association ("the Union").
(2) The winter period 2003 means the period from 24 December 2002 to 21 March 2003.
§ 2
(1) Aid for the renewal of hives (hereinafter referred to as "aid") shall be granted to a natural or legal person who:
(a) notify the Union on 1 May 2003 of the number of hives which died as a result of the adverse winter period of 2003 (the "dead hives"),
(b) request the Union for aid within the time limit laid down (§ 3) and indicate in the aid application the number of hives renewed.
(2) The aid is also granted to a natural or legal person who:
(a) request aid from the Union within the prescribed time limit (§ 3);
(b) notify the Union by the date of the application for aid at the latest of the number of hives killed and the number of hives recovered.
(3) The number of hives killed is demonstrated
(a) a certificate issued by the competent veterinarian; or
(b) written testimony by a third party.
(4) The aid shall be granted on the basis of a written application and a declaration of honour, a specimen of which is set out in the Annex to this Regulation.
§ 3
An application for aid, hereinafter referred to as "the application ', shall be submitted by a natural or, where appropriate, by a legal person in accordance with the model set out in the Annex to this Regulation within 15 days of the date of entry into force of this Regulation. The application shall be submitted to the basic organisational unit of the Union of which it is a member or, if it is not a member of the Union, to the basic organisational unit of the Union of which its renewed hives are located.
§ 4
The Union will provide support to a natural or, where appropriate, legal person through its basic organisational unit, at the same amount for each renewed colony, up to a maximum of CZK 1,500 per one renewed colony.
§ 5
By 31 December 2003, the Association shall submit to the Land Fund of the Czech Republic the accounts of the funds spent on the renewal of hives under this Regulation and shall, by 30 April 2004, return any unused funds to the Land Fund of the Czech Republic.
§ 6
Efficacy
This Regulation shall enter into force on the day of its publication.
