DECLARATION

amending Decree No. 301 / 1998 of the Ministry of the Environment Coll., establishing a list of chemicals and chemical products whose production, placing on the market and use are restricted
The Ministry of the Environment provides pursuant to § 15 (3), § 19 (5), § 21 (1) and § 22 (1) of Act No. 157 / 1998 Coll., on Chemicals and Chemicals and on the amendment of certain other laws, as amended by Act No. 352 / 1999 Coll.:
The Annex to Decree No 301 / 1998 Coll., establishing a list of chemicals and chemical products whose production, placing on the market and use are restricted, shall be amended as follows:
1. In point 6 (1):
"1. Fibrous asbestos
1. crocidolite, Cas No 12001-28-4
1.2. Amosit, Cas No 12172-73-5
1. 3. anthophylite, Cas No 77536-67-5
1.4. actinolite, Cas No 77536- 66-4
1.5. tremolite, Cas No 77536- 68-6
shall not be added to products placed on the market. ';
2. point 21 shall read as follows:
"21. Organo-tin compounds
1. They shall not be placed on the market for use as substances or constituents of products acting as biocides in coatings with anti-fouling effect.
2. Shall not be used as substances or constituents of products which act as biocides to prevent the rotting and damage of micro-organisms, plants and animals for:
(a) hulls of ships with a total length according to ISO 8666 of less than 25 m, and hulls of ships intended primarily for use on inland waterways and areas, with no length limit;
(b) cages, floats, nets and other equipment used for fish and molluscs farming;
(c) other equipment or equipment completely or partially immersed in water.
3. For uses other than those referred to in points (a) and (b), those substances may only be placed on the market in packages of at least 20 litres, excluding retail sales.
4. Where such substances or preparations containing those substances are placed on the market for authorised uses, the packaging of the following substances or preparations shall be marked legibly and permanently with the following inscription:
"Not to be used for ships of a total length of less than 25 m or for ships of any length used mainly on inland waterways and areas or for any other facilities or equipment for fish or molluscs farming. '
5. They shall not be used as such or as constituents of preparations intended for industrial water treatment. ';
3. In point 23 (4):
"4. In all cases where the use of pentachlorophenol as such or as constituents of the preparation is authorised, the total content of hexachlorodibenzo- p-dioxin in it shall be less than 2 mg.kg-1. ';
4. In point 23 (5) (b), the word "public 'is replaced by" retail'.
5. In point 28, the following point 4 is inserted after point 3, including footnote 4a:
"4. The verification of compliance with points 1 to 3 shall be carried out in accordance with specific legislation. (4a)
4a) Act No. 22 / 1997 Coll., on technical requirements for products and amending and supplementing certain laws, as amended by Act No. 71 / 2000 Coll. '
6. In point 29 of the title, "R45:" May cause cancer "'is replaced by" R45 May cause cancer' and "R49:" May cause cancer by inhalation 'is replaced by "R 49 May cause cancer by inhalation'.
7. in point 29 (1), the word "public 'is replaced by" retail';
8. In point 30 of the title, the words "R46:" May cause damage to hereditary properties "'are replaced by" R 46 May cause damage to hereditary properties'.
9. in point 30 (1), the word "public 'is replaced by" retail';
10. In point 31 of the title, "R60:" May damage fertility 'is replaced by "R 60 May damage fertility' and" R61: "May harm the unborn child 'is replaced by" R61 May harm the unborn child'.
11. In point 31 (1), the word "public 'is replaced by" retail'.
12. In points 33 to 40 (1), the word "public 'is replaced by" retail'.
13. In point 42 of the title, "very flammable (F) 'is replaced by" highly flammable (F)'.
14. in point 42 (1), the words "in aerosol generators' and" to the public 'are replaced by the words "in aerosol dispensers' and" in retail ';
15. In point 42 (2):
'2. The aerosol dispensers referred to in paragraph 1 shall be legibly and permanently marked with the following text: "For professional use only '. The labelling shall not in this way alter the other labelling obligations for dangerous substances and preparations.';
16. in point 42, the following point 3 is added:
'3. The provisions of paragraphs 1 and 2 shall not apply to aerosol dispensers with flammable content where results are available showing that under normal conditions of use there is no risk of ignition. ';
Efficacy
This decree shall take effect on the day of its publication.
