on the authorisation of amateur radio broadcasting stations
The Federal Ministry of Communications provides, pursuant to § 5 paragraphs 3 and 6, § 19 paragraph 1 and § 22 of Act No. 110 / 1964 Coll., on Telecommunications, as amended by Act No. 150 / 1992 Coll.:
BASIC INJURY
For the purposes of this decree:
(a) "amateur broadcasting radio station" (hereinafter referred to as "amateur station") means telecommunications equipment intended for technical self-education and study. It consists of one or more broadcasting and receiving equipment, including antenna systems, belonging to the same permit holder and operating in radio amateur traffic restricted bands,
(b) "establishment" means the establishment of an amateur station ready to operate, including its formation or acquisition. The establishment is not mass production or bulk imports,
(c) "operation" means the possession and use of an amateur station for radio reception or broadcasting;
(d) "possession" means the mere possession of an amateur station;
(e) "operator" means any natural person who is competent to operate an amateur station.
AUTHORISATION FOR ESTABLISHMENT, OPERATING AND TRANSPORT OF AMERICAN STANCES
Content of authorisation
The authorisation to establish, operate and maintain an amateur station (hereinafter referred to as "the permit ') authorises natural and legal persons to establish, operate and maintain an amateur station. The permit authorises the possession of radio broadcasting stations other than amateur stations, if they are to be converted into amateur stations.
Conditions for authorisation
The authorisation shall be issued:
(a) a natural person who has reached the age of 15 has not been deprived of legal capacity or its competence has not been limited and has demonstrated competence under this Order (§ 9);
(b) to a legal person established in the territory of the Czech and Slovak Federal Republic. The legal person shall designate a manager who shall be responsible for the operation of the amateur station in accordance with this Decree. The leading operator must be authorized by an amateur station.
Application for authorisation
The authorisation shall be issued on application containing:
(a) in the case of natural persons, the name, surname, address and birth number of the applicant and the permanent post of the amateur station;
(b) for legal persons, the name, registered office, identification number (IČO), the permanent post of the amateur station, the name and surname of the manager of the operator and his call sign.
Forms of authorisation
The decision to authorise an amateur station shall include in particular:
(a) the authorisation number;
(b) in the case of a natural person, its name and surname, address and birth number, its name, registered office, name, surname and call sign of the manager;
(c) the call sign assigned,
(d) operator class, where authorisation is granted to a natural person;
(e) a permanent post of an amateur station;
(f) permit conditions (operational and technical), differentiated by class of operators under which an amateur station is permitted to operate.
Validity of authorisation
(1) The authorisation is valid for five years from the date on which the decision granting the authorisation became final. The validity of the authorisation may be extended on the basis of an application submitted at least one but not earlier than six months before its expiry.
(2) Before the expiry of the period of validity referred to in paragraph 1, the authorisation shall expire on the date on which the natural or legal person:
(a) the authorisation has been surrendered;
(b) a natural person has died or been deprived of legal capacity;
(c) the legal person has ceased to exist;
(d) for a legal person, an operating management operator with its own authorisation has ceased to be active unless a new management operator has been established simultaneously;
(e) withdrawal of the authorisation of amateur station (1)
Obligations on termination of authorisation
In the event of the termination of the permit pursuant to § 6, the owner of the amateur station is obliged to terminate its operation and within 15 days:
(a) return the authorisation decision to the authorising authority;
(b) notify the authorising authority of how it has been handled with the broadcasting equipment.2)
Measures in respect of infringements of this Order or Conditions of Authorisation
(1) Where a natural or legal person who has been granted an authorisation seriously infringes the provisions of this Decree or the conditions of authorisation, the authorising authority shall impose on him one of the following measures:
(a) the suspension of an operating permit for a maximum period of one year;
(b) withdrawal of authorisation (1)
(2) If an operator infringes the provisions of this Decree or the conditions of authorisation, the authorising authority may require it to undergo an examination, with the result that it may be transferred to a lower class of operators. The examination shall be carried out mutatis mutandis in accordance with Part Three of this Order.
RECOGNITION OF CLASS OF AMERICAN STANDS
Operator classes
(1) Depending on the extent of knowledge and practice, the operator's competence shall be determined by including him in one of the four classes of amateur station operators marked with letters D, C, B, A.
(2) The requirements set out in the Annex to this Decree, for Class D, C and B, shall be fulfilled by the granting authority.
Tests
(1) The examination shall be carried out at the request of the tenderer, which may be accompanied by an application for authorisation from an amateur centre. The application shall be accompanied by proof of the prescribed practice and proof of payment of the test costs.
(2) The applicant is obliged to pay to the Federal Ministry of Communications the test costs, which shall be set at a flat-rate amount of 100 CZK.
Test Panel
The testing committee for operators shall establish a Federal Ministry of Communications; appoint at the same time the chairman and other members of the panel for each field of test. The Chairman of the Commission may appoint a representative from among the members of the Commission.
Time and place of test
(1) The examination shall take place within six months of the submission of the application, as a rule at the seat of the Examination Committee. The applicant shall be informed of the time and place of the examination at least a week in advance.
(2) If the candidate cannot attend the test at a specified time, he shall notify the examination committee in advance and request a new deadline.
Test run
(1) Before starting the test, the tenderer shall demonstrate his identity and provide proof of the prescribed practice.
(2) The test is not public. In addition to the members of the Examination Board, only persons whose presence is permitted by the Chairman of the Examination Board may be present at the examination.
(3) The chairman of the examination committee shall direct the examinations and monitor the examinations from each test area, and may ask additional questions to the tenderers.
The candidate consists of all prescribed test fields. The examination of certain subjects may be waived by decision of the Chairman of the Examination Committee if the applicant otherwise proves the required knowledge.
Assessment of test result
(1) The investigator shall be evaluated by the Commissioner responsible for each test. Two degrees are used for evaluation: good, bad.
(2) The candidate has passed the test if he has demonstrated knowledge of the substance prescribed by the test curriculum and no more than 3% of the errors in both the transmission and the intake of morse marks were committed in the practical test.
(3) The candidate did not pass the test if one or more of the test subjects had not been assessed in a grade.
(4) The chair of the examination committee shall issue a certificate to the candidate.
Correction and repeat of the test
(1) If the applicant has not benefited from only one test field, he may take a corrective test from that field. This correction test shall be accepted only once and shall be carried out within six months.
(2) If the tenderer has not benefited from more than one field or has not benefited from the correction test, he may submit a new application only after the deadline set by the Examination Board, which shall not exceed one year.
(3) A candidate to whom a correction test has been granted does not submit a new application.
A promise to preserve telecommunications secrets
(1) A candidate who has successfully passed the test must, before issuing the certificate, make a promise to maintain telecommunications secrecy.
(2) The promise of keeping telecommunications secrets is: "I promise that as an operator I will always preserve telecommunications secrets under the applicable legal provisions."
(3) The candidate makes a promise in the hands of the Chairman of the Examination Committee. The composition of the promise shall be confirmed by the tenderer by his signature in the test report.
PROVISIONS TRANSITIONAL AND FINAL
(1) The authorisations of individuals issued by the date of entry into force of this Order remain valid for the period stated therein. The authorisation where the period of validity has been fixed until further notice expires on 31 December 1995.
(2) Authorisations issued to club stations before the date of entry into force of this Decree expire on 31 December 1993. Until 30 November 1993, legal persons may apply for an extension of the authorisation, indicating the information required for the authorisation under this Order.
(3) The validity of the certificate for amateur youth centres and the validity of the certificate for amateur radio sports stations expires on 31 December 1992.
The Regulation on the establishment, operation and possession of amateur radio stations issued by the Decree of the Federal Ministry of Communications No 2700 / 1979-R / 1 of 22.1.1979, published as an annex to measure No 30 / 1979 of the Bulletin of the Federal Ministry of Communications and registered in the amount of 5 / 1979 Coll.
This decree shall take effect on the day of its publication.

Requirements for obtaining a class of amateur radio operator
(1) Class D
Age of at least 15 years, completed primary education and demonstration of basic knowledge in the following test fields:
(a) Legislation on the establishment, operation and possession of amateur stations (basic provisions) and conditions of authorisation of amateur stations.
b) Basics of electrical engineering and radiotech, basic types of antennas, their use and safety regulations.
(c) Operating radio amateur rules.
(2) Class C
Age of at least 15 years, completed primary education and demonstration of basic knowledge in the following test fields:
(a) Legislation on the establishment, operation and possession of amateur stations and permit conditions of amateur stations.
b) Basics of electrical engineering and radiotech, basic types of antennas, their use and safety regulations.
(c) Operating radio amateur rules.
d) Telegraph alphabet (rate of at least 40 characters per minute for three minutes and three minutes).
(3) Class B
At least one year of experience as a Class C or D operator and the establishment of at least 500 radio amateur connections (excluding transmitters and plants), as well as the demonstration of detailed knowledge in the following test fields:
(a) Legislation on the establishment, operation and possession of amateur stations and permit conditions of amateur stations.
(b) Operating radio amateur rules.
(c) Telegraph alphabet (rate of at least 80 characters per minute for three minutes and three minutes),
d) Basics of electrical engineering and radiotechics, solutions of receiver and transmitter circuits, types of antennas and their use, foundations of electromagnetic wave propagation, measurements in radiotech and safety regulations.
(4) Class A
Two years of experience in class B and establishing at least 3000 radio amateur connections (except transmitters and races).
Note:
The permit conditions of amateur stations and the Operating Radio Amateur Rules for testing shall be sent by the authorising authority to the tenderer at his request.
