DECLARATION
of 30 January 2006
amending Decree No. 241 / 2002 of the Ministry of Transport and Communications Coll., on the determination of water tanks and watercourses on which the navigation of vessels with combustion engines is prohibited and on the scope and conditions of the use of surface water for navigation
The Ministry of Transport, in agreement with the Ministry of the Environment in cooperation with the Ministry of Agriculture, provides for the Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act), as amended by Act No. 20 / 2004 Coll.:
Decree No. 241 / 2002 Coll., on the determination of water tanks and watercourses on which the navigation of vessels with combustion engines is prohibited and on the extent and conditions of use of surface water for navigation is amended as follows:
1. After Paragraph 1, the following Section 1a is inserted:
Basic concepts
For the purposes of this decree:
(a) by water skiing, an activity carried out using water skis or other floating object without its own steering gear in a tow behind a combustion engine vessel;
(b) by a jet ski, a vessel of less than 4 m in length, using an internal combustion engine with a hydroreactive propulsion system as the main source of propulsion and designed to drive by a person or persons seated, standing or kneeling on the hull, not within it;
(c) by a vessel intended to sail in glide, a small craft with its own propulsion capable of carrying one or more persons, designed and constructed to glide at a high speed, with a power / displacement ratio r > 120, or, where applicable, Frode Fn > 3;
(d) the use of an internal combustion engine as an auxiliary propulsion of a sailboat for its use in order to ensure the safety of navigation when manoeuvring in ports, berths, bulkheads and locks, and in serious defects preventing the use of dyeing, or for arriving in non-wind or other adverse climatic conditions; it is not permanently used in normal operation. ';
2. Paragraph 3 (1) reads as follows:
"(1) On surface waters on which the voyage of vessels with internal combustion engines is not prohibited pursuant to § 7 (5) of the Act or § 2 of this Decree, the voyage of such vessels shall be possible only at a dive corresponding to the displacement of the vessel at which the effect of hydrodynamic lift is negligible (displacement mode of navigation), but not more than 25 km / h. A cruise at a higher speed outside the discharge mode is only possible:
(a) in the surface water sections listed in Annex 2 to this Decree at a distance of more than 25 m from the shore, unless the navigational characteristics are otherwise specified;
(b) in the sections of surface water listed in Annex 3 to this Decree, at a distance of more than 25 m from the shore, unless specified otherwise, and where the ratio of engine power or engine power / displacement ratio of the vessel used is ≤ 60; the power / displacement ratio is calculated by dividing the maximum power or engine power P (kW) by the displacement of vessel D (m3 or tonne) corresponding to the maximum authorised load: r = P / D;
(c) on surface waters marked with the corresponding navigational characteristics referred to in paragraphs 2 and 3. ';
3. In Paragraph 3 (2), the words "and other similar activities carried out in tow after the vessel 'are deleted," 9' is replaced by "8 'and" 18' is replaced by "19 '.
4. In Section 3, the following paragraph 3 is added, including footnote 1a:
"(3) Vessels intended for gliding under § 1a (c) and water scooters may only be operated on surface waters marked with the corresponding navigational features located under special legislation (1a), under the conditions of good visibility, between 15 September and 15 June between 8 and 12 and 14 and 19 hours. The power / displacement ratio shall be calculated according to the relationship referred to in § 3 (1) (b) and the Frode number shall be calculated by dividing the maximum speed of the vessel V (m / s) by the square root of the product of the gravitational constant (g = 9,81 m / s2) and the length of the main waterline Lwl (m): Fn = V / (g.Lwl) 1 / 2.
(1a) § 28 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended. '
5. Paragraph 4 (1) is deleted.
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
6. In Paragraph 4 (1), "3 'is replaced by" 4'.
7. In Article 6 (a), the words "municipal police" shall be inserted after the words "Police of the Czech Republic."
8. In Annex 1 - In Table 1, point 57 is deleted.
Points 58 to 63 shall become points 57 to 62.
9. In Annex 1 - The following point 61 is added:
"61. Sázava 1-09-03-181 Pikovice."
10. Annex 2 shall read as follows:
"Annex No 2 to Decree No 241 / 2002 Coll.
Surface water sections on which navigation is permitted at speeds exceeding 25 km / h.
1. Elbe:
from the river km 102,2 (Chvaletice) at the state border with the Federal Republic of Germany.
2.
(a) from the river km 91,5 (Třebenice) to the confluence with the Elbe water stream, including the upper part of the Berounka water stream to the port of Radotín,
(b) from the river kilometre 135 (Kamýk) to the river kilometre 140. ';
11. The following Annex 3 is inserted after Annex 2:
"Annex No 3 to Decree No 241 / 2002 Coll.
Seats of surface water on which navigation is permitted at speeds exceeding 25 km / h, at a specified ratio of engine power or engine power / displacement
Vltava:
(a) from the river kilometre 105 (Life, mouth of the Mast) to the river kilometre 128,93 (Vestec, road bridge), from 15 September to 15 June;
(b) from the river kilometre 159,90 (Orlík nad Vltavou, Zďákovský bridge) to the river kilometre 193 (Rejšíkov); in the section from the river kilometre 159,90 (Orlík n / Vlt., Zďákovský bridge) to the river kilometre 179 only during the period from 1 June to 31 October. '
Annex 3 to date shall be renumbered Annex 4.
12. In Annex 4, the following points 4 to 6 are inserted in the table after point 3:

Efficacy
This Decree shall take effect on 1 March 2006.
