Order of the Minister for Transport
of 13 August 1955
limiting the liability of the seagoing operator.
The Minister of Transport, in agreement with the Minister of Finance, pursuant to Paragraph 59 (1) of Act No. 61 / 1952 Coll., on Maritime Navigation (hereinafter referred to as "the Act"), hereby orders:
(1) The operator of a seagoing ship shall be liable for damage caused by the fault of the master, other crew members, pilot or other persons serving on board in the performance of their duties, in particular damage caused by the failure to meet the cargo contract between loading and unloading of goods [Paragraph 58 (1) (a) of the Act], only to the amount which constitutes the cost of the ship, freight, fares, compensation due to that ship from a common crashed, as well as other compensation for damage caused on the ship after the start of the journey and not yet corrected and compensation for the provision of assistance, up to the amount equal to a multiplication of 150 Kčts of gross tonnage of the ship for all damage caused by one event.
(2) The operator may leave the ship to creditors instead of paying the price of the ship. If a ship is owned by a State or a socialist legal person, the agreement of the Ministry of Transport is needed to leave the ship to creditors.
The operator of a seagoing ship shall not be liable for damage caused by failure to comply with a cargo contract which has been caused by the master, other crew members, pilot or other persons serving on board the ship in the management or management of the ship. However, it shall not be regarded as a fault in the management or management of a ship in receipt, loading, deployment, storage, unloading and delivery of cargo.
This Regulation shall enter into force on the day of its publication.
