DECLARATION
of 24 July 2006
amending Decree No 364 / 2005 Coll., on the management of school and school documentation and school matrices, and on the transmission of data from school and school documentation and school matrices (School and school documentation)
The Ministry of Education, Youth and Sports provides, pursuant to § 28 (6) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 383 / 2005 Coll.:
Decree No. 364 / 2005 Coll., on the keeping of documentation of schools and school establishments and school matrices and on the transmission of data from school documentation and school establishments and from school matrices (Decree on documentation of schools and school establishments) is amended as follows:
1. in Article 3, the following paragraph 2 is inserted after paragraph 1:
"(2) The data transmitted shall be based on the content of the school matrices and documentation of the school or school establishment on the date set out in Annexes 1 and 2 to this Regulation (hereinafter referred to as the" applicable date ').'.
Paragraph 2 shall become paragraph 3.
2. In Paragraph 4 (3), the words "critical date 'are replaced by the words" relevant date' and the words "that date 'are replaced by the words" that date'.
3. Annex 1, including footnote 5, reads:

Transmission of individual data
METHOD OF TRANSMISSION OF INDIVIDUAL DATA
Dates of data transmission, applicable date, form of transmission and technical means used
(1) Individual data from school matrices and school and school documentation shall be transmitted electronically in secure form. Data are transmitted to the competent administration 5):
(a) by 30 April at the relevant date of 31 March of the same school year; and
(b) by 31 October at the relevant date of 30 September of the same school year.
(2) If the last day for the transmission of individual data referred to in paragraph 1 to Saturday, Sunday or holiday is the next working day for the transmission of individual data.
TRANSMISSION OF INDIVIDUAL DATA BY LEGAL PERSONS CARRYING OUT THE SCHOOL'S ACTIVITIES
Transmission of individual data from school matrices and documentation of higher education
(1) The basic set of data shall be transmitted to each student of a higher vocational school and shall include:
(a) the school department identifier and the relevant date;
(b) student identification:
1. birth number, year and month of birth, sex,
2. data on citizenship,
3. details of the place of permanent residence;
(c) details of previous student education:
1. previous place of employment of a newly admitted student, such as secondary school, higher vocational school, foreign school,
2. the department identifier of the school in which the student obtained secondary education with a graduate examination, the field of education, the year of completion of the graduate examination,
3. the highest degree of education achieved by the student before taking up higher education,
(d) details of the start of education in the relevant higher vocational school, including the date and code of the start of education in the relevant field of education and the form of education;
(e) details of completion of education at the competent higher education institution:
1. the date and code of termination of education in the relevant field of education and the form of education in a higher vocational school;
2. an indication of how the training ends,
3rd series and the number of the form for the certificate of discharge issued and the diploma of discharge in a higher vocational school,
(f) details of the course of higher vocational training:
1. code of the relevant field of education, form of education, length of education,
2nd year in which the student is educated, the total duration of the suspension, including holidays,
3. identification of study group;
4. language of instruction, foreign language codes studied by the student,
5. code of course, repetition of year, interruption of education,
6. sources of student education funding,
(g) discharge data:
1. whether the student successfully carried out or failed to discharge, the date of discharge;
2. the code of the repair test, the repair defence or the replacement test;
3. the code of the foreign language from which the student performs discharge,
(h) control items:
1. control resolution of student or graduate school,
2. date and type of data change code;
3. beginning of sentence, end of sentence.
(2) A student with special educational needs, a student assigned to a study group for students with disabilities, a student who is trained according to an individual training plan and an extremely gifted student shall also be transmitted in an anonymous form, accompanied by:
(a) a student code established by a legal person only for the purpose of transmitting individual data in an anonymous form, which ensures that the data transmitted with data on other students are unmistakable but does not allow the student to be identified;
(b) an indication of whether the student is disabled, included in the study group for students with disabilities, an indication of any training according to the individual training plan and an indication of any exceptional talent of the student,
(c) the type of disability or disability or, where appropriate, the social handicap of a student when dealing with a student with special educational needs;
(d) information on the need to increase funding from the state budget resulting from the disability or disability of the student.
Transmission of individual data from school matrices and conservatory documentation
(1) The basic data set shall be transmitted to each pupil of the Conservatory and shall include:
(a) the school department identifier and the relevant date;
(b) the student's identification details:
1. birth number, year and month of birth, sex,
2. data on citizenship,
3. details of the place of permanent residence;
(c) details of previous education of the pupil:
1. previous place of employment of a newly admitted student, such as primary school, secondary school, foreign school,
2. the type and department identifier of the school in which the pupil was trained prior to admission to the Conservatory;
3. the highest degree of education achieved by the pupil before being admitted to the Conservatory;
(d) information on the start of education in the relevant conservatory, including the date and code of start of education in the relevant field of education and form of education;
(e) data on termination of training in the relevant conservatory:
1. date and code of termination of education in the relevant field of education and form of education in the Conservatory;
2. an indication of how the training ends,
3rd series and form number for the certificate of discharge issued and the diploma of discharge in the Conservatory and the certificate of graduation,
(f) data on the course of education in the Conservatory:
1. code of the relevant field of education, form of education, duration of education, type of education,
2nd year in which the pupil is educated, the total duration of the suspension, including holidays, of the number of compulsory school years completed,
3. information on education in the second main field,
4. language of instruction, codes of foreign languages studied by the pupil,
5. code of course, repetition of year, interruption of education,
6. sources of education funding for the pupil,
(g) data on discharge or, where appropriate, graduation test:
1. an indication of whether the pupil has successfully completed or failed to complete the discharge or, where applicable, the final examination, the date of discharge or, where applicable, the final examination,
2. the code of the repair test, the repair defence or the replacement test;
3. the code of the foreign language from which the pupil performs the discharge or, where appropriate, the comic test or the graduation exam;
(h) control items:
1. control resolution of the pupil or graduate of the school,
2. date and type of data change code;
3. beginning of sentence, end of sentence.
(2) The transmission of data on pupils with special educational needs, pupils who are trained in accordance with the individual training plan and the exceptionally gifted pupil shall be treated mutatis mutandis in accordance with Article 2 (2).
Transmission of individual data from school matrices and secondary school documentation
(1) The basic data set shall be transmitted to each secondary school pupil and shall include:
(a) the school department identifier and the relevant date;
(b) the student's identification details:
1. birth number, year and month of birth, sex,
2. data on citizenship,
3. details of the place of permanent residence;
(c) details of previous education of the pupil:
1. previous place of employment of a newly admitted student, such as primary school, secondary school, foreign school,
2. the type and department identifier of the school in which the pupil was trained before receiving secondary education;
3. the highest degree of education achieved by the pupil before receiving secondary school education;
(d) information on the start of education at the relevant secondary school, including the date and code of start of education in the relevant field of education and form of education;
(e) data on completion of education at the secondary school concerned:
1. date and code of termination of education in the relevant field of education and form of education in secondary school;
2. an indication of how the training ends,
3rd series and the number of the form for the final examination certificate issued and the teaching certificate or, where applicable, the graduation certificate,
(f) data on the course of secondary education:
1. code of the relevant field of education, form of education, duration of education, type of education,
2nd year in which the pupil is educated, the total duration of the suspension, including holidays, of the number of compulsory school years completed,
3. class identification,
4. language of instruction, codes of foreign languages studied by the pupil,
5. code of course, repetition of year, interruption of education,
6. sources of education funding for the pupil,
(g) details of the completion of the senior or final examination:
1. code of the type of test carried out;
2. an indication of whether the pupil has successfully passed or failed the test, the date of the examination;
3. the code of the test, namely the correct time test, the replacement time test, the repair test and the repeated test,
4. the code of the foreign language from which the pupil performs the examination;
(h) control items:
1. control resolution of the pupil or graduate of the school,
2. date and type of data change code;
3. beginning of sentence, end of sentence.
(2) When transmitting data on pupils with special educational needs, pupils in the class for pupils with disabilities, pupils who are trained in accordance with an individual training plan and those who are particularly gifted shall be treated mutatis mutandis in accordance with Article 2 (2).

Transmission of aggregated data
METHOD OF TRANSMISSION OF AGREGATED DATA
Dates of data transmission, applicable date, form of transmission and technical means used
(1) Aggregated data from school matrices and school and school documentation are transmitted to the competent administration (5) on the statements either on paper form or electronically.
(2) For the purposes of this Annex, the current school year shall mean the school year in which the last day of transmission of aggregated data falls. A continuous school year means the school year immediately preceding the current school year.
(3) Aggregated data from school matrices and school documentation, in accordance with Part Two of this Annex, shall be transmitted to the competent administrative authority on a paper form no later than 4 October or electronically no later than 14 October at the relevant date of 30 September of the current school year. The data referred to in Article 13 shall be transmitted electronically by 10 March at the latest at the relevant date of 28 February of the current school year.
(4) Aggregated data from school matrices and documentation of school establishments are to be transmitted in the case of school establishments listed in:
(a) Article 16, 21 to 24 on a paper form not later than 4 October or electronically not later than 14 October at the relevant date of 30 September of the current school year;
(b) Articles 15, 17 to 20 on a paper form no later than 4 November or electronically no later than 11 November at the relevant date of 31 October of the current school year.
(5) Aggregated data according to:
(a) Article 25 shall be transmitted on a paper form for the previous school year no later than 19 September or electronically no later than 27 September of the current school year at the relevant date of 31 August of the previous school year;
(b) Article 26 shall be transmitted on a paper form for the previous school year no later than 9 September or electronically no later than 19 September of the current school year at the relevant date of 31 August of the previous school year.
(6) Where the last day for the transmission of aggregated data referred to in paragraphs 3 to 5 to Saturday, Sunday or holiday is the next working day for the transmission of aggregated data.
TRANSMISSION OF AGREGATED DATA BY LEGAL PERSONS CARRYING OUT SCHOOL ACTIVITIES
Transmission of aggregated data on the legal person performing the school activity
(1) Data for the previous school year: continuing education in secondary and upper vocational schools.
(2) Data for the current school year: teachers by type of school, by group of subjects, teachers in classes or study groups for children, pupils or students with special educational needs, managers by type of school, other teachers, classrooms, use of information technology in teaching.
(3) The data referred to in paragraphs 1 and 2 shall not be transmitted as a primary art school and a language school with the right to state language examinations.
Transmission of aggregated data from school matrices and school documentation
(1) For the purposes of the transmission of aggregated data, in the next text of the class and study groups intended for children, pupils and students with disabilities and classes of the school set up at the school establishment for the performance of constitutional education, protection education and for preventive educational care are referred to as "special classes', or" special groups', and schools composed exclusively of special classes or special groups as "special schools'. A class or study group which, according to the previous sentence, is not referred to as a special class or a special group is designated as a" common class' or "common group '. A school with at least one common class or common group is designated as" ordinary school'.
(2) In the case of a special school for children, pupils or students with disabilities, an indication of the type of disability for which the school is intended shall also be given.
(3) Where a school has one or more separate workplaces, aggregated data shall be transmitted per school broken down for each separate workplaces, with the exception of primary art and language schools with the right of state language examinations, on which only aggregated data per school are transmitted.
Transmission of aggregated data from school matrices and school documentation
(1) Data for the previous school year: entering, leaving and leaving the school, broken down into ordinary and special classes, recovery stays.
(2) Data for the current school year:
(a) classes and children by sex, broken down by type of operation and duration of attendance and language of instruction, and broken down into ordinary and special classes;
(b) special classes and children, depending on the type of disability or social handicap and the type of operation;
(c) individually integrated children with disabilities by type of disability and type of operation;
(d) children by citizenship and foreigners by residence scheme, foreigners who do not have access to education under the same conditions as nationals of the Czech Republic, by type of operation broken down into ordinary and special classes,
(e) age composition of children by sex, broken down into common and special classes;
(f) applications for admission to pre-school education which have not been granted.
Transmission of aggregated data from school matrices and documentation of primary school and primary school special
(1) Data for the previous school year: end of compulsory schooling and secondary school leaving, broken down into common and special classes and by gender, recovery stays, additional indicators.
(2) Data for the current school year:
(a) pupils by field of education;
(b) classes and pupils by year and by sex, broken down into common classes and special classes;
(c) pupils repeating the year and pupils transferred to higher education,
(d) teaching foreign languages, broken down into common classes and special classes, extended teaching of certain subjects or groups of subjects, broken down by classes and groups and by the educational fields specified in the relevant framework programme;
(e) optional subjects (compulsory) by year, optional subjects by year, teaching in foreign language;
(f) special classes by type of disability or social handicap for which they are intended;
(g) individually integrated pupils with disabilities according to the type of disability, individual training plans for pupils of particularly gifted and disabled,
(h) pupils performing compulsory schooling abroad or abroad on the territory of the Czech Republic or otherwise carrying out compulsory schooling laid down by law by year,
(i) the age composition of pupils, including newly admitted to the first year, broken down into common and special classes;
(j) pupils under citizenship and foreigners under residence arrangements;
(k) courses for basic education and courses for basic education, preparatory classes for children with social handicaps.
Transmission of aggregated data from school matrices and documentation of nursery or primary school at the medical institution
(1) Data for the previous school year: average number of children and pupils.
(2) Data for the current school year: current numbers of children and pupils, children and pupils by citizenship and foreigners by residence scheme.
Transmission of aggregated data from school matrices and secondary school documentation
(1) Data for the previous school year:
(a) graduates by field of education, type, length and form of education and by gender;
(b) favourable scholarships, remuneration for productive activities;
(c) recovery and ski training courses;
(d) graduates of retraining studies in the education system by field of education and length and form of education and by gender.
