of 13 November 2012
amending Decree No. 79 / 2010 Coll., on the control of the electricity system and on the transmission of data for control
The Ministry of Industry and Trade provides pursuant to § 98a (1) (b) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 211 / 2011 Coll. and Act No. 165 / 2012 Coll.:
Čl. I
Decree No. 79 / 2010 Coll., on the control of the electricity system and on the transmission of data for dispatching control, is amended as follows:
1.
„§ 1
Subject matter
This Decree sets out the arrangements for dispatching control of the electricity system (hereinafter referred to as "dispatching control '), the scope and procedures for dispatching control of power generation, the rules for cooperation of technical dispatches, the deadlines and the scope of the data transmitted by the transmission system operator or distribution system operator for dispatching management, the preparation of the operation of the transmission or distribution system and for the operation and development of the electricity system, the evaluation of the operation of the electricity system and the use of equipment for providing support services, the requirements for the technical equipment of electricity generation for the purpose of the dispatching process and the method and the procedure for the determination of unrecovered electricity at the dispatching procedure under Article 26 (5) of the Energy Act.'
2. In Article 2, the following paragraph 4 is added:
"(4) Local distribution system operators in dispatching and transmitting data for dispatching in the event that:
(a) have a technical dispatching system and notify the technical dispatching system operator to which their distribution system is connected as a regional distribution system operator;
(b) there is no technical dispatching, shall be considered:
1. for the customer, where at least one customer's demand point is connected to their distribution system and the electricity plant is not connected;
2. for electricity producers, where at least one electricity generation facility is connected to their distribution system and no customer's demand point is connected; or
3. for both the electricity producer and the customer, where at least one electricity production facility and at least one customer's sampling site are connected to their distribution system. ';
Paragraph 4 shall become paragraph 5.
3. In Article 2, the following paragraph 6 is added after paragraph 5, including footnote 2:
"(6) The transmission system operator and distribution system operators shall determine, in accordance with the procedure set out in Article 14c, the amount of electricity not collected from individual power generating plants whose generation of electricity has been limited in accordance with Article 26 (5) of the Energy Act and the distribution system operators shall transmit the data to the transmission system operator which shall transmit these data to the market operator within the time limits applicable to the transmission of the regulatory energy data under another legislation2).
2) Decree No. 541 / 2005 Coll., on the Rules of the Electricity Market, the principles of pricing for the activities of the electricity market operator and the implementation of certain other provisions of the Energy Act, as amended. '
4. In Article 5 (1), point (b) is replaced by the following:
5. In Article 5, at the end of paragraph 3, the dot is replaced by a comma and the following point (f) is added:
"(f) information on the limitation of production pursuant to Article 26 (5) of the Energy Act."
6. in Paragraph 7 (1) (a) (2):
"2. active and reactive power control and voltage control, ';
7. In Article 7 (1), the following point 6 is added at the end of point (a):
"6. the restriction of electricity generation pursuant to Article 26 (5) of the Energy Act and the technical equipment of electricity generation for dispatching control,"
8. In Article 7, the following paragraph 2 is inserted after paragraph 1:
"(2) The transmission system operator, in cooperation with distribution system operators, shall establish operational instructions for the dispatching management of electricity generation pursuant to Article 26 (5) of the Energy Act for the solution of the balance sheet imbalance of the electricity system of the Czech Republic."
Paragraph 2 shall become paragraph 3.
9. in Paragraph 9 (2), point (a) shall be deleted;
Points (b) to (e) shall be renumbered as points (a) to (d).
10. in Article 10 (1) (d):
"(d) the management of customer demand facilities and electricity generation in the scope and according to the procedures set out in Annex 5 to this Decree;"
11. in Articles 10 (1) (e), 10 (2) (d), 13 (1) (b) and 13 (2) (d), the word "regulation" is replaced by "management" and the words "active" are inserted after the word "flows."
12. In Article 10, at the end of paragraph 3, the dot is replaced by a comma and the following point 3 is added:
"3. to limit the generation of electricity under Paragraph 25 (3) (d) (10) of the Energy Act."
13. in Article 13 (3), at the end of point (c), the dot is replaced by a comma and the following point 5 is added:
"5. to limit the performance of power generation pursuant to § 25 (3) (d) (10) of the Energy Act,"
14. in Article 13 (3) (d) (2):
"2. to modify or interrupt the power supplied by the electricity plant pursuant to Article 25 (3) (d) (10) of the Energy Act,"
15. in Paragraph 13 (3), at the end of point (d), the dot is replaced by a comma and the following point 3 is added:
'3. In carrying out the planned work and in dealing with fault conditions in its controlled distribution system which require the handling of switching elements or the change in power flow, '.
16. in Article 13 (3) (e) (1):
"1. to limit or interrupt the collection of electricity pursuant to § 25 (3) (c) of the Energy Act,"
17. in Article 13 (4), the word "installed" shall be inserted after the words "power generation with."
18. The following Sections 14a to 14c are inserted after Section 14, including the headings:
„§ 14a
Data for transmission system development
For the processing of the transmission system development plan, the transmission system operator shall transmit annually by 31 May at the latest.
(a) regional distribution system operators
1. the results of winter measurements, that is the national winter load measurement carried out on the third Wednesday of January at sections 3: 00, 11: 00, 13: 00 and 17: 00,
2. the assumption of electricity consumption and maximum load at transmission points between transmission and distribution systems in each year for a period of 10 years;
3. data needed for network calculations of steady-state network courses and short-circuit ratios;
4. information on the planned connection, disconnection or change of parameters for power generation, customer facilities, distribution system facilities with an impact on transmission system operation;
(b) the electricity producers shall provide information on the planned construction, unsetting or changes to the parameters of the power generation facilities connected to the transmission system;
(c) customers whose demand facilities are connected to the transmission system, information on the planned connection, disconnection or changes to the parameters of such facilities having an impact on the operation of the transmission system.
§ 14b
Requirements for technical equipment of power-generating modules for dispatching control
The technical equipment requirements for electricity generation for the purpose of dispatching control are set out in Annex 6 to this Decree.
§ 14c
Method and procedure for determining the electricity not collected and compensation for the electricity not taken from the dispatching procedure
(1) The instruction to limit the generation of electricity, including the restoration of the supply of electricity to the network, is given by the technical dispatching of the system operator to which the electricity production is connected. This technical dispatcher records the time of the start and end of the restriction on electricity production. Information on the start and end of the restriction on the generation of electricity shall be transmitted by the local distribution system to the regional distribution system operator by 8.00 hours the following day and by the regional distribution system operator to the transmission system operator by 9.30 hours the following day. During the period of the restriction on electricity production, the electricity generation plant shall be considered to be a power plant.
(2) The procedure for the transmission of data between technical dispatches and the settlement of compensation between system operators is agreed between each system operator.
(3) The restriction of electricity generation by dispatching control of power generating facilities shall be carried out by the relevant system operator in the order of the maximum power output of the power generating facility until the amount of power required for the dispatching control agreed with the TSO.
(4) Compensation for the non-recovery of electricity from solar or wind power generation shall be determined as the product of the quantity of non-recovered electricity determined in accordance with Annex 7 to this Decree and the price of the compulsory purchase of electricity which would be due to the manufacturer by the date of entry into service of the electricity plant after deduction of the costs of the non-produced electricity which would have been achieved in case of non-limitation of production. Electricity producers who are entities of the solar electricity levy shall be reduced by a value corresponding to the size of that contribution. The compensation for the non-collection of electricity for other types of renewable sources shall be set at the level corresponding to the manufacturer's total income after deduction of the costs of non-produced electricity which would have been achieved if production had not been restricted. In the event of an emergency and for the duration of the emergency, the manufacturer is not responsible for the replacement of the unwithdrawn electricity.
(5) The compensation referred to in paragraph 4 shall be reduced in the hour when the negative price of electricity on the daily market, organised by the market operator, is reached by the absolute value of the product of the quantity of electricity not withdrawn at that hour, as determined in accordance with Annex 7 to this Decree and the hourly price. Where the day-to-day electricity market organised by the market operator does not agree on supply and demand, the manufacturer shall not be entitled to compensation in those hours.
(6) If, following the issue of an operational instruction by the relevant technical dispatcher, the restriction of electricity production pursuant to Article 26 (5) of the Energy Act does not result in the power plant being switched back on by the electricity producer or the power plant being discontinued, the electricity producer shall not be liable for compensation for the unrecovered electricity from the time the operational instruction is issued. ';
19. In Annex 1, Part I is deleted.
Parts II to V shall be renumbered Parts I to IV.
20. In Annex No 2, Part I, the following paragraph 5 is added:
"(5) Switching the remote control of the power plant to the local control is possible only with the agreement of the relevant technical control unit that performs the remote control. '
21. The following Annexes 5 to 7 are added, including footnote 3:

"Annex No 5 to Decree No 79 / 2010 Coll.
Scope and procedures for dispatching electricity generation
1. In the management of the power balance in the electricity system, the transmission system operator shall, as a priority, use the dispatching control tools, which shall be:
(a) activation of contracted support services;
(b) the purchase of regulatory energy on the balancing market;
(c) the purchase of regulatory energy from abroad;
(d) emergency assistance from abroad;
(e) capacity changes to intraday cross-border transmissions;
(f) other contractually secured instruments.
2. In the event that the use of the control tools referred to in the previous paragraph is not sufficient to ensure the balance sheet balance of power in the electricity system, the transmission system operator's technical dispatching shall take the following measures:
(a) in the event of a lack of enforcement, notify emergency prevention or declare an emergency and proceed under another legislation (3);
(b) in the case of excess power, limits the generation of electricity in electricity production for the period strictly necessary and in a way which does not restrict the provision of support services and does not jeopardise the supply of heat from cogeneration plants; If the operating situation so permits, electricity production in renewable energy plants shall be maintained as a priority.
3. The use of the measure referred to in point (b) of the previous paragraph in the case of an excess of power shall not preclude notification of an emergency or an emergency notification.
4. Where the excess power is caused by the generation of electricity in specific electricity production plants or where such production is a threat to the safety and reliability of the electricity system or part of it, the transmission system operator or distribution system operator shall limit the generation of electricity in those electricity plants.
5. The scope and procedures for dispatching power generating facilities shall be determined by the TSO and distribution system operators using operational instructions.

Annex No 6 to Decree No 79 / 2010 Coll.
Requirements for technical equipment of power-generating modules for dispatching control
1. Electricity plants subject to control shall be equipped with a switch to enable them to be disconnected from the electricity system, which shall:
(a) remain operational even after the plant has been disconnected from the electricity system;
(b) be equipped with remote control from the operator's technical dispatching system to which the electricity generation plant is connected, unless it is possible to control the production separately by other means;
(c) be equipped with a condition indication;
(d) be available at any time to the operator of the relevant system to which the power plant is connected.
2. The power plants referred to in Article 23 (2) (q) of the Energy Act with installed power from 100 kW including up to 400 kW shall be equipped with an interface for data transmission and control by the transmission system operator or distribution system operator to which they are connected to enable compliance with the requirements referred to in paragraph 1 and further enabling:
(a) the management of active power supplied;
(b) control of reactive power and voltage;
(c) transmission of data from active and reactive power and voltage measurements.
3. The power plants referred to in Article 23 (2) (q) of the Energy Act with an installed power of 400 kW or more shall be equipped with an interface for data transmission and control by the transmission system operator or distribution system operator to which they are connected, enabling the requirements referred to in paragraphs 1 and 2 to be met and further enabling:
(a) the transmission of electricity measurement data;
(b) transmission of signals from protection and fault signals necessary for the control of the electrical system by the dispatcher;
(c) for the production of electricity from renewable sources, the transmission of the data necessary for predicting electricity production.
4. The transmission system operator or distribution system operator to which the power plant is connected or is to be connected shall determine the installed power for a specific connection point and the type of power plant, the way in which and the parameters of the technical equipment of the power-generating facilities for:
(a) static voltage control equipment;
(b) equipment for dynamic support of the cooperation of the electricity plant with the electricity system;
(c) active power control equipment, depending on network frequency;
(d) active power control equipment, depending on operating conditions;
(e) reactive power control equipment, depending on operating conditions;
(f) equipment for communication and data transmission in the dispatching control.

Determination of the quantity of electricity not taken from the dispatching procedure pursuant to Article 26 (5) of the Energy Act
The quantity of electricity not withdrawn from solar or wind power generation shall be determined as follows:

The values of the correction coefficient kv are for solar power plants:
1. in March to October 0,76
2. in November to February 0,6
The value of the correction coefficient kv for wind power plants shall be 0,72 year-round. ';

This Decree shall take effect on 1 December 2012.
