of 10 June 2004
on changes to the borders of the regions and amending Act No. 243 / 2000 Coll., on the budgetary determination of the proceeds of certain taxes to the local authorities and certain state funds (Act on the Budget Determination of Taxes), as amended, and Act No. 314 / 2002 Coll., on the determination of municipalities with the authority of the municipal authority and the establishment of municipalities with extended scope, and Act No. 131 / 2000 Coll., on the City of Prague, as amended
Parliament has decided on this law of the Czech Republic:
Changes to regional boundaries
The definition of the territory of the Vysočina Region and the South Moravian Region is amended as follows:
the territory of the municipalities of Borač, Borovnik, Chernvír, Lower Loučky, Doubravík, Drahonín, Upper Loučky, Kaly, Katov, Křižínkov, Kuřímská Nová Ves, Kurímská Jestřábí, Lubná, Nídžice, Olší, Pernštejnský Jestřábí Jestří, Rojetin, Řikonín, Senorada, Skráje, Tišnovská Nová Ves, Újezvka and Ždárec go from the region of Vysočina to the region of South Moravian Region.
The definition of the territory of the Moravian-Silesian Region and the Olomouc Region is amended as follows:
the territories of the municipalities of Huzová, Norberčany and Moravian Beroun are transferred from the territory of the Moravian-Silesian Region to the territory of the Olomouc Region.
Transitional provisions
(1) The function of founder of the Basic Art School, Dvořák 349, Moravian Beroun, and Special Schools, Masarykova 357, Moravian Beroun, passes from the Moravian-Silesian Region to the Olomouc Region.
(2) The counties shall, on 1 January 2005, adapt the instruments of incorporation of the contribution organisations referred to in paragraph 1 to the change resulting from paragraph 1.
Administrative procedures not completed by municipal authorities and regional authorities until 31 December 2004 shall be completed by the authorities responsible locally from 1 January 2005.
The competent municipal and regional authorities shall, within 1 month of 1 January 2005, carry out a file separation on their respective agendas affected by the change in regional boundaries, including the separation of information contained in other data media.
Amendment to the Budget Tax Determination Act
Annex No 1 to Act No. 243 / 2000 Coll., on the budgetary determination of the proceeds of certain taxes on local authorities and certain state funds (Act on the Budget Determination of Taxes), as amended by Act No. 483 / 2001 Coll., is amended as follows:
1. In the column "Region ', the word" Prague' is replaced by the words "Prague Capital 'and the words" Czech Republic in total' are replaced by the word "Total '.
2. In the column "Percentage 'in the line of Vysočina, the number" 7,099474' is replaced by "7,094656 '.
3. In the column "Percentage 'in the line of the South Moravian Region," 10,005734' is replaced by "10,010552 '.
4. In the column "Percent 'in the line of the Olomouc Region, the number" 6,606500' is replaced by "6,611897 '.
5. In the column "Percentage 'in the line of the Moravian-Silesian Region, the number" 9,656801' is replaced by "9,651404 '.
Amendment of the Act on the establishment of municipalities with entrusted municipal offices and the establishment of municipalities with extended scope
Act No 314 / 2002 Coll., on the establishment of municipalities with a municipal authority and the establishment of municipalities with extended scope, is amended as follows:
1. In Annex No 1, in the paragraph entitled "Moravian-Silesian Region ', the words" Moravian Beroun' are deleted.
2. In Annex No 1, in the paragraph entitled "Olomouc Region ', the words" Moravian Beroun' shall be inserted after the words "Mohelnice '.
Amendment to the Prague Capital Act
Act No. 131 / 2000 Coll., on the Capital City of Prague, as amended by Act No. 145 / 2001 Coll., Act No. 273 / 2001 Coll., Act No. 320 / 2001 Coll., Act No. 450 / 2001 Coll., Act No. 311 / 2002 Coll., Act No. 312 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 22 / 2004 Coll., Act No. 216 / 2004 Coll. and Act No. 257 / 2004 Coll., is amended as follows:
1. Paragraph 12 (1) reads as follows:
"(1) The connection of the neighbouring village to the capital city of Prague or the department of the city district, which is adjacent to another municipality, from the capital city of Prague can only be done by law. Changes to the borders of the capital city of Prague, where the neighbouring municipality is not connected to the capital city of Prague, or to the separation of the city area which is adjacent to another municipality, from the capital city of Prague, are carried out by agreement of the capital city of Prague and the neighbouring municipality after consultation with the relevant cadastral authorities. The conclusion of the Agreement shall be notified to the Ministry of Finance and the competent financial authorities. ';
2. In Paragraph 12 (2), "separation 'is replaced by" separation'.
EFFECTIVE
This Law shall enter into force on 1 July 2004, with the application until 31 December 2004 only of the provisions of Sections 1, 2 and 7, only for procedures and tasks to secure elections to regional councils in 2004 under specific legislation. 1)
