DECLARATION
of 13 October 2021
on the protection of dogs and cats in breeding for reproduction
The Ministry of Agriculture provides pursuant to Article 29 (1) of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended by Act No. 162 / 1993 Coll., Act No. 77 / 2004 Coll., Act No. 312 / 2008 Coll., Act No. 291 / 2009 Coll., Act No. 359 / 2012 Coll. and Act No. 501 / 2020 Coll., ("the Act ') for the implementation of Section 7a (9) of the Act:
§ 1
Subject matter
(1) This Decree provides
(a) breeding conditions for the reproduction of dogs or cats, requirements for the minimum size of the premises for the reproduction of dogs or cats and requirements for the carrying out of insemination, which must ensure and comply with:
1. associations of legal or natural persons engaged in animal husbandry and breeders who are members of them, entrepreneurs who are engaged in animal husbandry or other persons who are engaged in animal husbandry for profit, or breeders who are breeding 3 or more dog bitches ("female"),
2. a breeder not referred to in point 1 whose purpose of breeding is the reproduction of dogs or cats;
(hereinafter referred to as "keeper of a dog or cat 'or" keeper of a dog' or "keeper of a cat '),
(b) the minimum and maximum age requirements for breeding of dogs or cats which must be complied with by breeders referred to in (a) (1).
(2) This decree shall apply to breeders referred to in paragraph 1 (a) who keep:
(a) a dog for the purpose of reproduction:
1. pregnant or lactating bitch,
2. a female who is not pregnant or breastfeeding,
3. Male dog, or
4. puppy kept together with mother, or female replacing his mother,
("the dog '),
(b) a cat for reproduction, which is:
1. pregnant or lactating cat,
2. a cat that is not pregnant or lactating,
3. cat; or
4. a kitten raised together with a mother, or a cat replacing his mother,
(hereinafter "the cat ').
(3) This decree does not apply to:
(a) experimental animals kept by the keeper of the experimental animals, supplied by the supplier of the experimental animals or used by the user of the experimental animals;
(b) animals used to carry out tasks assigned to armed forces, security corps or municipal police by other legislation1);
(c) animals treated by a veterinarian and placed in an establishment for the treatment of such animals by a veterinarian;
(d) animals placed in an animal shelter (2), where no breeding takes place in an animal shelter for the reproduction of a dog or cat.
§ 2
Terms
(1) For the purposes of this decree:
(a) an outdoor area for keeping a dog or cat which is enclosed by a fence, wall or similar fence;
(b) an indoor or outdoor enclosure for a dog or cat intended for permanent residence of a dog or cat and not transferable; a voter or other premises intended for the permanent residence of a dog or cat shall also be considered as a pen,
(c) cage internal enclosed space or equipment for keeping dogs or cats intended for the temporary residence of the dog or cats.
(2) The requirement for a minimum size of space is a requirement for a usable space where the dog or cat can move freely and where there are no items and equipment which interfere with the usable area. The objects and equipment used by the animal, in particular the shed, or the places used for laying, shall not be regarded as disrupting the usable area.
§ 3
General conditions for breeding of a dog or cat for reproduction
(1) The breeder must ensure that the premises for keeping the dog or cat allow for proper supervision, care and monitoring of the performance of the breeder's duties.
(2) The internal premises for the breeding of a dog or cat, with the exception of the apartment, must be covered with a durable and disinfectable material. The outdoor areas intended for dog or cat breeding and the premises of the apartment where the dog or cat is kept must be easily cleaned. The premises for keeping dogs or cats, equipment, toys and other equipment used in these areas must be kept clean.
(3) Inner spaces for dog or cat breeding shall be ventilated to ensure the introduction of fresh air and removal of moisture and contaminated air.
(4) The dog or cat breeding areas shall be adapted so that the animals can maintain their thermal balance without difficulty.
(5) The lying places for a dog or cat must be
(a) large enough and in sufficient numbers for all animals to lie down at the same time and rest in their natural position;
(b) dry, clean and comfortable.
(6) The dog or cat shall have sufficient access to daylight with the change of day and night. The inner premises for keeping dogs or cats shall be provided with appropriate lighting to enable the supervision and care of the animals.
(7) In the case of dog or cat breeding in a shed, the keeper of the dog or cat is obliged to ensure that the shed, which serves to rest the dog or cat and is situated in the indoor or outdoor space, is constructed as a space with fixed floor, wall and ceiling, equipped with an entrance.
§ 4
Special conditions for keeping dogs or cats for outdoor reproduction
(1) A dog or cat kept outdoors must be able to access places that provide shade and protection against wind, direct sunlight, precipitation, heat, cold and moisture.
(2) A dog or cat kept outdoors must have free access to indoor or shed accommodation. In outdoor areas for dog or cat breeding, which are used only for the purpose of running-off, free access to indoor or kennel accommodation is not required.
(3) A kennel for a dog or cat kept outdoors must be designed and maintained to protect animals from wind, direct sunlight, precipitation, heat, cold and moisture.
§ 5
Conditions for breeding a dog or cat for reproduction during birth and lactation
(1) A lactating bitch or a nursing cat must have access to a quiet and undisturbed place for themselves and their puppies or kittens. Breeding female or lactating cat must have access to a separate resting place where puppies or kittens cannot.
(2) The keeper of the dog or cat must ensure that the dog or cat is able to deliver its puppies or kittens in seclusion.
(3) The premises used for pregnant or lactating bitches or cats shall be equipped with such that the animals are protected from wind, direct sunlight, precipitation, heat, cold and moisture.
(4) Until the puppy reaches the age referred to in § 7a (6) (c) of the law, it may be separated from the female who is his mother, or from the female replacing his mother, only if:
(a) disease or injury to a puppy or bitch,
(b) suspected or infected of a puppy or bitch;
(c) the treatment of a puppy or bitch by a veterinarian, their treatment, quarantine or isolation;
(d) where the treating veterinarian so decides; or
(e) walking a puppy or a bitch outside the premises intended for breeding animals.
(5) Until the cat reaches the age specified in § 7a (7) (c) of the Act, it may be separated from the cat which is its mother, or from the cat replacing its mother, only if:
(a) disease or injury to a kitten or cat;
(b) suspected of being infected or infected by a kitten or cat;
(c) the treatment of a kitten or cat by a veterinarian, their treatment, quarantine or isolation; or
(d) where the treating veterinarian so decides.
§ 6
Care conditions for breeding dogs or cats for reproduction
(1) A keeper of a dog or cat is required to carry out or ensure supervision of a dog or cat at least twice every 24 hours, except for a cat with free access to the outdoor area. For animals that need more care, especially newborns, sick or injured, abnormally breeding animals, bitches or cats at the time of birth, the keeper of the dog or cat must oversee more frequently.
(2) The keeper of the dog or cat must keep the dog or cat clean and care for their fur as necessary.
§ 7
Special conditions for breeding a dog for reproduction
(1) The keeper of the dog must, when keeping the dog for the purpose of reproduction:
(a) to ensure the upbringing of the dog through contact with people and treatment of handling during normal breeding operations;
(b) enable the dog to exercise regularly to an extent adapted to its individual needs; and
(c) provide the dog with the possibility of resting.
(2) A dog older than 3 months, which has no free access to the outdoor area, must be regularly walked in the outdoor area, taking into account the need for movement, age and health.
(3) Except when walking, the dog must not be covered with a muzzle, except where necessary to protect the life and health of humans or animals for as long as necessary.
(4) The dog breeding areas must be equipped with safe toys for that dog.
(5) The number of devices and equipment, in particular the number of feeding and water bowls, safe toys, must correspond to the number of dogs kept.
(6) The dog must not be kept permanently in a cage. The breeder shall only keep the dog in the cage temporarily for as long as is strictly necessary for transport, participation in public appearances, dog security at the time of veterinary treatment, treatment, quarantine or isolation, where appropriate cleaning, repair or modification of the premises in which the dog is kept permanently. Cages with dogs must not be placed above each other, this does not apply in the case of transport of animals or participation in public appearances.
§ 8
Minimum size requirements for breeding areas for reproduction
(1) The breeder of the dog must ensure the minimum size of the breeding area for reproduction provided for in Annex 1 to this Decree.
(2) If the dog has permanent access to the connected space within or in other internal spaces and outdoors, at least one of these dog breeding areas shall comply with the requirements set out in Annex 1 to this Decree.
§ 9
Requirements for carrying out dog insemination
The keeper of the dog must ensure that only a person who is competent under the veterinary code 3 is performed by artificial insemination of the dog.
§ 10
Requirements for the lowest and highest age of the dog in reproduction
(1) An association of legal or natural persons engaged in animal husbandry, and breeders who are members thereof, entrepreneurs engaged in animal husbandry or other persons engaged in animal husbandry for the purpose of profit, or breeders who hold 3 or more bitches, must comply with the following requirements for the lowest and highest age of the dog in breeding:
(a) the cover or artificial insemination of the dog is permissible for:
1. small breeds up to 50 cm of faucet height from the day of the end of the fourteenth month of age to the day of the eighth year of age in the female, for male dogs from the day of the fourteenth month of age,
2. large breeds over 50 cm of faucet height from the day of the seventeenth month of age until the day of the eighth year of age in the female, in the male dog from the day of the seventeenth month of age,
(b) in the case of a female who has completed the eighth year of age, pregnancy shall be possible only until the end of the ninth year of age, on the basis of the written confirmation by the private veterinarian referred to in paragraph 2.
(2) Written confirmation by a private veterinarian referred to in paragraph 1 (b) (b) it must state that the health of the animal allows pregnancy without excessive risks. The examination of the animal shall be carried out and the certificate shall be issued at the latest at the beginning of the heat, first the examination of the animal may be carried out and the certificate issued one month before the beginning of heat.
§ 11
Specific conditions for breeding of cats for reproduction
(1) The breeder of a cat must ensure that the cat is kept for breeding purposes
(a) education through contact with humans and the treatment of manipulation in normal breeding operations;
b) the possibility of climbing and grinding each day;
(c) the possibility of resting and a dry place to rest; and
(d) access to shelters and the possibility of being secluded and raised during most of the day and night.
(2) The premises for the keeping of cats, with the exception of cats having free access to the outdoor area, must be equipped with:
(a) scrapers and safe toys for cats; and
(b) cat toilets containing sufficient material to allow digging.
(3) The quantity of equipment and equipment, in particular the number of cat toilets, feeding and water bowls, safe toys, must correspond to the number of cats kept.
(4) The feeding area and the cat toilet area must be at least 1 m apart and must not be confused.
(5) The cat must not be kept permanently in a cage. The breeder shall only keep the cat in a cage temporarily for as long as is strictly necessary for transport, participation in public appearances, cat security at the time of veterinary treatment, treatment, quarantine or isolation, and where appropriate cleaning, repair or modification of the premises in which the cat is kept permanently. Cages with cats shall not be placed above each other, this shall not apply in the case of transport of animals or participation in public appearances.
§ 12
Minimum size requirements for breeding areas for reproduction
(1) The keeper of the cat must ensure the minimum size of the premises for breeding cats for reproduction as laid down in Annex 2 to this Decree.
(2) If the cat has permanent access to the connected space within the building or in other internal spaces and outdoors, at least one of these cat breeding areas shall comply with the requirements set out in Annex 2 to this Decree.
§ 13
Requirements for performing cat insemination
The cat breeder must ensure that only a person who is competent in accordance with the animal health code (3) perform artificial insemination of the cat.
§ 14
Requirements for the lowest and highest age of a cat in reproduction
(1) An association of legal or natural persons engaged in animal husbandry, and breeders who are members thereof, entrepreneurs engaged in animal husbandry, or other persons engaged in animal husbandry for the purpose of profit, must comply with the following requirements for the lowest and highest age of a cat in breeding:
(a) coverage or artificial insemination of a cat shall be allowed from the day of the end of one year of age to the day of the end of the ninth year of age, with the exceptions referred to in (b) and (c), in the case of a cat from the day of the end of the sixth month of age,
(b) in exceptional cases, coverage of the cat may be possible from the date of the ninth month of age only on the basis of the written confirmation of the private veterinarian referred to in paragraph 2;
(c) in the case of a cat who has completed the ninth year of age, pregnancy shall be possible only on written confirmation by the private veterinarian referred to in paragraph 2.
(2) The written confirmation by a private veterinarian referred to in paragraph 1 (b) shall contain an indication of the overall health and physical maturity of the particular animal. The written confirmation of a private veterinarian referred to in paragraph 1 (c) shall state that the health status of the animal allows pregnancy without excessive risks. The examination of the animal shall be carried out and the certificate shall be issued at the latest at the beginning of the heat, first the examination of the animal may be carried out and the certificate issued one month before the beginning of heat.
§ 15
Transitional provision
The provisions of Sections 8, 12, Annexes 1 and 2 shall apply to breeders who have started breeding for breeding or breeding of cats after the entry into force of this decree. From 1 July 2022, the provisions of Sections 8, 12, Annexes 1 and 2 shall apply to all breeders who keep a dog for breeding or for breeding.
§ 16
Repeal
Decree No. 21 / 2013 Coll., establishing the conditions for breeding dogs and cats, is repealed.
§ 17
Final provision
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
§ 18
Efficacy
This Decree shall take effect on 1 November 2021.
