of 19 August 2005
amending Act No. 40 / 1995 Coll., on the regulation of advertising and amending and supplementing Act No. 468 / 1991 Coll., on the operation of radio and television broadcasting, as amended, and Act No. 252 / 1994 Coll., on radio and television charges, as amended
Parliament has decided on this law of the Czech Republic:

ČÁST PRVNÍ

Amendment to the Advertising Regulation Act
Čl. I
Act No. 40 / 1995 Coll., on the regulation of advertising and amending and supplementing Act No. 468 / 1991 Coll., on the operation of radio and television broadcasting, as amended, as amended, Act No. 258 / 2000 Coll., Act No. 231 / 2001 Coll., Act No. 256 / 2001 Coll., Act No. 138 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 132 / 2003 Coll., Act No. 217 / 2004 Coll., Act No. 326 / 2004 Coll. and Act No. 480 / 2004 Coll., is amended as follows:
1. In Article 2, at the end of paragraph 1, the dot is replaced by a comma and the following point (f) is added:
"(f) advertising distributed in publicly accessible places outside the place of business, other than through advertising or promotional equipment established under special legislation 5b), where the municipality so provides by its delegated regulation 5c), to the extent specified in paragraph 6.
5b) Paragraph 71 (2) of Act No. 50 / 1976 Coll., on Territorial Planning and Construction Regulations (Construction Act), as amended by Act No. 83 / 1998 Coll.
5c) § 11 paragraph 1 of Act No. 128 / 2000 Coll., on Municipality (municipal establishment), as amended by Act No. 313 / 2002 Coll. § 44 paragraph 2 of Act No. 131 / 2000 Coll., on the Capital City of Prague, as amended by Act No. 320 / 2002 Coll. '
2. In Article 2, the following paragraph 6 is added:
"(6) The municipality in the Regulation issued pursuant to paragraph 1 (f) provides:
(a) publicly available places where advertising under paragraph 1 (f) is prohibited;
(b) the period during which advertising referred to in paragraph 1 (f) is prohibited;
(c) the types of communication media by which the advertising referred to in paragraph 1 (f) may not be disseminated and, where appropriate, also:
(d) actions not covered by the prohibition on advertising. ';

ČÁST DRUHÁ

Amendment of the Radio and Television Charges Act
Čl. II
Act No. 252 / 1994 Coll., on radio and television charges, as amended by Act No. 135 / 1997 Coll., Act No. 231 / 2001 Coll. and Act No. 192 / 2002 Coll., is amended as follows:
In Article 2 (3), at the end of point (h), the dot is replaced by a comma and the following point (i) is added, including footnote 5b:
"(i) schools registered in the register of schools and school establishments 5b).
5b) Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act). '.

This Act shall take effect on the day of its publication.
