implementing certain provisions of the Arms Act
According to Article 79 (2) of Act No. 119 / 2002 Coll., on firearms and ammunition and amending Act No. 156 / 2000 Coll., on verification of firearms, ammunition and pyrotechnic articles and amending Act No. 288 / 1995 Coll., on firearms and ammunition (Firearms and ammunition Act), as amended by Act No. 13 / 1998 Coll., and Act No. 368 / 1992 Coll., on Administrative Charges, as amended, and Act No. 455 / 1991 Coll., on Trade (Trade Act), as amended, and under § 39 (5) of the Act, (the Act on Weapons Act), (hereinafter referred to as "Act '), as amended by § 17 (2 (c), § 21 (9), § 30 (11), § 39 (5), § 39 (5) and under § 79 (3):
INTRODUCTORY PROVISIONS
Subject matter
This decree provides for:
(a) the requirements of the technical execution of the photograph;
(b) the content of the theoretical and practical part of the proficiency test (hereinafter referred to as the "test") and the overall evaluation of the applicant's examination for the issue of an arms licence and the level of remuneration of the examiner;
(c) the content of the theoretical part of the examination, the method of carrying out the practical part of the examination, the overall evaluation of the examination of the examiner and the method of issuing the test commissioner's certificate;
(d) the content of the theoretical and practical part of the proficiency test and the overall assessment of the applicant's proficiency test for the issue of a group F armaments licence;
(e) how to keep records of weapons and ammunition in the arms and ammunition business and how to carry out training rounds;
(f) the manner in which the documentation on unexploded ammunition and explosives is kept; and
(g) models of cards, applications, applications, certificates and notifications.

[Paragraph 17 (2) (c) of the Law]
(1) The photograph has a smooth surface and is in black and white or colour. The photo is rectangular with dimensions 35 mm x 45 mm, built on a shorter side with straight or rounded corners with R = 3 mm + / - 0,5 mm with thickness from 0,13 mm to 0,27 mm.
(2) The photograph shows the head and shoulders of the person displayed. The person is shown in the front view in such a way that the central vertical plane of the face is an extension of the vertical plane of the lens of the sensing system and the horizontal plane of the face formed by the eyes is an extension of the horizontal plane of the lens of the sensing system. The view of the person displayed is directed to the lens.
(3) The distance between the upper edge of the head and the upper edge of the photograph is at least 2 mm. The height of the facial part of the head, which consists of a distance from eyes to chin, shall be at least 13 mm.
(4) The background behind the displayed person is white to light blue, allowing for smooth transition of these colors. The photo is without glare which would hide or significantly change the characteristic identification characteristics of a person, which are in particular the shape and location of eyebrows, eyes, nose, mouth, chin and the overall shape of the face. Retunes and other modifications of the negative or positive photo cannot be performed.
TRAINING ELEMENTS TESTS
The applicant's proficiency test for the issue of a group armaments licence A to E
(Paragraph 21 (9) of the Law)
Content of the theoretical part of the test
The theoretical part of the test is carried out by a test consisting of 30 questions, of which 22 are questions of knowledge of the legislation evaluated by 3 points, 5 questions of knowledge of the teaching of weapons and ammunition evaluated by 2 points and 3 questions of knowledge of the medical minimum evaluated by 1 point.
Content of the practical part of the test
(1) In the practical part of the test, the applicant shall gradually demonstrate:
(a) a inspection of the weapon to determine whether it is in a loaded state;
(b) partial disassembly and composition of the weapon to the extent necessary to clean the weapon after the shooting;
(c) the procedure for the preparation of the weapon and the ammunition for the shooting, for the interruption of the shooting, for the detection of a defect in the weapon during the shooting and at the end of the shooting.
(2) After demonstration of the activities referred to in paragraph 1, the applicant shall carry out a fixed target shooting.
(3) In order to demonstrate the activities referred to in paragraph 1 and to shoot a solid target, the type of weapon corresponding to the arms licence group indicated in the application shall be used. For shooting, a long 22 LR (5.6 mm) gun is used instead of hunting ball and hunting combined weapons - a mallet. In cases where the applicant is the owner of a weapon which he holds for a permit to hold a weapon, that weapon may preferably be used in the practical part of the test. When performing the activities referred to in paragraph 1, they shall be used as ammunition for cartridges not containing diaphragm, impactor or matchstick.
(4) The shooting is carried out at the shooting range (§ 52 of the Act) in standing position. Only an applicant for the test may use the weapon support in the shooting for the issue of a category B firearms licence, if it is a long weapon or a category C weapon licence. When firing a ball gun, a ball bullet shall be used with a single shot and a shotgun bullet shall be used.
(5) The target shall be a 50 / 20 pistol international target or a 550 x 550 mm white target with a 200 mm black round centre and a 250 mm long ball and shotgun target, or a 250 x 250 mm white target with a 112 mm black circular centre, firmly attached to the target area.
(6) The applicant shall verify the accuracy of the shooting of the weapon with three shots before starting the assessed shooting.
Overall test evaluation
(1) The overall assessment of the test consists of an evaluation of the theoretical part and the practical part of the test. The results obtained during the test are assessed by the Examination Commissation1) by "benefit 'or" benefit'. The degree of evaluation shall be indicated in the test evaluation form, the model of which is given in Annex 1.
(2) In the theoretical part of the test, the applicant shall be assessed as "benefit 'if he obtains at least 40 minutes without the aid.
(a) 67 points if there is a request for a group A armaments licence test;
(b) 71 points if there is a request for an examination for the issue of a B and C arms licence; or
(c) 74 points if there is a request for a test to be carried out for the issue of a D and E arms licence.
(3) If an application is made for a multi-group armaments test, the applicant shall be assessed as "benefit 'if he reaches at least the points to be obtained for the group for which the most points are required.
(4) If, in the theoretical part of the test, the applicant is assessed as "non-profit ', the practical part of the test is no longer performed and the overall result is assessed as" non-profit'.
(5) In the practical part of the test, the applicant shall be assessed by "benefit 'if, in addition to the management of the activities referred to in Paragraph 4 (1), he reaches a fixed target when shooting at a fixed target.
(a) at least two shots at a target from a long ball gun at a distance of 25 m of five possible shots at a time of not more than five minutes, at least two shots at a target from a short ball gun at a distance of 10 m of five possible shots at a time of not more than five minutes or at least two shots at a distance of 25 m of four possible shots at a time of not more than three minutes, if the application for a test to be carried out for the issue of a group A firearms licence,
(b) at least four shots at the target from a long ball gun at a distance of 25 m of five possible shots at a time of not more than five minutes, at least four shots at the target from a short ball gun at a distance of 10 m of five possible shots at a time of not more than five minutes or at least three shots at a distance of 25 m of four possible shots at a time of not more than three minutes, if the application is made for a test to be carried out for the issue of a group B weapon pass;
(c) at least four shots at the target from a long ball gun at a distance of 25 m from five possible shots at a time of not more than five minutes and at least three shots at a distance of 25 m from four possible shots at a time of not more than three minutes, if the request for a test to be carried out for the issue of a category C armour pass is requested;
(d) at least four hits at the target from a short ball gun at a distance of 15 m from five possible shots within a maximum period of two minutes, if a request is made for a test to be carried out for the issue of a D-category weapons licence; or
(e) at least four hits on the target from a short ball gun at a distance of 10 m from five possible shots within a maximum period of three minutes, if a request is made for a test to be carried out for the issue of an E-category weapons licence.
(6) Target impact means hitting the target with a shot or a shotgun into the space of the pictorial circles displayed on it.
(7) If, in the practical part of the test, the applicant endangers the safety of persons by self-inflicted, the examiner shall immediately terminate the test and evaluate the applicant with a "non-profit 'degree.
(8) An applicant who, in the theoretical part of the test, has been assessed in the "benefit" degree and in the practical part of the test, has not benefited, may repeat the practical part of the test once within two months of the date on which, in the practical part of the test, it was assessed in the "non-benefit" degree.
Remuneration of the Examination Commissioner
A fee shall be paid to the Assistant Commissioner for Participation in the test of the applicant for an armaments licence. The reward for participation in the examination of one applicant for the issue of a gun licence is CZK 300.
Test
(Paragraph 30 (11) of the Law)
Content of the theoretical part of the test
The theoretical part of the test shall be carried out by a test consisting of 60 questions, of which 52 are legal questions, 5 questions from knowledge of weapons and ammunition teaching and 3 questions from knowledge of the medical minima, and an oral interview lasting no more than 20 minutes by which the applicant certifies knowledge under the provisions of Section 30 (7) of the Act.
Content of the practical part of the test
(1) In the practical part of the test, the applicant gradually
(a) demonstrate a search of at least two weapons as determined by the Examination Committee in order to determine whether the weapon is in a loaded state;
(b) demonstrate the partial disassembly and composition of at least two different types of weapons, as determined by the Test Panel, to the extent necessary to clean up the weapon after the shooting;
(c) demonstrate the procedure for the preparation of the weapon and ammunition for the shooting, for the interruption of the shooting, for the detection of a defect in the weapon during the shooting and at the end of the shooting; and
(d) demonstrate knowledge from the shooting control procedure.
(2) In order to demonstrate the activities referred to in points (a) to (c) of paragraph 1, the types of weapons corresponding to all arms licence groups shall be used, and ammunition shall be taken as ammunition, not containing bulletins, impactor or match matches.
Overall test evaluation
(1) The overall assessment of the test consists of an evaluation of the theoretical part and the practical part of the test. The results obtained during the test shall be assessed by the test panel by the degree "benefit 'or" benefit'. The degree of evaluation shall be indicated in the test form of the applicant, the model of which is set out in Annex 2.
(2) The theoretical part of the test is assessed by "benefit" if the applicant correctly answers without help and aids within 80 minutes at least 57 questions from the test and subsequently confirms the knowledge provided for in Section 30 (7) of the Act in an oral interview.
(3) The practical part of the test shall be assessed by the "benefit 'level if the applicant demonstrates that the activities referred to in Section 8 (1) have been managed.
(4) The examination shall be assessed by the test panel by "benefit 'if the applicant reaches" benefit' from both parts of the assessment.
(5) If, in the practical part of the test, the applicant endangers the safety of persons by self-inflicted, the test committee shall immediately terminate the test and evaluate the test with the "no benefit 'grade.
Issue of a pilot's licence
The Ministry of the Interior shall issue to the Examination Commissioner, after his appointment, a certificate of the Examination Commissioner and send it to the competent police department for transmission. The Ministry of Interior shall inform the Examination Commissioner of the issue of the licence and invite him to be taken over by the relevant police department.
The applicant's proficiency test for the issue of a group F weapons licence
(K § 21a (8) of the Act)
Content of the theoretical part of the test
The theoretical part of the test is carried out by a test consisting of 50 questions, 12 of which are from knowledge of legislation, 10 of them from knowledge of regulations governing the handling of ammunition and explosives, 25 of them from knowledge of ammunition, explosives and detection techniques, and 3 of them from knowledge of medical minima. The correct answer to each question is evaluated by 3 points, except for the correct answers to questions about knowledge of the medical minimum, which are assessed by 1 point. The theoretical examination shall also include an oral interview lasting no more than 45 minutes by which the applicant certifies knowledge under Section 21a (3) of the Act.
Content of the practical part of the test
In the practical part of the examination, the applicant shall gradually demonstrate all the acts contained in Section 21a (4) of the Act.
Overall test evaluation
(1) The overall assessment of the test consists of an evaluation of the theoretical part and the practical part of the test. The results obtained during the test are assessed by the Test Committee (1a) by a "benefit 'or" benefit' assessment. The degree of evaluation shall be indicated in the assessment form for the proficiency test, the model of which is set out in Annex 24.
(2) In the theoretical part of the test, the applicant shall be assessed by "benefit 'if, without the aid, he obtains at least 135 points from the test within 60 minutes and subsequently certifies knowledge in accordance with the provisions of Section 21a (3) of the Act.
(3) If, in the theoretical part of the test, the applicant is assessed as "non-profit ', the practical part of the test is no longer performed and the overall result is assessed as" non-profit'.
(4) In the practical part of the test, the applicant shall be assessed as "benefit 'if he can handle the activities referred to in Section 10b.
(5) If, in the practical part of the test, the applicant infringes the principles for the safe handling of ammunition and explosives, thereby endangering the safety of persons in practice, the test committee shall terminate the test and assess the "non-profit 'level.
(6) An applicant who, in the theoretical part of the examination, has been assessed as "benefited" and in the practical part "failed" may once repeat the practical part of the examination on the basis of a written request submitted to the Ministry of Interior within two months of the date on which the practical part of the examination failed.
METHOD OF EVIDENCE AND DOCUMENTATION
(Paragraph 39 (5) and (8) of the Law)
Record book of weapons and ammunition
(1) The holder of the arms license2) keeps a register of weapons of category A, B or C and ammunition in those weapons which are owned and not the subject of the activities referred to in § 2 (2) (d) of the Act, in the record book of weapons and ammunition (hereinafter referred to as the record book).
(2) The record book shall state:
(a) the serial number of the registration;
(b) the date of acquisition or transfer of the weapon or ammunition;
(c) weapon or ammunition data, 3)
(d) personal data of a natural person (4) or data identifying a legal person (4) from which the holder of the arms licence has acquired a weapon or ammunition;
(e) personal data of a natural person (4) or data identifying a legal person (4) to which ownership of the weapon or ammunition has been transferred;
(f) the name, surname and signature of the person making the registration.
Record book of weapons and ammunition
(1) The holder of an arms licence (2) keeps a register of weapons of category A, B or C and ammunition in those weapons which are the subject of the activities referred to in § 2 (2) (d) of the Act, in the register of weapons and ammunition (hereinafter referred to as the register).
(2) The register shall state:
(a) the serial number of the registration;
(b) the date of acquisition, transfer, transfer or taking over of the weapon, ammunition, black hunting powder, powder or matches;
(c) the reason for the acquisition, transfer, transfer or taking over of a weapon, ammunition, black hunting powder, free powder or matches;
(d) particulars of the weapon, (3) ammunition, black hunting powder, dust-free or matches;
(e) personal data of a natural person (4) or data identifying a legal person, (4) from which a weapon, ammunition, black hunting powder, free powder or matches were acquired;
(f) personal data of a natural person (4) or data identifying a legal person, (4) to which ownership of a weapon, ammunition, black hunting powder, dust or matches have been transferred or to which a weapon, ammunition, black hunting powder, powder or matches have been left, including authorisation;
(g) the name, surname and signature of the person making the registration.
Book of dispensing and receiving weapons and ammunition
(1) The holder of an arms licence (2) shall keep a register containing an overview of the arms issued and received in category A, B or C and the ammunition into those weapons in the arms and arms and ammunition supply book (hereinafter referred to as "the issue and receipt book").
(2) The book of expenditure and income is divided into "issued" and "returned." In the book of dispensation and income, when dispensing and receiving weapons and ammunition,
(a) the serial number of the registration;
(b) under the heading "Issued"
1. date of issue of the weapon and ammunition;
2. weapon data, 3)
3. species and number of ammunition issued,
4. the name, surname, license number and signature of the person who received the weapon or ammunition;
(c) under the heading "Returned"
1. date of return of the weapon or ammunition;
2. the number of weapons or ammunition returned;
3. the signature of the person who took over the returned weapon or ammunition.
A book on practice shooting
(1) The holder of an arms licence (2) shall keep a register containing an overview of the training shootings carried out in the book on training shootings carried out (hereinafter referred to as the "shooting book").
(2) The book of shots shall state:
(a) the serial number of the registration;
(b) date of execution of the shooting;
(c) the name, surname and date of birth of the shooting person.
(3) The arms dealer will confirm the data check in the book by signing it.
Record book on unexploded ammunition and explosives
(1) The holder of a weapons licence (2) keeps documentation on the findings of unexploded ammunition and explosives in the record book on the findings of unexploded munitions and explosives (hereinafter referred to as the "Found Book").
(2) The list of findings shall include:
(a) the serial number of the registration;
(b) the place, date and time of the finding of unexploded ammunition or explosives;
(c) data identifying unexploded ammunition or explosive;
(d) the quantity of unexploded ammunition or explosives found;
(e) the date and time of deactivation;
(f) the date and time of receipt of the unexploded ammunition or explosives by a member of the Police of the Czech Republic, his identification number and signature; and
g name, surname and signature of the person making the registration.
Common provision
(1) Only the persons referred to in Article 32 (1) (d) and (e) or Article 40 of the Act and in the register of findings are to be carried out by the holders of an F-licence. Types shall be used to record all data which allow indelible written records. In the case of repair of the registration, this shall be crossed out so that the entry remains legible.
(2) The books referred to in Sections 11 to 14 are kept separately for each category of weapons.
(3) The books referred to in paragraph 1 shall be adapted in such a way as to avoid confusion, loss or replacement of individual sheets. The title of the book shall appear on the front of the cover and for which category of weapons it is maintained. The individual sheets of the book shall be marked with order numbers of the sheets.
(4) On the inside of the cover of the book is stated
(a) a serial number,
(b) personal data of a natural person (4) or data identifying a legal person, (4) keeping a register;
(c) the number of sheets of the book;
(d) the date on which the book was taken into use and the date of its closure;
(e) the signature of a representative of a natural or legal person.
(5) The books referred to in paragraph 1 may be kept in the form of an entry on a data medium bearing an electronic signature in accordance with a specific legislation, (5) the recording data recorded on the data medium shall also be recorded graphically in paper form. The contents of the books remain intact.

(1) The Annexes provide a model for the assessment of the applicant's competence for the issue of an arms licence (No 1), for the examination of the applicant for the appointment of an examiner (No 2), for the arms licence (No 3), for the arms licence (No 4), for the design of a arms licence (No 9), for the issue of an arms licence (No 11), for the issue of an arms licence (No 12), for the issue of an arms licence (No 13), for the issue of an arms licence (No 17), for the issue of a gun arms licence (No 10), for the issue of a gun licence (No 14), for the authorisation of a transport (No 15), for the issue of an arms licence (No 16), for the operation of a gun (No 13), for the issue of a gun authorisation of a gun (No 17), or for the production of a weapon of a gun or of a weapon of a weapon (No 9), for a weapon of a weapon of a gun (No 10), for the issue of a gun (No 10), for the issue of a weapon of a weapon of a certificate of a gun
(2) The Ministry of the Interior shall publish electronic forms in accordance with the models set out in paragraph 1 in a way that allows remote access.
FINAL PROVISIONS
Decree No. 50 / 1996 Coll., on the implementation of certain provisions of the Firearms Act, is hereby repealed.
Efficacy
This Decree shall take effect on 1 January 2003.
