Government Decree No. 383 / 2024 Coll.

(1) The birds' zone of the Western Krusty Mountains (hereinafter referred to as the "bird area") is defined.

(2) The protection of the birds' areas consists of the populations of tetrus (Lyrurus tetrix) and of the red cheese (Aegolius funereus) and their biotopes.

(3) The aim of the protection of the birds' area is to preserve and restore ecosystems relevant to the species for which the bird's area is defined, in their natural area of extension and to ensure conditions for the conservation of the populations of those birds' species in a conservation-friendly state.

(1) The birds' area is situated in the territory of the Karlovy Vary Region, in the cadastral territories of the Dar, Jáchymov, Ryžovna, Nábečná, Abertamy, Divers, Horní Blatna, Pernink, Trout near Merklín, Oldřichov near Nedek, High Štola, Nové Hamry, Deer near Nové Hamra, Rolava, Chaloupka near Přebuze, Přečí, Milíř u Šindelová a Šebrná.

(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.

(3) Detailed map materials in which the territory of the bird aredrawn are stored in the central conservation lists1).

(1) Only with the prior agreement of the competent nature conservation authority may the birds' area outside the built-up area and the stalled areas of the municipalities:

(a) to change the type of land or the way it is used (2);

(b) carry out activities causing a change in the level of established surface or groundwater level which could cause a change in the biotope of the bird species for which the bird area is defined;

(c) maintain drainage systems;

d) organise sports competitions and other events with mass participation carried out outside permanent sports areas and marked tourist routes;

(e) to mark new hiking, cycling, riding and skiing routes;

(f) conduct an aerial application of biocides and substances which may alter the chemical properties of the soil environment;

(g) use rodent control products in the agricultural and forestry sector; or

(h) in the period from 1 January to 31 May of the calendar year, feed and feed the game, except for hay feeding, excluding feeding establishments, in particular hay and fodder.

(2) Prior consent of the competent nature conservation authority is not required

(a) the activities referred to in paragraph 1 (b), where this is a procedure carried out in accordance with the Water Code (3);

(b) the activities referred to in paragraph 1 (c) in the case of the maintenance of a forest road for year-round operation and the maintenance of a forest road for seasonal operation;

(c) for the activities referred to in paragraph 1 (h), where they are carried out in the winter industry;

(d) in the implementation of road operations4); or

(e) the activities referred to in paragraph 1 in the case of activities carried out under the Mining, Explosive and State Mining Act, the Geological Labour Act or the Mining Act (5), in the designated conquest area or in the exploration area for deposit exploration.

This Regulation shall take effect on 1 January 2025.

Borders From the eastern edge of the land, the birds of the Western Krušné hora have a partyte number (hereinafter "No. ') 1043 in the cadastral territory (hereinafter" K. O.'). The border of the bird area continues west on the state border (approx. 14 km) to the forest road leading to the hill Zadní Obražnik. Here, the border of the bird region is disconnected from the state border and replicates the forest path 400 m to the crossroads, where the border of the bird area turns to another nameless forest path to the east, which then turns south to below the hill Vyštek. Below the peak, the border of the bird area is set in a southeast direction along the forest roads through the Skalina site up to road 21012 at the bridge via the Silver stream.
