laying down principles for the establishment of an emergency planning zone and the scope and manner of drawing up an external emergency plan for accidents caused by selected hazardous chemicals and chemical products
According to Article 12 (10) of Act No 353 / 1999 Coll., on the prevention of major accidents caused by selected hazardous chemicals and chemicals and amending Act No. 425 / 1990 Coll., on District Offices, the modification of their responsibilities and on certain other measures related thereto, as amended, (Act on the Prevention of Major Accidents):
Principles for setting the emergency planning zone
(1) The district office in whose territorial area an object or device is located, (1) in which dangerous substances are produced, processed, used, transported or stored, (2) (hereinafter referred to as the "risk source"), which has been committed by agreement or has been designated by the Ministry of the Interior, establishes an emergency planning zone and establishes an external emergency plan.3)
(2) The emergency planning zone (4) does not cover the territory for which the operator (5) processes the internal emergency plan.6) The ground-floor perimeter of the area for which the operator processes the internal emergency plan is the internal boundary of the emergency planning zone. If the area bounded by the external boundary of the emergency planning zone is equal to or less than the area bounded by the internal boundary of the emergency planning zone, the emergency planning zone shall not be determined.
(3) The external borders of the emergency planning zone are:
(a) a circle whose radius measured by the air line is twice the parameter R, which is concentrated with the smallest circle inscribed around the floor projection of the source of risk; the supporting documents for parameter R and the method for determining it are set out in Annex 1;
(b) a curve derived as a boundary for the unification of multiple surface areas of other sources of risk referred to in paragraph 6; or
(c) the curve established otherwise in accordance with paragraph 4.
(4) The district office shall choose the external boundary of the emergency planning zone referred to in paragraph 3 (c) if:
(a) the internal boundary of the emergency planning zone intersects the external geometric boundary of the emergency planning zone established in accordance with paragraph 3 (a);
(b) the radius of the smallest circle inscribed around the floor projection of the source of danger is greater than one fifth of parameter R [paragraph 3 (a)],
(c) the procedure for determining the parameter R as set out in Annex 1 is not appropriate for a given source of risk; or
(d) there are other expert-based and state-of-the-art oversight on the major accident prevention section (7) discussed specific reasons for other means of choosing the external boundary of the emergency planning zone.
(5) If the source of risk includes different hazardous substances, (2) the highest parameter R determines the choice of the external boundary of the emergency planning zone.
(6) Where additional sources of risk are found between the internal boundary of the emergency planning zone and the external boundary of the emergency planning zone which may increase the risk to the population by cumulative or synergistic effects of a further accident caused by the accident of the risk source under assessment (hereinafter referred to as "site of the chain of action of the accident '), the district office of the emergency planning zone shall set the external boundary of the emergency planning zone in accordance with one of the procedures referred to in paragraphs 3 to 5 and adjust the external boundary of the emergency planning zone of all risk sources under paragraph 3 (b).
(7) The external boundary of the emergency planning zone determined by one of the procedures referred to in paragraphs 3, 4, 5 and 6 shall be adjusted by the district office according to local urban, cadastral, terrain, demographic and other similar circumstances.
(8) The district office will mark the internal and external boundaries of the emergency planning zone in the map base.
Scope and method of drawing up the external emergency plan
(1) Where the emergency planning zone is situated in the territory of two or more counties, the competent district authorities shall process the sub-parts of the external emergency plan for the relevant part of the territory of their district and transmit them to the district office in whose territory the risk source is located, which has been committed by agreement to the development of the external emergency plan or which has been designated for the preparation of the external emergency plan, 8) (the "coordinating district office"). The coordinating district office shall draw up an external emergency plan for the entire emergency planning zone.
(2) The competent district authorities shall identify or determine the radii of the external borders of the emergency planning zones for those sites of the chain effect of the accident located in their territory and transmit them to the coordinating district office.
(3) The development of an external emergency plan is based on written documentation from and in cooperation with the operator (9), (10) a security programme for the prevention of a major accident, (11) a safety report (12) and sub-documents processed by individual components of the integrated rescue system. The expression of the authorities concerned and the legitimate comments of the public and municipalities in the emergency planning zone shall also be used for processing. 13) In particular, written declarations of legal and natural persons authorised to do business under a special law shall be used to identify the sites of the chain-effect of the accident. 14)
(4) The Head of the Coordinating District Office ensures coordination of the preparation of the external emergency plan, 15) unifies the process of the relevant district authorities in the processing of parts of the external emergency plan, proposes and discuss any changes thereto. The external emergency plan shall be discussed with the operator and shall ensure public consultation. 16)
(5) The external emergency plan is always processed in paper and electronic form (files, digital maps).
(6) The scope and manner of processing the external emergency plan is set out in Annex 2.
(1) The approved external emergency plan shall be transmitted by the head of the District Office for the deposit of the district fire brigade (17) and the operator.
(2) Territorial or district centre of medical emergency services, 18) Regional (urban, district) Directorate of Police of the Czech Republic, other components of the integrated rescue system, the authorities concerned and the municipalities in the emergency planning zone will receive relevant extracts from the external emergency plan together with information on the establishment of the zone. The transmission of extracts from the external emergency plan shall take place in accordance with Article 2 (5).
(1) If a change is made not related to an operator's activity which has an impact on emergency preparedness, an amendment to the external emergency plan shall be made without delay after the county authority has established this fact.
(2) Verification of the external emergency plan in terms of its actual19) may be carried out by administrative, exercise or combination of both methods.
Efficacy
This decree shall take effect on the day of its publication.

Documentation for parameter R and method of its determination (§ 1 (3) (a))
I. Procedure of the District Office
(a) Determination of the area.
In determining the area, the size of the territory under consideration shall choose the surrounding risk source and shall process the general characteristics of the territory under consideration. As a general rule, the territory under consideration is an area of 10 - 200 km2, comprising the territory of one or more municipalities or the administrative district of the county office concerned or an area with concentrated industrial activity or concentrated housing.
(b) an inventory of activities and an overview of the types of hazardous chemicals, their quantities and location.
It shall collect information on stationary facilities with hazardous substances (14) (even with less than those applicable to sources of risk), routes and modes of transport of dangerous substances. It shall identify the hazardous activities presenting an increase in risk to the population (examples in Table 2) with further information needed for their classification according to physical, chemical, technical and technological characteristics and conditions; it shall, after classification, draw up a list of dangerous substances and activities (hereinafter referred to as "the list ').
(a) Assessment of the quantities of substances.
For individual installations, estimate the maximum amount of hazardous substance or hazardous substances that may be involved in an accident under realistic conditions. It is based on the design dimensions of individual parts of the technological nodes and the greatest load capacity or volume of service trucks, tankers, railway wagons etc. If the device has sufficient physical or effective separation between storage tanks of dangerous substances, only the contents of the largest tank shall be considered when estimating the quantities. The distance between tanks avoiding cumulative effects caused by fire, explosion or breakdown of any part of the equipment under consideration shall be considered as physical separation. The existence of separate sinks on individual tanks with sufficient distance between the edge of the pit and other tanks or the use of automatic safety fittings on connected tanks' pipelines or mechanical barrier between tanks shall be considered as effective separation. The use of open connection between tanks or the use of manually operated fittings is not considered to be sufficient physical or effective separation. The estimated maximum quantities shall be assigned to the list to the individual hazardous substances concerned.
(d) Assignment of reference numbers to hazardous substances, respectively sources of risk.
In the list referred to in point (c), taking into account their type and known physical conditions, they shall assign a reference number in accordance with Table 1 and verify that it conforms to the reference number of the same substance assessed simultaneously with the type of activity or hazardous activity and the nature of the technology referred to in Table 2 and, where appropriate, to the reference number obtained taking into account the type and description of the substance in relation to the type of activity referred to in Table 4. In the event that a single reference number cannot be clearly assigned from Tables 1, 2 and 4 to the assessed source of risk or to the assessed hazardous activity or to a dangerous substance, two or more possible reference numbers shall be entered in the list and the next procedure shall be carried out according to all those numbers.
(e) Replacement determination of toxicity class.
When assessing the toxicity of a dangerous substance not listed in Table 1, its toxicity class for the purpose of this procedure may be determined according to the following auxiliary rules and using Tables 1a, 1b, 1c:
1. If the saturated vapour pressure is less than 0,1 MPa at 20 ° C, the substance shall be considered a liquid.
2. If the saturated vapour pressure is greater than 0,1 MPa at 20 ° C, the substance is considered to be a gas.
3. From the sum of the calculation number (a) derived from the LC50 according to Table 1 and the calculation number (b) derived from the physical properties according to Table 1b, the requested toxicity class is obtained using Table 1c.
(f) Reducing the list.
The following may be excluded from the list:
1. dangerous activities which do not pose a direct threat to the damage to the population due to the distance of populated areas. The reduction of the list according to the criteria of this selection for stable equipment and transport is shown in Table 3;
2. roads and roads with thin operation of dangerous substances. The reduction of the list according to the transport density criterion shall be carried out in accordance with Table 3a;
3. transport in water soluble liquids whose vapour pressure is less than 0,1 MPa at 20 ° C and transport of liquids with a specific mass greater than the specific mass of water, in the case of inland waterways. Exceptions are liquids that can react dangerously with water or air to produce products more toxic than the substance itself. In such cases, the quantity of dangerous reaction products shall be determined by an expert estimate;
4. parts of selected roads, railway routes, waterways or pipelines which do not meet the distance to populated areas criteria in Table 3. Parts shall be selected over a length of 1 km and a place closest to the populated area shall be selected for assessment within each part. In the case of transport by rail, special attention shall be paid to trains. For waterways, special attention shall be paid to ports.
g) Repeating or stopping the procedure.
If, following a reduction in the list, it is clear that there is a source of risk in the area under consideration with a single isolated installation without any link to other hazardous activities, it shall increase the area under consideration approximately twice the area under consideration and a new list shall be established; If this is not appropriate because there is no additional source of risk in the territory thus enlarged, the next procedure shall be terminated. It is further followed by Article 1 (3) of the Decree.
h) Assignment of R parameters to list entries.
The corresponding R parameters shall be assigned to each reference number included in the list using Tables 4 and 4a or Table 4b and the known quantities of the substance in tonnes estimated in accordance with point (c). If Table 4a contains a capital letter X instead of the numerical value of the parameter, the combination of the substance and its quantity, which in practice is not present or cannot exist. However, if such a value is achieved, parameter R corresponding to twice the nearest quantified value of parameter R of the same substance or expert estimate shall be used. If the table contains a symbol (-), the effects of the substance are negligible.
(i) Determination of parameter R.
If a single R value has been assigned to an item in the list, the R value shall be considered to be the defined value of the R parameter according to § 1 (3) (a) of the Decree. Where more than one reference number has been assigned to one substance or hazardous activity in accordance with point (d) of this procedure and thus has been obtained for one entry in the list of multiple R values, for the purposes of Section 1 (3) (a) of this Decree, the largest of these values shall be determined as the R parameter.
II. The models of possible methods of establishing the external boundary of the emergency planning zone are shown in Figures 1 to 5.

Scope and method of processing the external emergency plan
The external emergency plan contains a text and graphic section. The text section contains information and operational information and plans for specific activities. The graphic section is used for the graphic display of basic information of the text section and contains maps, 20) graphs, diagrams, deployment of forces and means, deployment methods etc.
In order to address a major risk accident, the territory of the emergency planning zone may be divided into two or more sectors. Depending on the direction or manner of spreading the consequences of the accident and the monitoring results, the measures provided for in the external emergency plan will be applied in the sectors (their groups). The relevant measures shall be processed by the District Office according to the specific characteristics of the hazardous substance and the scenarios (22) of its activity outside the risk source of the accident for each sector. In the immediate vicinity of the source of risk or near the point of penetration of the substance into the water stream, etc., appropriate and pre-determined measures shall, as a general rule, be applied regardless of the extent of the spread of hazardous substances in the accident and the results of the monitoring of the situation ("emergency measures'). The precise course of sectoral borders will be adapted to local urban, cadastral, terrain and demographic conditions.
Safeguard measures shall be planned in the form of specific action plans for the relevant parts of the emergency planning zones, their selection and the way in which they are processed shall be chosen in proportion to the size of the zone and the nature of the threat.
The external emergency plan shall be divided into:
A. Information
(1) The information part contains:
(a) the characteristics of the territory, in particular geographical, demographic, climatic, hydrogeological and description of the infrastructure;
(b) housing units including an overview of the population;
(c) a description of the organisation structure of emergency preparedness in the emergency planning zone, including an indication of the competence of its constituents;
(d) the supporting documents transmitted to the district office by the operator established in the established manner, 23)
(e) the list and characteristics of the major accident effects considered by the processed risk analysis, including a description of their expected consequences (e.g. chain effects);
(f) a list of all internal emergency plans of risk managers.
(2) The district emergency plan shall be used to process the parts referred to in (a) and (b). 24)
B. Operational part
(1) The operational part shall include an overview of the measures prepared, which shall be carried out following notification of the suspected or the occurrence of an accident by the operator. The District Office shall develop the solutions to the individual measures, depending on the expected situation and its expected time sequences, including agreements on the security tasks of each administration in implementing urgent measures. The implementation of individual measures shall be ensured according to the plans for specific activities, depending on the nature of the accident.
(2) The operational part contains:
(a) the tasks of the competent administrative authorities, the components of the integrated rescue system and, where appropriate, the other administrative authorities concerned, including the tasks, forces and resources of other natural and legal persons in an accident;
(b) the way in which a major accident is coordinated;
(c) criteria for declaring a state of emergency;
(d) the method of ensuring information flows in the management of the destruction of the consequences of the accident;
(e) the principles of action in extending or extending the consequences of an accident outside the emergency planning zone and the system of connection and cooperation of the administrations concerned.
(3) The operational part contains ways, procedures and forms of information to the population in the emergency planning zone, 25) including their pre-prepared content.
C. Plans for specific activities
Plans for specific activities shall be processed in particular for:
(a) notification of the authorities concerned and of natural and legal persons, in particular natural and legal persons at risk of a major accident;
(b) warning of the population;
(c) the cover of the population;
(d) prophylaxis of antidotes;
(e) intervention of the components of the integrated rescue system;
(f) evacuation of persons;
(g) individual protection of persons;
(h) decontamination;
(i) monitoring;
(j) regulation of movement of persons, regulation of transport;
(k) medical assistance;
(l) measures to protect livestock;
(m) preventing the distribution and consumption of food, feed and water affected by intoxication by a dangerous substance;
(n) measures for the death of persons in the infected area;
(o) measures to minimise impacts on environmental quality;
(p) ensuring public order and security.
Notification
(1) Notification means the immediate transmission of information on suspected or imminent accidents.
(2) For the purpose of notification, a notification plan shall be drawn up containing:
(a) the names and names of the ingredients concerned, addresses and means of contact to:
1. operational centres operating on the territory of the district;
2. the relevant authorised staff of the District Office,
3. the relevant staff of the other components of the integrated rescue system,
4. other district offices in the emergency planning zone and operational centres in their territory, or other district offices concerned by the planned measures,
5. Other territorial administrations concerned,
6. the national central administrative offices and operational centres concerned,
7. natural and legal persons at risk of a major accident, including the names of the persons responsible.
(b) the necessary extract from the operator-secured notification system or a description of the means of notification which the operator is able to secure (e.g. the start of the siren).
(3) The notification plan shall specify for each of the intervening components of the integrated rescue system and authorised personnel of district and other local authorities the essential activities carried out after the notification (e.g. alarm announcement, collection security).
Population warning
A population warning plan shall be prepared for the purpose of warning the population, based on evidence of an operator-secured warning and shall include:
(a) the chosen way of warning the population, including a description of the activity to be carried out by the population after warning;
(b) ensuring the implementation of the chosen method by organisational and technical mechanisms;
(c) a alternative way of warning the population by other means in the event of failure of the chosen way of warning.
Hiding the population
(1) Hiding the population is an urgent protective measure which, depending on the nature of the dangerous substance, is prepared as an immediate response of the population to the warning.
(2) For the purposes of concealment, a cover plan shall be drawn up containing:
(a) means and places suitable for hiding persons in the emergency planning zone;
(b) principles for the behaviour of the population in hiding.
Prophylaxis of antidotes
(1) Prophylaxis of antidotes means an urgent protective measure consisting of the ingestion of antibodies, which, depending on the nature of the dangerous substance, may in some cases be prepared as an immediate reaction of the population to a warning or the ingestion of antibodies is carried out at the call.
(2) For prophylaxis of antidotes, a prophylaxis plan containing:
(a) the principles governing the imposition and treatment of prophylactic agents in the population;
(b) methods of distribution, replacement and use of prophylactic agents.
Intervention of components of the integrated rescue system
(1) For the purpose of the profession of predetermined forces and devices, an integrated rescue system alarm plan shall be prepared containing:
(a) a list of the components of the integrated rescue system intended to perform the accident tasks;
(b) the manner in which those components are notified and the occupation;
(c) equipment for protective and technical equipment;
(d) predetermination for the performance of specific tasks;
(e) the likely location of their deployment;
(f) arrival and departure routes.
(2) A deployment plan shall be drawn up for the deployment of pre-determined forces and resources, which shall include:
(a) specific possible deployment;
(b) the tasks performed;
(c) the procedure for managing the intervention;
(d) material, technical and medical security of the components of the integrated rescue system.
Evacuation of persons
(1) Evacuation of persons means an urgent safeguard measure to be taken when fulfilling the conditions set out in the operational part of the external emergency plan.
(2) An evacuation plan shall be prepared for the evacuation of persons. The evacuation plan shall include in particular:
(a) a list of the forces and means to ensure evacuation;
(b) the manner in which they are informed, equipment, preparation and occupation;
(c) the number of persons to be evacuated and the places from and where they will be evacuated;
