DECLARATION
of 29 November 2011
amending Decree No 215 / 2008 Coll., on measures to prevent the introduction and spread of harmful organisms of plants and plant products, as amended
According to Article 88 (1) (b) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the Amendment of Certain Related Acts, as amended by Act No. 131 / 2006 Coll., Act No. 249 / 2008 Coll., Act No. 291 / 2009 Coll. and Act No. 245 / 2011 Coll., ("the Act '):
Decree No 215 / 2008 Coll., on measures to prevent the introduction and spread of harmful organisms of plants and plant products, as amended by Decree No 159 / 2009 Coll. and Decree No 76 / 2010 Coll., is amended as follows:
1. In Article 1, the words "the European Communities (hereinafter referred to as the Community) 'are replaced by the words" the European Union'.
2. In footnote 1, the words "European Communities' are replaced by the words" European Union '.
3. in Article 3 (4) (a), in Annex 1, Part A, under Section I, "Community parts" shall be replaced by "European Union parts."
4. In Article 3 (4) (a) and (b), Annex 1, Part A, Section I and Section II, Annex 2, Part A, Section I and Section II and Annex 9, Part And the heading of Section I is replaced by "the whole of the Community '.
5. in Article 3 (4) (b), in Annex 1, Part A, the title of Section II, Annex 2, Part A, the headings of Sections I and II and footnotes 1 and 2, Annex 4, Part A, Section I, point 49.2, second column, point (b), third indent, and point 28.2, second column, point (b), fourth indent, the words "in the Community" shall be replaced by "in the European Union."
6. in Article 3 (4) (b), the words "the whole of the Community" shall be replaced by the words "the whole of the European Union."
7. In Section 5 (12) of Annex 1 to the title of Part A, Annex 2 to the title of Part A, Annex 3 to the title of Part A, Annex 4 to the title of Part A, Section II, point 18.2. of the second and third indents of Annex 6 to the form 11 and the heading of Annex 9, the words "the territory of the Community 'are replaced by the words" the territory of the European Union'.
8. Paragraph 10 (3) and (4) are deleted.
9. in Articles 15 (2) (a) and 15 (5) to (8), "EC" is replaced by "EU."
10. In Paragraph 19 (1), the words "Community languages' are replaced by the words" European Union languages'.
11. In the heading of Section 22, "7 'is replaced by" 9'.
12. in Paragraph 22 (1), "3" is replaced by "4."
13. in Paragraph 22 (2), "Community goods" is replaced by "European Union goods."
14. In the heading of Section 23, "7 'is replaced by" 9'.
15. in Article 23 (2), "5" is replaced by "6."
16. In Section 32, the words "Reimbursement of property damage resulting from the imposition of emergency plant health measures and the particulars of the application for such reimbursement 'are replaced by the words" Forms of application for reimbursement of costs and losses arising from the implementation of the emergency plant health measures imposed'.
17. in Paragraph 32, paragraph 1 is deleted;
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
18. in § 32 (1) of the introductory part of the provision and § 32 (1) (e), the words "material damage" are replaced by the words "costs and losses incurred effectively."
19. In Paragraph 32 (2) of the Introductory Part of the provision, "2 'is replaced by" 1'.
20. in Paragraph 32 (2) (e), the words "the quantified property damage suffered" shall be replaced by the words "the calculated costs and losses incurred effectively."
21. In Annex 3, Part A, point 12, Part B, point 1, first column and point 2, first column, Annex 4, Part A, point 1.1., second column, points (b) and (c), point 1.2., second column, points (d), point 25.1., second column, point 25.4., point 25.2., point (c), point 1.5., point (e) and (f), point 1.6., second column, point (c), point 16.2., second column, point (c), point 16.3., second column, point (a), point 16.4., second column (b), point 16.5., point 16.2., point (a) and (b), point 16.2., point (c), point 16.3., second column, point (c), point 16.3., second column, point (a), point (b), point 16.4., point (b), point 16.5., point (b), point 16.5., second column, point (b), point 16.5., second column, point (b), point (b), point (b), point 16.5., second column (b), point
22. In Annex No 4, Part A, Section I, point 25.1, second column, point (b) and point 25.2, second column, point (b), the words "Community measures' are replaced by the words" European Union measures'.
23. in Annex No 4, Part A, Section II, point 18.1, second column, points (a) and (b) and point 18.5, second column, second column, introductory part, of the provisions, the words "Community measures" shall be replaced by "European Union measures."
24. In Annex 4, Part A, the title of Section II, the title of Annex 9 and the heading of Part A, the words "Community 'are replaced by the words" European Union'.
25. In point 21.1. of Part B of Annex 4 to the Introductory Part of the provision, the words "to the Community 'are replaced by the words" to the European Union'.
26. In the heading of Annex 6, the words "Community States' are replaced by the words" European Union States'.
27. In Annex No 6 to the title of the first column of the form, the words "European Community / European Communities' are replaced by the words" European Union / European Union 'and point 11 of the form is replaced by the words "the territory of the European Union'.
28. In Annex 7, Part A Section IV (5) (4) and (5) is replaced by "the European Union method '.
29. In the heading of Annex 9, "outside the Community 'is replaced by" outside the European Union'.
Efficacy
This decree shall take effect on the day of its publication.
