on the conditions for use of treated sludge on agricultural land
The Ministry of the Environment, in cooperation with the Ministry of Agriculture and the Ministry of Health, pursuant to § 33 (4) of Act No. 185 / 2001 Coll., on Waste and on the amendment of certain other laws, hereinafter referred to as "the Act":

ČÁST PRVNÍ

CONDITIONS OF USE OF PREPARED CALES ON AGRICULTURAL SOURCES
§ 1
Technical conditions for the use of treated sludge on agricultural land
Adapted apocalypse (1) may be used on agricultural land under the following conditions:
(a) no later than 48 hours after the sludge has been placed on the agricultural land, the sludge must be put into the soil;
(b) the need for the supply of nutrients to land on the land intended for the location of sludge must be demonstrated by the results of the analysis of the agrochemical properties of the soils indicated in the register of the use of sludge in agriculture referred to in Annex 1;
(c) no more than 5 tonnes of dry matter per hectare shall be used during 3 consecutive years. This quantity may be increased up to 10 tonnes of dry matter in 5 consecutive years if the sludge used contains less than half the limit quantity of each of the risk substances and elements monitored. The exact determination of the dry matter dose shall be calculated from the nitrogen content found. The dose of nitrogen delivered in the sludge shall not exceed 70% of the total amount of nitrogen required for the fertilised crop. The sludge dose (amount and duration of use) shall also be governed by the nutrient requirement of plants, taking into account the available nutrients and the organic component in the soil, as well as the conditions of the habitat;
(d) the sludge dose determined in accordance with the conditions referred to in paragraph (c) shall be applied to the parcel in one agri-technical operation and in one continuous period of time under favourable physical and moisture conditions;
(e) the minimum dry matter content of sludge for pressurisation into the soil by soldering applicators is 5%, the minimum dry matter content of sludge for application by mechanical spreading of organic fertilisers is 18%.
§ 2
Limits for the concentrations of selected soil risk substances and those that may be added to agricultural land
(1) In the soil on which sludges may be used, the concentration limits of selected risk substances listed in Annex 2 must not be exceeded.
(2) The total permitted intake of hazardous substances into the agricultural land by the use of sludge over 10 consecutive years is defined by the permitted dose of sludge referred to in § 1 (c) and the limit values for concentrations of the hazardous substances and substances listed in Annex 3.
§ 3
Limits for concentrations of selected hazardous substances and sludge elements and microbiological criteria for the use of sludge on agricultural land
Only sludges suitable for agricultural land may be used
(a) the limit values for the concentrations of selected risk substances and elements listed in Annex 3; and
(b) the microbiological criteria set out in Annex 4.
§ 4
Sampling procedures for sludge and soil and methods of analysis of sludge and soil
(1) Soil sampling and analysis ("soil monitoring") on land intended for the use of sludge and sludge sampling and analysis ("sludge monitoring") are provided by sludge producers. The proposal for soil monitoring and the minimisation of sludge on land intended for the use of sludge is part of the programme for the use of sludge on agricultural land under Section 5.
(2) Soil monitoring shall be carried out before first use of sludge and at regular 10-year intervals in accordance with specific legislation (m2) and to the extent specified in Annexes 1 and 2.
(3) Sampling and chemical and microbiological analyses of sludge shall be carried out on sludge monitoring to the extent and frequency specified in Annexes 3, 4 and 5. The following requirements shall apply to sludge monitoring:
(a) the determination of adsorbable organic halogens (AOX) and polychlorinated biphenyls in sludge shall be carried out each time before the first use of sludge;
(b) sampling of sludge shall be carried out according to ČSN EN ISO 5667; 3)
(c) samples of sludge for microbiological testing must be taken in such a way as to avoid secondary contamination, preserve them and transport them according to ČSN ISO 10381.4)
(4) Soil monitoring shall be carried out by persons entrusted with the Central Audit and Examination Institute under the specific legislature5) by the procedures specified in the specific legislation.6)
(5) The reference methods for analysis of sludge and soil samples are set out in Annex 6.
(6) The results of the monitoring of sludge and soil monitoring shall be shown on the register of the use of sludge in agriculture as set out in Annex 1, which is part of the sludge application programme referred to in Section 5. The annexes to the completed report are always protocols on soil monitoring and sludge monitoring. This report shall be kept by the sludge producer for 30 years.
§ 5
Content of the sludge application programme on agricultural land
(1) The sludge application programme processed by the sludge producer always contains:
(a) evaluation of sludge with regard to its use on agricultural land in accordance with Annexes 3, 4 and 5;
(b) a list of selected parcels intended for the use of sludge, including indicators for their assessment in accordance with Annex 2;
(c) hydrological conditions in the pet territory of the use of sludge;
(d) the inclusion of rotational sludge;
(e) a proposal for the monitoring of sludge and soil monitoring;
(f) sampling plan;
(g) measures to protect health at work with sludge.
(2) The sludges application programme shall include the records of the use of sludges in agriculture referred to in Annex 1.

Explanatory notes:
1) Limit values for the concentrations of selected elements in soil - define the maximum values for selected risk elements in soil which could be exceeded by damaging soil functions and environmental components
2) Soil categorisation:
(a) Common (sand-aluminium, aluminium and clay) which occupies most of the agricultural land used. Under the notion of common soil, we understand soil with normal variability of the element, with normal soil development in various geomorphological conditions in the areas of various pímitic, pellitic rocks sedimentary, acidic, neutral, places also basic rocks spilt and metamorphosed rocks. These are therefore soils which did not originate from geogenically and petrographically abnormal rocks such as sand, gravel, ultrabasic rock (snakes, amphibolites, leucites) and carbonate rock. These include areas where rocks or veins with a high degree of metallogenetic reddening are involved in soil formation.
b) Sand, on very light and poor mother rocks such as sand and gravel. In the case of the definition of these soils, it is necessary to base the representation of fine particles (up to 10 µm), which shall not exceed 10%. For sand soils on sand, gravel and gravel, this is mainly due to low sorption capacity, even in the case of direct use of raw materials with normal levels of risk elements, there is rapid pollution of groundwater and river water.
(c) Soils on substrates with geographically conditioned extreme contents of certain elements. These soils are assessed separately and the background reference values do not apply to them. For the soil on other geologically extreme rocks, these upper limits of the reference values of the elements are not established because their values in these rocks are often significantly unbalanced and high, especially for Cr, Co, Ni, throughout the soil profile.

Category II - sludges which may be applied to agricultural land intended for the cultivation of technical crops and to land on which field vegetables and intensely fertile fruit crops will not be grown for at least 3 years after the application of sewage sludge, while respecting the principles of occupational health and other provisions of the Decree.
