of 11 June 2004

declaring the National Nature Reserve of the Žofín Forest, laying down its close protection conditions and protection zone and amending Decree No. 395 / 1992 Coll., implementing certain provisions of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended

The Ministry of the Environment provides, pursuant to § 79 (3) (b) with regard to § 28 (1) and § 37 (1) of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, hereinafter referred to as "the Act ':

ČÁST PRVNÍ

§ 1

Subject matter

(1) The National Nature Reserve of the Žofín Forest ("National Nature Reserve") is hereby declared.

(2) The object of the protection is the preserved remnant of the original forest-based forest area, left to the spontaneous development, which is an example of the mixed mountain beets typical of the Novohradské hory region, as well as the fragments of the adjoining sown spruce and peat spruce and the assembly of forest springs.

§ 2

Definition of the national nature reserve

(1) The national nature reserve is situated in the South Bohemia region in the cadastral territory of Pivonice near the Pohorská village. The national nature reserve boundaries are determined by a closed geometric pattern with direct sides whose vertices are determined by the coordinates given in the S-JTSK1 coordinate system). The list of coordinates of the vertices of the geometric pattern as they follow is given in Annex 1, which is an integral part of this decree. The indicative graphical representation of the national nature reserve is given in Annex 3.

(2) The map documents in which the national nature reserve is drawn are stored in the Central Nature Protection List (Section 42 of the Act).

§ 3

Closer protection conditions for the national nature reserve

Only with the prior consent of the competent nature conservation authority (§ 44 (2) and § 79 (3) (g) of the Act) can the national nature reserve:

(a) make a change to the type of land and the way it is used (2);

(b) to conduct interference with the riverbed or banks of watercourses;

(d) to store even temporarily wood or other materials;

(e) carry out geological work linked to the intervention of the territories (4);

(f) establish hunting or fishing facilities.

§ 4

Protection zone

The protection zone of the national nature reserve is situated in the South Bohemia region in the cadastral territory of Pivonice near the Pohorská village. The national nature reserve protection zone boundaries are established (Section 37 (1) of the Act) by a separate closed geometric pattern with direct sides whose vertices are determined by the coordinates given in the S-JTSK1 coordinate system). The list of coordinates of the enclosed geometric pattern and its individual vertices arranged as follows in the pattern is given in Annex 2. An indicative graphical representation of the national nature reserve protection zone is given in Annex 3.

In Annex V, the words "Žofín forest CK Pivonice Decision of the Owner 1838 and the Decree of the Ministry of Transport No 143.547 / 33 (31.12.1933) 'are deleted.

This Decree shall take effect on 15 July 2004.
