DECLARATION
of 24 September 2025
on emergency services
The Ministry of Health provides pursuant to Section 120 of Act No. 372 / 2011 Coll., on health services and the conditions for their provision (Health Services Act), as amended by Act No. 290 / 2025 Coll., for the implementation of Section 7a (3) of the Health Services Act:
Subject matter
This decree sets out the requirements for minimum material and technical equipment and minimum personnel security of emergency services, including the minimum time range for their provision.
Medical emergency service for adults
(1) Adult medical emergency services must be provided to a minimum in time
(a) 3 hours continuously between 16: 00 and 22: 00 on a working day;
(b) 8 hours at a time of constant duration, while being provided at a fixed time from 10: 00 to 16: 00, on Saturday, Sunday and on the day of work.
(2) The emergency medical services for adults must be provided at least by personnel
(a) by a physician with specialised competence following a baseline strain of general medical practice, internal, surgical or anaesthesiologic; or
(b) a doctor with professional competence and a certificate of completion of a baseline strain of general medical practice, internal, surgical or anaesthesiologic, provided that the medical emergency service for adults is part of an acute bed care medical facility and that the physical availability of the physician referred to in (a) is ensured within 15 minutes of the request; and
(c) a nurse-general; This requirement shall not apply if an adult medical emergency service is provided within an emergency reception facility.
(3) In the case of an adult medical emergency service provided in the context of an emergency reception, the requirements for the minimum physical and technical equipment of the workplace where that service is provided shall apply mutatis mutandis to the outpatient part of the emergency reception provided for by the legislation governing the minimum technical and physical equipment of medical facilities and contact works1). The workplaces must also be equipped to carry out rapid antigen tests for group A streptococci and to carry out rapid quantitative determination of C-reactive protein levels in the testing regime at the health care site.
(4) In the case of an adult medical emergency service provided outside an emergency intake, the requirements for minimum physical and technical equipment of the workplace where that service is provided shall apply mutatis mutandis to the minimum technical and material equipment of the outpatient care facilities in the field of general practical medicine provided for by the legislation governing the requirements for minimum technical and physical equipment of medical facilities and contact works2). The workplaces must also be equipped to carry out rapid antigen tests for group A streptococci and to carry out rapid quantitative determination of C-reactive protein levels in the testing regime at the health care site.
Emergency medical services for children
(1) Medical emergency services for children must be provided to a minimum in time
(a) 3 hours continuously between 16: 00 and 22: 00 on a working day;
(b) 8 hours at a time of constant duration, while being provided at a fixed time from 10: 00 to 16: 00, on Saturday, Sunday and on the day of work.
(2) The emergency medical services for children must be provided at least by personnel
(a) by a practitioner for children and adolescents, a pediatrician or a pediatrician; or
(b) a doctor with competence and a certificate of completion of the basic paediatric strain, provided that the medical emergency care facility for children is part of an acute bed care facility in the field of pediatric or paediatric medicine, while ensuring the physical availability of the physician as referred to in (a) within 15 minutes of the request; and
(c) a nurse of a child or a nurse of a general nature; This requirement shall not apply if the emergency medical emergency services for children are provided under urgent income.
(3) The minimum technical and physical equipment requirements for children's medical emergency services shall apply mutatis mutandis to the minimum technical and physical equipment of outpatient care facilities in the field of practical medicine for children and adolescents provided for by the legislation governing the minimum technical and physical equipment of healthcare facilities and contact works3). The workplaces must also be equipped to carry out rapid antigen tests for group A streptococci and to carry out rapid quantitative determination of C-reactive protein levels in the testing regime at the health care site.
Dental emergency services
(1) Dental emergency services must be provided at least within a time range of 4 hours continuously between 7: 00 and 15: 00 on Saturday, Sunday and working day.
(2) The requirements for the minimum physical and technical equipment of the dental emergency service workplace and the minimum staff security of that service shall apply mutatis mutandis to the requirements for the provision of outpatient dental care laid down by the legislation governing the minimum technical and physical equipment of medical facilities and contact centres and for minimum staff security requirements for medical services (4).
Medical Emergency Services
(1) Medical emergency services must be provided at least within a time range of 3 hours continuously between
(a) 17: 00 and 23: 00 on a working day;
(b) 15: 00 and 20: 00 on Saturday, Sunday and working day.
(2) Medical emergency services must be provided at a pharmacy which complies with the requirements for minimum technical and physical equipment and personnel security laid down by the legislation governing the minimum technical and material equipment of medical devices and contact centres and the minimum staff security requirements for medical services (5).
Efficacy
This Decree shall take effect on 1 January 2026.
