DECLARATION
of 8 November 2012
amending Decree No 15 / 1995 Coll., on the authorisation of mining activities and activities carried out in a mining manner, as well as on the design of objects and equipment forming part of those activities, as amended by Decree No 298 / 2005 Coll.
The Czech Mining Authority provides pursuant to § 5 paragraph 2 of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, as amended by Act No. 206 / 2002 Coll.:
Decree No. 15 / 1995 Coll., on the authorisation of mining activities and activities carried out in a mining manner, as well as the design of objects and equipment which are part of those activities, as amended by Decree No. 298 / 2005 Coll., is amended as follows:
1. In Paragraph 1 (1), the words in brackets "racing, racing mine, racing quarry or designer 'are replaced by" racing, racing mine, racing quarry, mining designer or main mine meter'.
2. In Article 2 (1) (b), the word "residence 'is replaced by" residence or residence, if not residence in the Czech Republic'.
3. in Paragraph 2 (1) (c), the words "birth number 'are replaced by the words" date of birth';
4. in Article 2 (1) (e), including footnote 6:
"(e) the name, surname, place of permanent residence or residence, if any, if not permanent residence in the Czech Republic, and the date of birth of the racetrack or racetrack, or of the mining planner or main mining meter, including his certificate of competence for the performance of the activity (6).
6) Decree No. 298 / 2005 Coll., on requirements for professional qualifications and competence in mining or mining activities and amending certain legislation, as amended by Decree No. 240 / 2006 Coll. and Decree No. 378 / 2012 Coll. '
5. Paragraph 3 (1) reads as follows:
"(1) The authorisation shall specify:
(a) the trade name and, where appropriate, the name and surname;
(b) the registered office or, where applicable, the place of business or the place of permanent residence or, where applicable, the place of residence, unless it has permanent residence in the Czech Republic;
(c) identification number and date of birth, if any;
(d) the subject matter of the activity;
(e) the name, surname, place of permanent residence or residence, if any, if they do not have a permanent residence in the Czech Republic, and the date of birth of the factory mine or, where applicable, of the factory mine, of the quarry or of the mining designer or of the main mining meter, including his certificate of competence for the performance of the activity (6);
(f) the date of issue of the authorisation. ';
6. in Article 4 (1) (c):
"(c) the expiry of a certificate of competence for the performance of an activity or the termination of an employment relationship or any other similar ratio of a race mine, or of a racetrack, racing, mining designer or main mining meter, unless a legal or, where appropriate, natural person has concluded a new similar relationship with a competent person at the end of the relationship (6). The Circular Mining Office may authorise the pursuit of mining or mining activities, as well as the design of objects and equipment which are part of such activities, for a transitional period without such a responsible natural person, provided that this does not endanger the lives and health of people or significantly harm property. ';
Efficacy
This Decree shall take effect on 1 December 2012.
