DECLARATION
of 29 November 2011
amending Decree No 328 / 2004 Coll., on the registration and control of harmful organisms in plant products storage and the methods for detecting and regulating their occurrence in agricultural public storage and storage of the State Agricultural Intervention Fund
According to Article 88 (1) (a) and (b) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the Amendment of Certain Related Acts, as amended by Act No. 245 / 2011 Coll., (hereinafter referred to as "the Act '), the Ministry of Agriculture provides for the implementation of Sections 4 (1) (c) and 4 (2) of the Act:
Decree No 328 / 2004 Coll., on the registration and eradication of harmful organisms in plant storage and on the methods of detection and control of their occurrence in agricultural public storage and storage of the State Agricultural Intervention Fund, is amended as follows:
1. In the introductory sentence, "§ 88 (1) (a) 'is replaced by" § 88 (1) (a) and (b)' and "§ 4 (1) (d) 'is replaced by" § 4 (1) (c)'.
2. Article 3, including the title, reads:
Registration of the presence and registration of harmful organisms in plant products storage
[Paragraph 4 (1) (c) of the Law]
(1) The operator of the store of plant products shall keep records of the presence of harmful organisms in empty storage and in stored products in accordance with the model set out in Annex 1. The registration of the eradication of harmful organisms shall include the name of the plant protection product or biocidal product used, the duration of use and the application dose.
(2) The records referred to in paragraph 1 shall be kept by operators of plant products storage facilities for at least 3 years.
(3) The operators of plant products storage sites which do not operate primary production shall also make the records referred to in paragraph 1 available in accordance with the procedure laid down in point 7 of Part III of Annex I to Regulation (EC) No 852 / 2004 of the European Parliament and of the Council of 29 April 2004 on the hygiene of foodstuffs, as amended. "
Efficacy
This decree shall take effect on the day of its publication.
