DECLARATION

of 20 October 2000
amending Decree No. 161 / 2000 Coll., amending certain details of the service of members of the Police of the Czech Republic
The Ministry of Interior provides pursuant to § 13, § 16 paragraph 2, § 43 paragraph 2, § 66 paragraph 3 and § 121 of Act No. 186 / 1992 Coll., on the service relationship of members of the Police of the Czech Republic, as amended by Act No. 326 / 1993 Coll. and Act No. 40 / 1994 Coll.:
Decree No. 161 / 2000 Coll., adjusting certain details of the service of members of the Police of the Czech Republic, is amended as follows:
1. In Paragraph 2 (1), the second sentence is deleted.
2. In Article 2, the following shall be added at the end of the text of paragraph 3: "if, before being admitted, he has practised for a period equivalent to twice the period laid down in paragraph 2 (a) to (c) or one and a half times the period laid down in paragraph 2 (d) to (f)."
3. In Article 3, the following paragraph 3 is added:
"(3) For the purposes of appointing a candidate who has been in the service of a customs officer to the rank on acceptance of service, the following rank shall be considered as comparable:

| vrchní celní nadstrážmistr | - podpraporčík, |
| celní asistent | - praporčík, |
| celní kontrolor | - nadpraporčík, |
| vrchní celní kontrolor | - podporučík, |
| celní inspektor | - poručík, |
| vrchní celní inspektor | - nadporučík, |
| celní rada | - kapitán, |
| vrchní celní rada | - major, |
| ministerský státní rada | - podplukovník, |
| celní prezident | - plukovník.“. |

Functions in the selection procedure
(1) As a result of the selection procedure, the vacancies of official officials entitled to appoint police officers and the vacancies of their representatives shall be filled. Other management functions may also be filled under the selection procedure.
(2) The selection procedure cannot be declared for a vacant post at which, pursuant to § 17 (1) (a) and § 17 (1) (4) of the Act is to be transferred or under § 18 of the Act, a police officer who is still of the same or higher level.
(3) The provisions of paragraphs 1 and 2 shall not apply to the filling of duties in the Office for Foreign Relations and Information. ';
5. Article 14 shall be deleted;
6. In Article 24, the following paragraph 3 is added:
"(3) The duration of the service referred to in paragraph 1 (b) and (c) shall be deemed to be the duration of the service applicable to the entitlement to severance payments under Paragraph 39 (1). ';
7. in Paragraph 40 (3) (a), "sickness insurance" is replaced by "sickness care."
8. Paragraphs 52 and 53 are renumbered paragraphs 46 and 47.
This Decree shall take effect on the day of its publication, except for point 5, which shall take effect on 1 January 2001.
