on the granting of leave for certain workers in connection with their stay abroad
According to § 110 (2) of the Labour Code (full version No. 55 / 1975 Coll.), the Federal Ministry of Labour and Social Affairs provides in agreement with the central authorities involved and the Central Council of Trade Unions:
Members of the crew of Czechoslovak seagoing ships and workers working abroad may take home the annual recovery leave until the end of the next calendar year, provided that the organisation is unable, for urgent operational reasons, to determine their embarkation in such a way that the holiday ends no later than 30 April next year.
(1) Workers who enter or return from a place of work outside the territory of the Czechoslovak Socialist Republic and who change their employment in the context of this recruitment or return are entitled to the corresponding proportion of the leave in respect of the current and new organisation, even if they do not fulfil the conditions for entitlement to leave (Section 100 (1) of the Labour Code). This applies mutatis mutandis if the worker has been temporarily released for work for another domestic organisation in connection with secondment abroad; for the duration of such release, it shall provide it with a proportion of the holiday organisation for which it has been released.
(2) The initial or new organisation may grant the worker referred to in paragraph 1, on the basis of an agreement to pay for the compensation of wages between these organisations (Section 108 (4) of the Labour Code), a full national leave, even if the worker does not request it before departure.
The staff referred to in the previous provisions may be granted leave under the conditions laid down therein, due to them for the year 1975, if they have not exhausted it at the time of application of this decree.
This decree shall take effect on the day of its publication.
