Decret of the President of the Republic
of 31 July 1945
about the severe punishment of pillaging.
On the proposal of the Government and in agreement with the Slovak National Council, I establish:
§ 1.
Those who use extraordinary circumstances caused by war or post-war conditions for themselves or any other unauthorized person shall remove a foreign object of moveable value not minor, which is in buildings or rooms or on land abandoned or damaged by any acts of war, such as air or other bombing, commit pillaging and be punished for crime by a heavy prison of five to ten years. However, if the perpetrator has been armed or committed with several accomplices, or in circumstances of particular danger, or has misused the perpetrator's public office, he shall be punished by a heavy prison of 10 to 20 years or for life.
§ 2.
In the same way, he will be punished for hiding or on himself or any other unauthorized person transferring a thing that he knows has been obtained by pillaging.
§ 3.
Judging the crimes referred to in § § § § 1 and § 2 shall be the jurisdiction of the First Chamber. Paragraph 338 of the Code of Criminal Procedure of 23 May 1873, No 119 of the Act, may be used only in cases of exceptional consideration.
§ 4.
The crime referred to in Paragraph 1 is one of the crimes in which martial law may be declared particularly dangerous.
§ 5.
This decree shall apply to the territory of the whole State and shall take effect on the day of its publication; It shall be carried out by the Ministers for Justice, National Defence and Home Affairs.
