DECLARATION
of 4 December 2024
amending Decree No. 471 / 2001 Coll., on Technical Safety Surveillance of Water Parts, as amended
The Ministry of Agriculture provides pursuant to § 61 paragraphs 5, 9 and 16 and § 62 paragraph 2 of Act No. 254 / 2001 Coll., on Water and on the Amendment of Certain Laws (Water Act), as amended by Act No. 20 / 2004 Coll., Act No. 150 / 2010 Coll., Act No. 544 / 2020 Coll., Act No. 149 / 2023 Coll. and Act No. 182 / 2024 Coll.:
Decree No. 471 / 2001 Coll., on Technical Safety Supervision of Water Parts, as amended by Decree No. 255 / 2010 Coll. and Decree No. 86 / 2021 Coll., is amended as follows:
1. In Paragraph 1, at the end of point (e), the comma is replaced by "a '.
2. in Article 1, points (f) and (h) are deleted;
Point (g) shall be renumbered as point (f).
3. In Article 1 (f), "a 'is replaced by" a';
4. Paragraph 2 (d), including footnote 11, reads as follows:
"(d) the stage of preparation of the construction of the waterwork - the processing of documentation for the authorisation of the construction of the waterwork or of the documentation of the plan of common equipment11),
11) Act No. 139 / 2002 Coll., on land and land offices and amending Act No. 229 / 1991 Coll., on the treatment of property relations with land and other agricultural property, as amended, as amended. '
5. In Article 2 (h), the words "on water works' are replaced by the words" over water works'.
6. In Article 2, at the end of the text referred to in point (i), the words "or a water work subject to supervision under Article 61 (2) of the Water Act, if it existed before 1 April 1975 'shall be added.
7. In footnote 3, "11 'is replaced by" 10'.
8. Paragraph 4 (5) reads as follows:
"(5) The assessment for the classification of the water works into the category and the design of the conditions of supervision shall be carried out at the stage of preparation of the construction of the water works and shall include an assessment of the degree of safety of the water works during the floods and an assessment of the parameters of the safety and discharge facilities under the decree governing the requirements for construction and according to the Czech technical standard ČSN 75 29 35 Assessment of the safety of water works during the floods. '
footnotes 12 and 13 are deleted.
9. in Article 5 (1) (d), the word "designated" shall be inserted after the word "state."
10. in Article 5 (2), the word "document" shall be inserted after the word "processing."
11. in § 5 (2), § 12b (2), Annex 4 (3) (c) and Annex 5, in the explanatory note, the word "water law" is replaced by "construction."
12. in Article 5 (3), the word "designated" shall be inserted after the word "buildings."
13. in Article 6 (1), the words "at the stage of the documentation for construction permits" shall be replaced by the words "at the stage of the preparation of the construction of the water works or at the stage of the preparation of the documentation for the permit."
14. in Article 6 (2) (a), the word "designated" shall be inserted after the word "existence."
15. in Article 6 (2) (b), the word "construction" is replaced by the words "for the permit of construction, documentation of the joint facilities plan."
16. in Article 7 (2) (a), the words "under Article 62 (5) (a) of the Water Act" shall be deleted;
17. in Article 7 (2) (e), the word 'which' shall 'shall be replaced by' which 'and the word' shall 'shall be deleted;
18. in Paragraph 7 (2) (l), the words "emergency situations" are replaced by the words "declared emergency situations."
19. in Article 8 (3), the word "designated" shall be inserted after the word "around."
20. In Paragraph 10 (1), the word "designated 'shall be inserted after the word" construction'.
21. Article 12a shall be deleted, including the title.
22. in Article 12b (3) and (4) and Annex 5 in the table, the word "Water law" is replaced by the word "Construction."
23. in Annex No 2 (j), the word "Device 10" is replaced by the words "Equipment according to Czech Technical Standard ČSN 75 29 35 Assessment of the safety of water works in floods."
footnote 10 is deleted.
24. Footnote 8 reads:
"8) For example, ČSN 75 2310 Sprayed dams, ČSN 75 2410 Small water tanks, ČSN EN 1993-1-1 (731401) Eurocode 3: Design of steel structures."
25. in Annex 3 (1) (a), the words "water works" shall be deleted after the words "buildings."
26. In Annex 3, point 4 (c), the words "all observed phenomena and facts in relation to limit values' are replaced by the words" the safety of the designated water work with regard to all observed phenomena and facts and their relationship with limit values'.
27. in Annex 3, point 5 (e), the words "all phenomena and facts observed" shall be replaced by the words "the safety of the designated water works with regard to all phenomena and facts observed and their relationship with the limit values."
28. In Annex 3, point 5 (g), the words "and related legislation12), 13) 'are replaced by the words", decrees governing construction requirements and according to the requirements of Czech technical standard ČSN 75 29 35 Assessment of the safety of water works in floods'.
29. In Annex 4, point 3, the words "the administration and service of the work 'are replaced by the words" the owner, the administration and service of the designated water work'.
30. In Annex 4, point 3, the word "owner 'shall be inserted at the beginning of point (a).
31. In Annex 4, point 9, the word "water-based 'is replaced by" building-based'.
32. In the title of Annex 5, the words "above the designated water part 'are added.
Efficacy
This Decree shall take effect on 1 January 2025.
