DECLARATION
of 30 October 2003
determining the undertakings in which, during a transitional period, derogations from the animal health requirements for their operation are allowed
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., ("the Act ') for the implementation of Section 77 (3) of the Act:
This decree provides in accordance with the law of the European Community1)
(a) undertakings which, for a transitional period, are allowed to apply to their operation animal health requirements derogating from the animal health requirements laid down in Decree No. 200 / 2003 Coll., on animal health requirements for egg products, Decree No. 201 / 2003 Coll., on animal health requirements for fresh poultrymeat, rabbit meat, farmed game meat and wild game meat, Decree No. 202 / 2003 Coll., on animal health requirements for fresh meat, minced meat, meat preparations and meat products, as amended by Decree No. 375 / 2003 Coll., and Decree No. 203 / 2003 Coll., on veterinary requirements for milk and milk products (hereinafter referred to as "veterinary legislation"),
(b) divergent animal health requirements;
(c) the duration of the transitional period.
(1) For the purposes of this decree, an undertaking, plant or other establishment for which a single veterinary approval number has been assigned on the basis of its approval and registration (2) shall be considered.
(2) The list of undertakings in which derogations from animal health requirements are allowed for the transitional period is set out in the Annex (hereinafter referred to as "undertakings with a transitional period").
For the purposes of this decree, the derogation from the animal health requirements for the operation of holdings with a transitional period shall mean the non-application of the individual provisions of the veterinary legislation laid down in the Annex to those undertakings.
The different animal health requirements for the operation of individual undertakings with a transitional period are allowed to apply only for a transitional period which runs from the date of entry into force of this Decree until the last date specified for that undertaking in the Annex, unless the undertaking has previously brought its operations into compliance with the animal health requirements laid down in veterinary legislation.
(1) In addition to the information provided for in specific legislation3), raw materials and food of animal origin originating from holdings with a fixed transitional period must be labelled on the packaging intended for consumers and on the outer packaging
(a) "intended for sale only in the Czech Republic,"

(2) The accompanying commercial documents which must be accompanied by raw materials and food of animal origin coming from undertakings established for a transitional period shall be the subject of paragraph 1 mutatis mutandis.
(1) Raw materials and food of animal origin originating in undertakings with a fixed transitional period may only be put into circulation in the Czech Republic or used for further processing in other undertakings with a fixed transitional period.
(2) Where an operator of an undertaking which is not an undertaking with a transitional period buys or processes raw materials and food of animal origin originating from an undertaking with a transitional period, the provisions of Sections 5 and 6 (1) shall apply mutatis mutandis to it.
Efficiency and validity
(1) This Decree takes effect on 1 January 2004.
(2) This Decree expires on 31 December 2006.
