DECLARATION
of 25 November 2013
on the storage and use of fertilisers
The Ministry of Agriculture provides pursuant to Sections 8 (5) and 9 (9) of Act No. 156 / 1998 Coll., on fertilisers, soil improvers, aids and substrates, and on agrochemical testing of agricultural soils (Fertilisers Act), as amended by Act No. 308 / 2000 Coll., Act No. 147 / 2002 Coll., Act No. 317 / 2004 Coll., Act No. 444 / 2005 Coll., Act No. 553 / 2005 Coll., Act No. 9 / 2009 Coll., Act No. 490 / 2009 Coll., Act No. 227 / 2009 Coll.
Subject matter
This decree implements the relevant European UnionRegulation (1) and regulates the
(a) storage of fertilisers, soil improvers, plant biostimulants and substrates and storage capacity;
(b) the use of fertilisers, soil improvers, plant biostimulants and substrates on agricultural land and forest land;
(c) keeping records of the use of fertilisers, soil aids, plant biostimulants, substrates and treated sludge;
(d) reports on the use of treated sludge and reports on the aerial application of fertilisers, soil improvers, plant biostimulants and substrates;
(e) keeping records of the yield of the main and by-product harvested, data on the average collection of nutrients in the products harvested and the manner and form of electronic transmission of the register; and
(f) the operation of the feeding site.
Storage of solid mineral fertilisers
(1) Solid mineral fertilisers are stored in storage as bulk or packaged.
(2) Unloaded mineral fertilisers are stored
(a) in heaps designated as fertilisers up to a maximum of 6 m, at least 1 m apart,
(b) in divisions marked with the name of the fertiliser, where heaps may reach the upper edge of the bulkhead at the most; or
(c) in containers.
(3) Packed mineral fertilisers are only stored in packaging for this purpose. Up to 50 kg shall be stored in bags placed on each other up to a maximum of 1,5 m. Pallets may be stored in a maximum of 2 layers when storing fertiliser bags on pallets. Fertilisers above 50 kg shall be stored individually or in a maximum of 2 layers, unless otherwise indicated by the manufacturer.
(4) For a maximum of 1 month, packaged solid mineral fertilisers may also be stored on loose reinforced areas, placed on pallets and protected against weather effects.
(5) For a maximum of 24 months, calcium fertilizer may be stored on agricultural land.
(6) Fertilisers based on ground limestone delivered with a moisture content of 2 to 10% may be stored on agricultural land for a maximum of 2 months.
Storage of single-component ammonium nitrate fertilisers
(1) For the purposes of this Decree, single-component ammonium nitrate fertilisers are fertilisers with a total nitrogen content of both forms, both nitrate and ammonium, exceeding 28%.
(2) Fertilisers referred to in paragraph 1 may only be stored:
(a) in warehouses, separately and protected from any innards of organic substances, in particular sawdust, straw, wood, oil or alkaline substances, in particular lime and cement,
(b) packed and up to a maximum of 25 tonnes in one stock;
(c) so as to be protected against direct sunlight,
(d) at least 1 m from the wall and ceiling of the warehouse and at least 0,5 m from the heat and light source; and
(e) provided that the manure and packaging residues are immediately removed outside the storage area in the warehouse.
Storage of liquid mineral fertilisers
(1) Liquid mineral fertilisers are stored in tanks built and marked for that purpose by the name of the stored fertiliser, located in detention tanks with a volume greater than that of the largest tank in the bath placed.
(2) Suspension mineral fertilisers are stored in tanks equipped with an effective mixing device.
(3) Packed liquid mineral fertilisers are stored in storage.
(4) For a maximum of 1 month, packaged liquid mineral fertilisers may also be stored on loose solidified areas, while protecting against weather effects and the maximum volume of one pack being 1000 litres.
Storage of organic and organo-mineral fertilisers and technological waters
(1) Liquid organic and organo-mineral fertilisers and technological waters are stored in impermeable aerial or partially recessed tanks or in ground sinks. In the operation of sinks and tanks, the inflow of surface or precipitation water into the pit or tank shall be avoided unless otherwise specified in the approval decision or approval. The wells and tanks shall correspond to at least four months of expected production of digestor or digestor fugate. In the case of biogas station plants newly put into service and their designed capacity are among the stationary sources under the Air Protection Act, low-emission systems must be used in storage.
(2) Freely loaded organic and organo-mineral fertilisers shall be stored in buildings secured in the same way as those for the storage of solid manure excluding the inflow of surface or precipitated water which include a liquid pool, or as referred to in Section 2 (2) in warehouses.
(3) Packed solid organic and organo-mineral fertilisers are stored in storage in the manner referred to in Section 2 (3).
(4) For a maximum of 1 month, packaged solid or liquid organic and organo-mineral fertilisers may be stored on free reinforced surfaces, placed on pallets and protected from weather effects.
(5) The solid organic fertiliser compost is stored outside agricultural land only in places suitable for its storage approved in the emergency plan under the Water Act. The storage facility shall be secured against leakage of liquid substances.
Storage of manure
(1) Solid manure shall be stored in solid manure storage structures excluding the inflow of surface or precipitation water. In the case of livestock farms newly put into service and their planned capacity are among the stationary sources under the Air Protection Act, low-emission systems must be used in storage. These structures shall include a liquid storage tank. The storage capacity for solid manure corresponds to their actual production in 6 months. This does not apply when solid manure is stored on agricultural land before they are used. On agricultural land, solid manure may be stored only in places suitable for their storage, on the basis of information obtained from land use records based on user relations under the Agricultural Act (6), provided that the user of the defective substances is included and loaded at any time with a total of at least 2 tonnes of solid manure. If the user of the defective substances is not included in the land use register according to the user relations conducted under the Agriculture Act, solid manure may be stored on agricultural land only in places suitable for their storage under the Government's Regulation on the establishment of vulnerable areas and action programme7).
(2) Liquid manure shall be stored in impermeable tanks, sinks or stables. The vessels and tanks and, where appropriate, the stables' sub-areas correspond to a capacity of at least four months of expected manure production or its liquid share and at least three months of expected manure and manure production, depending on the climate and weather conditions of the region. In the operation of sinks and tanks, the inflow of surface or precipitation water into the pit or tank shall be avoided unless otherwise specified in the approval decision or approval. In the case of livestock farms newly put into service and their planned capacity are among the stationary sources under the Air Protection Act, low-emission systems must be used in storage.
(3) Where data on manure production is not available, obtained in a demonstrable way, in particular by weighing, measuring volume, calculating manure production by species and category of animals, their weight, performance or feeding method, taking into account the consumption of litter and, where appropriate, the production of technological waters, the average livestock production values referred to in Annex 1 to this Regulation, Table A, and the required storage capacity shall be determined in accordance with Annex 1 to this Regulation, Table B. If the weight of animals determined by weighing is not available, the data referred to in Annex 1 to this Decree, Table C, shall be used for conversion into livestock units. In the case of grazing or residence of livestock on agricultural land, the need for storage capacity is reduced proportionately.
(4) The storage capacity for manure as set out in paragraphs 1 to 3 may be reduced in the case of the tamper-proof putting into circulation of manure, their use for the production of organic fertilisers or for the production of biogas, or their disposal as waste, in proportion to that quantity, on the basis of a processed timetable. However, even after this reduction, storage capacity may not be less than necessary to store the two-month total manure production.
(5) Feedingstuffs may be operated if:
(a) not less than 50 m from the body of surface water or on agricultural parcels with a inclination of more than 5 degrees at least 100 m from the body of surface water; and
(b) at least once a year during the period 1 February to 30 April, the removal of feces, litter and feed residues shall be carried out.
Use of fertilisers, soil aids, plant biostimulants and substrates
(1) Fertilizers, excipients and substrates are used in accordance with the data given in their labelling and must not be directly penetrated into surface water or on adjacent land when used.
(2) Differentiated fertilisation on the basis of data on the properties of the soil or the state of the crop fulfils the conditions for uniform coverage of the land under Section 9 (2) (a) of the Fertiliser Act. The condition of equal coverage of land is also met in the case of fertilisation under the Government Regulation on the establishment of vulnerable areas and action programme3) or under the Government Regulation on the determination of the consequences of a breach of conditions4).
(3) Liquid manure, liquid organic fertilisers or technological water shall be introduced into the soil no later than 24 hours after application to the surface of the arable land, in the case of fertilisers originating from installations under the Integrated Prevention Act no later than 12 hours. Soil treatment shall not be required after line application to the crops by hose applicators and application to grass, clover and clover crops during a period of at least 1 month prior to harvest. After applying solid manure or solid organic fertilisers to the surface of arable land, fertilisers shall be introduced into the soil within 24 hours at the latest; This does not apply to by-products or by-products resulting from the cultivation of cultural plants.
(4) Urea as fertiliser may only be used if the urease inhibitor is added to it in the manner and at the dose indicated on the label. This does not apply if it is immediately fixed into the soil or administered in a solution.
(5) In order to determine the need for fertilisation,
(a) the nutrient needs of the crop for the anticipated yield and quality of production, according to the values obtained from the analysis of the particular crops produced in the past or the data on the nutrient collection of the crops listed in Annex 6 to this Regulation;
(b) the quantity of available nutrients in the soil and the habitat conditions (in particular climate, soil type and type);
(c) the soil reaction (pH), the ratio of the important cation (calcium, magnesium and potassium) and the amount of soil organic matter (humus); and
(d) production conditions affecting nutrient availability (precrop, soil processing, irrigation).
(6) Data on the amount of nutrients in the soil are provided by agri-chemical testing of agricultural soils under Section 10 of the Fertilisers Act. The chemical analysis is determined by soil reaction (pH), carbonate content, liming need, available nutrient content (phosphorus, potassium, magnesium, calcium) and cation exchange capacity of soil.
(7) The maximum application dose of ash from separate biomass combustion is 2 tonnes of dry matter per ha in 3 years. In the same year, the use of ash from the separate combustion of biomass with the use of treated sludge or sediments must not coincide.
(8) The maximum application dose of organic and manure with dry matter above 13% is 20 tonnes of dry matter per ha over 3 years. The maximum application dose of organic and manure with a dry matter content not exceeding 13% shall be 10 tonnes dry matter per ha over 3 years; This shall not apply to livestock manure from bovine animals and organic fertilisers produced only from by-products or by-products resulting from the cultivation of cultural plants or from manure from bovine animals where the maximum application dose is 15 tonnes of dry matter per ha over a period of 3 years.
(9) Manure and organic fertilisers delivered in bulk must not be used
(a) arable land used to grow field vegetables and fruit from sowing or planting to harvesting, with the exception of straw mulch crops; and
(b) in fruitful fruit plantings and on soil blocks with a type of agricultural vineyard culture one month before the harvest begins.
(10) For the use of technological waters, the provisions of paragraph 9 (a) shall apply mutatis mutandis.
Fertilisation of forest land
Fertilisers are used according to:
(a) evaluation of the results of chemical analyses of soil and crops;
(b) external signs of nutrition, growth and development and their general condition;
(c) the terms and conditions; and
(d) the results of previous fertiliser use in crops.
Record keeping of fertiliser, soil aid, plant biostimulants, substrates and treated sludge
(1) The information set out in Annex 2 to this Order shall be recorded in the register. Agricultural entrepreneurs who are required to keep records pursuant to Sections 9 (7) and 9 (8) of the Act on fertilisers in electronic form shall transmit it to the Institute electronically by means of an automated data output via an electronic application accessible on the Ministry's website. The Ministry shall establish access to this application to the agricultural entrepreneur upon request. Transmission of data through this electronic application does not require signature. The detailed requirements for the method and form of electronic transmission of the register are set out in Annex 7 to this Decree.
(2) For the determination of nutrient intake, the values obtained by own analysis not more than 1 year old shall be used, the data from the fertiliser designation and, where applicable, the data set out in Annex 3 to this Decree, Table A. The procedures laid down in the Decree on collection and chemical analysis of fertiliser samples (5) shall be used for the own sampling and analysis of fertiliser samples. Where they are used for fertilisation by secondary or main products resulting from the cultivation of cultural plants, i.e. harvested plant residues, in particular straw, grass, grass, grass, they shall be recorded in the register without indicating the amount of matter and nutrients. Where soil improvers, plant biostimulants or substrates are used on agricultural land, they shall be recorded without indication of the amount of nutrients.
(3) For the recording of nutrient supply of feces and urinals of farmed animals during grazing or on agricultural land, the data on faeces and urine production and data on nutrient supply set out in Annex 3 to this Decree, Table B, shall be used.
(4) In the case of the leaving of feces and urinals of livestock on agricultural land, the type of manure shall bear the indication "pasture 'or" stay' identifying the species or category of animals. If the weight of animals determined by weighing is not available, the data referred to in Annex 1 to this Decree, Table C, shall be used for conversion into livestock units.
Method of reporting air application of liquid fertilisers, soil aids, plant biostimulants and substrates
The model form for reporting the air application of liquid fertilisers, soil improvers, plant biostimulants and substrates is set out in Annex 4 to this Decree.
Method of reporting the use of treated sludge
The model for the report on the use of treated sludge is set out in Annex 5 to this Decree.
Repeal
The following shall be deleted:
1. Decree of the Ministry of Agriculture No. 274 / 1998 Coll., on the storage and use of fertilisers.
2. Decree No. 476 / 2000 Coll., amending Decree No. 274 / 1998 of the Ministry of Agriculture Coll., on the storage and use of fertilisers.
3. Decree No. 473 / 2002 Coll., amending Decree No. 274 / 1998 Coll., on the storage and use of fertilisers, as amended by Decree No. 476 / 2000 Coll.
4. Decree No. 399 / 2004 Coll., amending Decree No. 274 / 1998 of the Ministry of Agriculture Coll., on the storage and use of fertilisers, as amended.

Efficacy
This Decree shall take effect on 1 January 2014.

1) Technological water resulting from the milking process, feeding of animals and cleaning of stables.
(2) For different dry matter content, manure production shall be proportionally recalculated.
3) Technological water from milking, dairy and adjacent areas (annual production 4,2 - 5,6 t / DJ, i.e. 15 - 20 litres per cow per day) may be stored separately. Technological water generated by cleaning stables and feeding animals (annual production 0 - 1,4 t / DJ, i.e. 0 - 5 litres per cow and day) are stored together with slurry.
(4) For different litter consumption, manure production is proportionally converted (1 kg of litter per DJ per day = 0,3 t of manure per DJ per year).
5) Technological waters containing 1% dry matter and 0,9 kg nitrogen per tonne (N / t).
6) The urine is formed by free urine, which does not sink into the litter and technological water.
7) The above values shall also be used for sows after launch.

(1) Where data are available on the weight of animals determined by weighing, these values shall be used for conversion into livestock units to calculate manure production.
2) The conversion coefficient to livestock units includes lambs and kids. For the purpose of calculating manure production, the coefficient shall be adjusted proportionately for the average weight of adult ovine and caprine animals other than those indicated.
(3) For ponies and other small breeds of horses, the conversion factor to livestock units at half value shall be applied for the purpose of calculating manure production.

Compulsory information:
(a) identification of the farm operator
1. the name and, where applicable, the name, surname and, where applicable, the addendum distinguishing the person of the agricultural operator or the type of business, the date of birth, the identification number of the person, if any, and the address of the place of business, if any, if any, of the natural person; and
2. name or business name, identity number and address of the registered office, if any,
(b) identification of the owner of the forest parcel;
(c) identification details of the natural or legal person engaged in forest production;
(d) the number of the cadastral territory (1) in the case where the parts of the soil blocks are kept in the land use register according to user relations under the Agriculture Act;
(e) land number1), forest land (for forest land, the separation, crop, grassland),
(f) area of land, forest land (in the case of forest land shall be indicated by separation, vegetation, grassland) in ha,
(g) crop name (2), species,
(h) the date of sowing or planting (3);

(s) the total dose of fertiliser or treated sludge (t, kg, l), in the case of treated sludge, expressed as 100% dry matter,
(t) the average dose of fertiliser or treated sludge (t / ha, kg / ha or l / ha), in the case of treated sludge expressed as 100% dry matter, in the case of grazing or housing animals on agricultural land, the number of DJ / ha5);
(u) the average nutrient intake in the fertiliser or treated sludge in kg / ha - N, P2O5, K2O, MgO, CaO, S;
(v) the name of the soil improvers, plant biostimulants, substrates, micro nutrient fertilisers used; and
(w) the average dose of soil aid, plant biostimulants, substrates and micro-nutrient fertilisers used (t / ha, kg / ha or l / ha).
Explanatory notes:
1) If an agricultural entrepreneur is included in the Land Register under Act No. 252 / 1997 Coll., on Agriculture, as amended, he shall enter the number of the map square in the cadastral territory section and the abbreviated code of the soil block part in the Land Register.
2) For permanent grassland only the agricultural crop culture shall be indicated.
3) In the case of cultivation of more than one crop on the same area within the growing (marketing) year, data shall also be kept on the date of sowing and the date of harvest or processing.
(4) In the case of livestock grazing, the data referred to in (q), (s), (u) to (w) shall not be provided.
5) The cattle unit (DJ) corresponds to 500 kg live weight of livestock.

Explanatory notes:
1) The supply of nutrients in manure is given for the period of application, i.e. after deduction of losses of nutrients in stables and in manure storage. For different dry matter content for liquid manure, the nutrient content shall be proportionally recalculated. Where an analysis of the nutrient content is available, the values of that analysis shall apply.
(2) In the joint storage and subsequent use of a mixture of different types of manure and organic fertilisers, the weighted average shall be used for the calculation of the nutrient supply according to the quantitative representation of the different species in the mixture. When representing one type of fertiliser above 80%, the value for this predominant type of fertiliser may be used.
