GOVERNMENT REGULATION
of 30 November 2011
on the adjustment of compensation for loss of service income after the cessation of incapacity for service resulting from an accident or occupational disease and the adjustment of the cost of maintenance of survivors
The Government orders the implementation of Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, as amended by Act No. 186 / 2004 Coll., Act No. 436 / 2004 Coll., Act No. 586 / 2004 Coll., Act No. 626 / 2004 Coll., Act No. 169 / 2005 Coll., Act No. 253 / 2005 Coll., Act No. 413 / 2005 Coll., Act No. 530 / 2005 Coll., Act No. 189 / 2006 Coll., Act No. 531 / 2006 Coll., Act No. 261 / 2007 Coll., Act No. 305 / 2008 Coll., Act No. 306 / 2008 Coll., Act No. 326 / 2009 Coll.:
The compensation for loss of service income after the cessation of incapacity for service resulting from an accident or occupational disease (hereinafter referred to as "compensation for loss of service income ') and the reimbursement of the maintenance costs of survivors belonging to members or survivors under Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps, as amended, or under previous legislation1), shall be adjusted by increasing by 1,6% the average service income applicable to the calculation of compensation for loss of service income and to the reimbursement of maintenance costs of survivors, possibly increased by the former legislation2).
If there is a claim for compensation for loss of service income and for the reimbursement of maintenance costs of survivors after 31 December 2011, the average service income applicable to the calculation of compensation under Paragraph 1 shall not be increased.
The provisions of Paragraph 1 shall apply from 1 January 2012 and shall be implemented without the application of a member or survivors and, at the request of a member, shall be made in the event that the compensation for loss of service income was not due to an increase in the invalidity pension under social security legislation or pension insurance legislation.
Efficacy
This Regulation shall enter into force on the day of its publication.
