GOVERNMENT REGULATION
of 27 September 2000
on the rules on the selection procedure for the post of head of the district office
The Government orders pursuant to § 41 (1) of Act No. 147 / 2000 Coll., on District Offices:
(1) The selection procedure for the post of Head of the District Office (hereinafter referred to as the "selection procedure") is opened on the date specified in the notice of the Minister of the Interior on the invitation to tender (hereinafter referred to as the "notice"). no later than that date, the district office in which the priority function is to be filled shall post a notice on its official record. The notice shall also be published by the Ministry of the Interior (hereinafter referred to as "the Ministry ') in the weekly newspaper" Public administration', no later than the opening of the selection procedure.
(2) The notification shall include in particular:
(a) the name of the district office in which the priority function is to be filled;
(b) requirements for the performance of the post of Head of the District Office as laid down by specific legislation, 1)
(c) the date of the opening of the selection procedure;
(d) the deadline for the submission of an application for competition (hereinafter referred to as the application), which may not be less than 3 weeks from the date of the opening of the competition;
(e) the particulars of the application (§ 2),
(f) the address to which the application is sent.
(3) The selection procedure shall be completed no later than 5 months after the date of its initiation.
(1) The application for a candidate's post as a priority of the District Office (hereinafter referred to as the "applicant") contains the name of the District Office in which the post of priority is to be filled, the date and signature of the applicant by hand.
(2) The following documents are attached to the application:
(a) a completed personal questionnaire, a model of which is set out in the Annex to this Regulation;
(b) a CV setting out data on existing employment, possible practice in public administration and local authorities, experience in the management of employees and family relationships;
(c) certified evidence of the highest education achieved;
(d) certified proof of citizenship;
(e) an extract from the register of offences 2) not earlier than 3 months;
(f) a certificate issued under special legislation3) fulfilling the conditions of contact with classified information for the "Confidential" level or a copy of the request for such a certificate;
(g) a certificate issued under special legislation4) on the facts relevant to the appointment or a copy of the application for such a certificate;
(h) an affidavit pursuant to special legislation5) on the facts relevant to the appointment of office in the administration;
(i) a statement of the facts relevant to the appointment of the head of the district office in accordance with the special legislation, 6)
(j) a declaration that the tenderer has properly fulfilled his financial obligations.
(3) The documents referred to in points (f) and (g) of paragraph 2, for which the tenderer has provided evidence of a copy of the application, shall be sent by the tenderer to the address indicated in the notice (Article 11 (2) (f)) immediately upon receipt, unless the tender has already been withdrawn or the tender has been terminated.
(1) The selection procedure is carried out by the Ministry and the selection committee (hereinafter referred to as "the Commission"). The Commission shall have at least 7 members. The Chairman of the Commission, the Vice-President of the Commission, the Secretary of the Commission and other members of the Commission shall be appointed and removed by the Minister for the Interior.
(2) The proceedings of the Commission shall be convened, managed and the acts of the Secretary of the Commission shall be approved in advance by the President of the Commission; in his absence, the Vice-President of the Commission shall do so.
(3) The hearing of the committee is private. The Commission shall be able to act if an absolute majority of all its members are present and the decision shall be taken by an absolute majority of the members present.
(1) A candidate who has not submitted the required documents with the application shall be invited in writing by the Secretary of the Commission to submit the missing documents within a specified time limit which may not be less than 15 days. At the same time, the tenderers will point out that if they do not submit the missing documents within the prescribed time limit, they will be excluded from the selection procedure. A candidate who has not remedied the deficiencies of the application within the time limit set out in the invitation shall be removed from the selection procedure by the Secretary of the Commission and informed thereof without delay, stating the reasons therefor, and at the same time returning the documents submitted to him.
(2) A candidate who, according to the documents submitted, does not meet the requirements for the performance of the post of Head of the District Office laid down by specific legislation, 1) shall be removed from the selection procedure by the Secretary of the Commission, shall immediately inform him of the reasons and return all documents submitted to him.
(1) A candidate who has not been excluded from the selection procedure provided for in Section 4 shall be invited by the Secretary of the Commission to a targeted psychological examination, in which the candidate shall fill out questionnaires and draw up tests to assess the candidate's intellect, its resistance to psychological stress, the candidate's orientation in human relations and his organisational capacity. Psychological examination by the Ministry. The validity of a psychological examination is 1 year.
(2) Candidates who have not had a psychological examination will be excluded from the selection procedure by the Secretary of the Commission. The discharge shall be notified to the tenderer in writing by the Secretary of the Commission, stating the reasons and returning the documents submitted to him.
(3) Candidates who have had a psychological examination will be invited to an oral interview by the Commission Secretary.
(4) A candidate who has not participated in the oral interview will be notified by the Secretary of the Commission that he is excluded from the selection procedure for this reason and will return the documents submitted to him.
(5) The evaluation of the oral interview with the candidate shall be carried out by the Commission; on the basis of it, on the basis of the results of the psychological examination and taking into account the data contained in all documents submitted, the Commission shall determine the ranking of the tenderers.
(1) The Secretary of the Commission shall draw up a record of the conduct of the selection procedure. In order to verify and sign the part of the minutes containing the information referred to in Article 5 (5), the commission shall elect two members. The minutes shall be signed by the President of the Commission and the Secretary of the Commission. The minutes shall contain:
(a) a list of the members of the Commission, indicating their duties;
(b) a list of all applicants applied for and their birth numbers,
(c) the list of candidates rejected pursuant to Article 4 (1) for deficiencies in the application;
(d) the list of candidates excluded under Paragraph 4 (2) for non-compliance with the requirements for the performance of the post of Head of the District Office laid down by specific legislation, 1)
(e) the list of candidates excluded under Article 5 (2) for non-participation in a psychological examination;
(f) the list of candidates eliminated pursuant to Article 5 (4) for non-participation in the oral interview;
(g) a list of tenderers who have not submitted documents, issued at the request of the tenderer referred to in Article 2 (2) (f) and (g);
(h) the ranking of tenderers determined in accordance with Article 5 (5).
(2) The minutes of the selection procedure with the documents on which the members of the commission were based shall be forwarded by the chairman of the commission to the Minister of the Interior within 5 days of the end of the selection procedure.
(3) The Secretary of the Commission will notify the tenderers who have not been excluded from the selection procedure within 5 days of the end of the selection procedure.
(1) If an urgent need for emergency situations is required (7) or for the proper cessation of the activities of the district offices, the post of head of the district office may be filled by a short selection procedure. This shall be indicated in the notification. In this case, the notice shall not be published in the "Public administration" weekly.
(2) The deadline for submitting an application for a short tender is 5 days from the date of the opening of the short tender. The applicant may remove the deficiencies of the application at any time before the opening of the oral interview, which may not take place more than 15 days after the date of notification, at the request of the Secretary of the Commission.
(3) A short selection procedure shall not carry out a psychological examination.
(4) The reduced tendering procedure shall be concluded no later than 30 days after the date of its opening.
(5) The provisions of this Regulation shall apply to the abbreviated selection procedure, save as otherwise provided in paragraphs 1 to 4.
After the appointment of the Head of the District Office by the Government, the Ministry shall inform the other candidates who have not been excluded from the selection procedure of the name of the candidate who has been appointed by the Government to the post of Head of the District Office and, at the same time, return to them the documents submitted by them within 5 days of the date of the Government's decision to appoint the Head of the District Office.
The costs incurred by participating in the selection procedure shall be borne by the tenderer.
Selection procedures initiated before the date of entry into force of this Regulation shall be completed in accordance with existing legislation.
This Regulation shall enter into force on the day of the elections to regional councils in 2000.
