laying down requirements for drinking water and the scope and frequency of its control
For the implementation of Sections 3 (1), 3 (4) and (5) and 4 (1) and (2) of the Act No. 258 / 2000 Coll., on the Protection of Public Health and on the amendment of certain related laws (hereinafter referred to as "the Act ') and under Sections 19 (a), (b) and (f) of the Act No. 110 / 1997 Coll., on food and tobacco products and on the amendment and addition of certain related laws, as amended by Act No. 306 / 2000 Coll.:
Scope
(1) This decree sets out the hygiene requirements for drinking water, including bottled drinking water, the extent and frequency of checking compliance with the health limits of microbiological, biological, physical and chemical indicators of drinking water.
(2) The Decree does not apply to natural mineral waters, packaged table waters and packed infant waters.
For the purposes of this decree:
(a) by public supply of drinking water, the supply of drinking water from the public water pipeline, the purchase of a public well designated as a source of drinking water or the supply of a private well used by the public or for business activities requiring the use of drinking water. Public supply of drinking water shall also be considered to be the provision of replacement drinking water,
(b) by individual supply of drinking water to the supply of drinking water from one source (e.g. from a well) with a daily production of less than 10 m3 of water or a supply of up to 50 persons, provided that the water is not used to operate under (a);
(c) a limit value for the limit value of the drinking water quality indicator, the excess of which loses drinking water of satisfactory quality in the indicator whose value has been exceeded; the indicator has an indicator function and appropriate measures must be taken when it is exceeded;
(d) the maximum limit value of the limit value of the water quality indicator with a threshold effect, the excess of which excludes the use of water as drinking water;
(e) the limit value of the reference risk, the limit value of the drinking water quality indicator with no threshold effect, usually late toxic effects (carcinogen, mutagen); exceeding the reference risk limit excludes the use of water as drinking,
(f) the recommended value is the value of the drinking water quality indicator which means achieving the optimum concentration of the substance or component in terms of the biological value of the drinking water;
(g) by the home distribution system of pipelines, fittings and equipment installed between taps from which water is collected for human consumption and the distribution network, but only if they do not fall within the scope of the water supplier's public supply with drinking water;
(h) audit monitoring of drinking water1) independent monitoring of drinking water quality, necessary to determine whether all indicator values are respected.
Indicators and sanitary limits of drinking water
Annex No 1 shall be established or indicated:
(a) microbiological, biological, physical and chemical indicators of drinking water and their hygiene limits;
(b) fecal pollution indicators or other indicators indirectly demonstrating the microbiological safety of drinking water;
(c) the values of the relevant quality and health indicators showing the toxicological safety and acceptability of sensory-impaired properties of drinking water by comparison with their limit values;
(d) the other conditions for determining whether the results of the individual analysis can be considered as meeting the conditions and requirements of this Decree and whether the method used is appropriate to establish the values of the relevant drinking water quality indicator.
Drinking water control
(1) The minimum annual frequency of control sampling and analysis of samples of drinking water of public supply is set out in Annex 2.
(2) The minimum level of control analyses of samples of drinking water of public supply is set out in Annex 3.
(3) Samples of drinking water for inspection shall be taken to be representative of the quality of drinking water consumed throughout the year.
The drinking water indicators set out in Annex No 1 shall be determined in accordance with the procedure corresponding to the methods contained in the relevant technical standards, the application of which shall be considered to show that the result is in terms of catch, accuracy and accuracy. When using a non-standard method, it shall be demonstrated that the results obtained by such a method are equally reliable and meet the other conditions set out in Annex 1. Only the methods set out in this Annex may be used to check the values of the indicators set out in Annex 4.
(1) The values of drinking water indicators [§ 2 (c) to (e)] must be complied with when checking
(a) drinking water supplied from the distribution network at the point within the building, establishment or establishment where drinking water flows from taps intended for human consumption;
(b) drinking water supplied from well or artificially installed tanks at the point of discharge from the well or tank;
(c) drinking water put into packaging or containers intended for replacement or for sale to the consumer at the place where the water is loaded into packaging or containers;
(d) drinking water used for the production of foodstuffs at the place where drinking water is used for that purpose.
(2) The potable water indicators shall be considered to be fulfilled in accordance with paragraph 1 (a) if it can be demonstrated that the non-compliance with the values of the indicators set out in Annex 1 is due to the home distribution system or its maintenance. This is not the case if the establishments or businesses supplying drinking water to the public (such as schools, hospitals, food establishments, catering establishments) are concerned.
The results of the checks on drinking water shall be recorded in protocols where data on the place, date and hour of sampling, water sources, the name and surname of the person who took the samples under the authority of the operator, the date of analysis, the method used to the extent provided for in Section 5, the method of handling the sample and the result of the analysis.
(1) If the result of determining the values of indicators with a limit value, a maximum limit value and a reference risk limit value is greater than or equal to the set limit value, the analysis shall be repeated.
(2) If more than 5 per cent of the average value of the monitored quality indicator is increased by an annual increase of more than 5 per cent of the average during the three-year monitoring of drinking water quality, improvement measures must be taken to improve the established status.
Forms of proposals
(1) The application under Article 3 (4) of the Act must contain:
(a) the trade name and registered office of the applicant, if it is a legal person, or the name, surname, birth number (date of birth), business name and place of business, if it is a natural person;
(b) the justification for the proposed exemption and the proposal for a time limit for the duration of the derogation;
(c) a proposal for measures to improve the situation established;
(d) how to inform the drinking water consumers.
(2) The application under Article 4 (2) of the Act must contain:
(a) the trade name and address of the applicant, if it is a legal person, or the name, surname, birth number, business name and place of business, if it is a natural person;
(b) a proposal for an adjustment to the scope and frequency of the check with a justification;
(c) in the case of a proposal to reduce the scope and frequency of the check, proof of the unaltered quality of the source, supported by the results of at least 10 analyses carried out during the last three years.
Efficacy
This Decree shall take effect on 1 January 2001, with the exception of the tightening limits set out in Annex No 1, the 3 µg / l limit for 1,2- dichloroethane, which shall take effect on 1 January 2006, the 0,01 mg / l limit for bromates and 0,1 mg / l limit for trihalomethane, which shall take effect on 1 January 2010, and the 0,01 mg / l limit for lead, which shall take effect on 1 January 2015.

Notes to Annex No 1
1 It concerns waters treated from surface sources by direct sampling and groundwater from groundwater where surface contamination is suspected.
2 It is determined for drinking water treated directly from surface water or for groundwater affected by surface water. Where the value of the indicator is not complied with, it shall be established whether human health is not compromised by the presence of pathogenic micro-organisms such as cryptosporidium.
3 It concerns drinking water from groundwater sources with evidence of beryllium in the subsoil.
4 The limit is determined by the toxic effect of copper. At concentrations above 0,1 mg / l, the organoleptic properties of water may change.
5 The condition that the sum of the nitrate content determined divided by 50 and the nitrite content determined by 3 is less than or equal to 1 must be complied with. The nitrite content in drinking water at the outlet of the plant shall be less than 0,1 mg / l. The drinking water for the preparation of infant formulae and beverages shall have a nitrate content of less than 15 mg / l.
6 It concerns waters disinfected with silver salts and treated with silver containing devices.
7 In case of possible presence of a specified substance released from materials (e.g. from a distribution line) and articles used for the treatment, manufacture and distribution of drinking water, it is determined. The value applies to the residual concentration of the monomer, calculated according to the content and possible release data of the polymer in contact with drinking water.
The sum of the concentrations of tetrachloroethylene and trichloroethylene shall not exceed 10 µg / l.
9 The limit is determined on the basis of the organoleptic action of the substance.
10 Specific compounds are benzo (b) fluorantene, benzo (k) fluorantene, benzo (ghi) perylene, indeno (1,2,3cd) pyrene.
11 The limit applies to individual pesticides, which mean organic insecticides, herbicides, fungicides, nematicides, acaricides, algicides, rodenticides, slimicides, related products and their metabolites or breakdown products, with the exception of aldrin, dieldrin, heptachlor and heptachloroepoxide, where the limit concentration is 0,03 µg / l.
12 The limit is set for the sum of each pesticide identified (see footnote 11). Indicators No 45 and 46 are only collected in cases of justified suspicion of pesticide contamination of water.
13 The content of free chlorine, chlorite or ozone is determined in the case of drinking water disinfection by means of products containing chlorine, chlorodioxide or ozone. The limit value of free chlorine is related to the free chlorine content after treatment. The minimum value of free chlorine in the distribution network is 0,05 mg / l.
14 Limit applies to the sum of the measured concentrations of chloroform, bromoform, dibromochloromethane and bromodichloromethane.
15 Exceedance of the limit value is tolerated only with the chloride concentration caused by the geological background.
The water must not be aggressive.
17 A pH of 4,5 may be allowed for packaged non-carbon-saturated drinking water and for drinking water transported by containers.
18 In case of surface water treatment, water from the treatment plant should not exceed 1,0 NTU (non-phelometric units).
19 It is not necessary to determine if the TOC content (total organic carbon) is determined.
20 It shall be determined in cases of justified suspicion of contamination with oil and petroleum products.
21 It is not fixed for sources of less than 10,000 m3 per day.
22 The limit is the minimum.

* The scope may be provided by the public health authority under Section 4 (2) of the Act.
Note:
1) for every additional 1000 m3 / d of water produced or 5000 inhabitants, the number of basic analyses of category II is increased by 3 and for every 25 000 m3 / d of water produced (125,000 inhabitants) the number of complete analyses of category III is increased by 1. The number of test points of the water network shall be increased by one per 1000 m3 / d of water produced.
(2) the range and frequency of analyses at each of the points examined shall be determined by meeting the minimum frequency requirement of the individual analytical ranges for the entire distribution network of the monitored tap. The output water from the water plant shall be counted as one of the tested sites of the network only.

Note:
1) The shortened range is used to verify the stability of water quality at the different sampling points of the monitored water supply, to verify the inconsistency of the quality of the source (with sufficient data on its quality), as an auxiliary procedure for monitoring water quality of an unknown source (for example, if indicators of the reduced range are exceeded, no further analyses are usually carried out). On the basis of a reduced analysis, it is not possible to assess whether water meets all the requirements of this Decree.
2) The basic range of analyses is used to determine the health of drinking water from groundwater sources of raw water, if it can be assumed that the source is not contaminated. The number of indicators is extended when the source of drinking water is crude water from a surface source, by the determination of 1,2 dichloroethylene, carbon tetrachloride, dichloromethane, ethyl benzene, formaldehyde, and can be extended by the public health authority by indicators close to the permitted limit or by other indicators likely to occur. It may also be reduced in the case of proven stable quality of the water produced and the sources, evidenced by a statistically significant number of data.
3) The full range of analyses is used to determine the health of drinking water from surface water sources, mixed water sources and audit monitoring.

1. Methods for checking values of selected indicators
1.1 Coliform bacteria and Escherichia coli (E. coli) (ISO 9308-1, TNV 75 7835)

1.6.1 Membrane filtration followed by anaerobic culture of the membrane on m- CP agar at 44 ± 1 ° C for 21 ± 3 hours. The frequency of opaque yellow colonies shall be calculated, the colour of which shall be pink or red after exposure to ammonia vapour for 20 to 30 seconds.

2. Quality indicators for which parameters of methods are established
The analytical methods used to determine the chemical and physical quality indicators for which the relevant parameters of the methods are established (see Annex 1, Part Other Conditions) shall comply with the requirement to be able to measure the concentrations of the monitored indicator given the relevant% limit value (10, 25%) with the same minimum percentage of the required accuracy and accuracy. The result shall be expressed using the same units and at least the same number of digits as indicated for the value of the indicator in Annex 1.
