DECLARATION
of 7 September 2005
on emergency situations in the gas industry
The Ministry of Industry and Trade (hereinafter referred to as "the Ministry '), pursuant to Article II (17) of Act No. 670 / 2004 Coll., amending Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of Government Administration in the Energy Sector, and amending certain laws (hereinafter referred to as the Energy Act), as amended, for the implementation of Sections 73 (5) and 10 of the Energy Act:
Subject matter
This decree implements the relevant Directive1) The European Communities and the European Communities provide for a procedure for the prevention of an emergency situation in the gas industry (hereinafter referred to as "an emergency '), for the creation and removal of consequences of an emergency situation using the safety standard of gas supply. It shall also specify the scope and manner of limiting gas consumption and the content of emergency plans for these purposes.
Preventing an emergency
(1) In the event of an emergency, both the agreed gas transport or distribution and the agreed supply to final customers with a gas extraction of more than 400 000 m3 / year may be restricted.
(2) Restrictions on gas consumption in the event of an emergency shall be made by declaring a second stage of sampling, but not more than 48 hours, and shall not be possible to declare more frequently than once a week.
(3) In order to prevent an emergency from occurring with the gas manufacturer, the operation of the gas plant and the pipelines for extraction may be limited to the extent necessary.
Emergency
(1) When an emergency is declared, the transport or distribution of gas or the supply of gas for all traders and final customers may be restricted or interrupted.
(2) When an emergency is declared by the gas manufacturer, the operation of the gas plant and the production pipelines may be restricted or interrupted to the extent necessary.
(3) In the event of an emergency, the gas storage operation may be restricted or interrupted to the extent necessary.
(4) When declaring an emergency, the relevant operator shall restrict or interrupt the supply of gas to customers in the following order:
(a) to customers with an annual sample of more than 400 000 m3 / year, in consultation with the relevant gas trader and transmission system operator or distribution system operator,
(b) all other customers.
(5) When the gas supply to final customers is interrupted, the transmission system operator or distribution system operator shall act in a non-discriminatory manner.
(6) The emergency response shall be remedied according to the emergency plans of the manufacturer, transmission system operator, distribution system operators and underground gas storage operators.
Sampling stages
The sampling steps shall be applied to traders and final customers using gas as follows:
(a) the first stage of take-off which means unabated take-off according to the contractual daily gas take-off;
(b) a second stage of consumption, which means a contractually agreed restriction of gas consumption according to the requirements of the relevant transmission system operator, distribution system operator or underground storage tank operator, up to the level at which all gas demand points above 400 000 m3 / year take place nationally or within a given area to collect gas at the level of the safety and technological minima;
(c) an emergency consumption step which implies an interruption of supply for all final customers.
Demonstration of sampling steps
(1) The nationwide announcement of the demand stages by the transmission system operator is carried out via the Czech Radio station ČRo 1 - Radio station in regular daily relations, at 6.00 and 13.00 hours after the end of the reporting session or other media, as the case may be.
(2) The announcement of the second demand stage or the emergency demand stage for a part of the national territory by the distribution system operator shall be carried out through the local broadcast of the Czech Radio or ČRo 1 station - Radio station in regular daily relations at 6.00 and 13.00 hours after the end of the reporting session or other media.
(3) The announcement of the emergency demand stage is also reported by the distribution system operators, municipalities, regions and authorities of the Czech Police and the authorities of the Czech Fire Rescue Corps mentioned in the emergency plan.
Security and technological minimum
(1) The safety and technological minimum is established for all final customers with a gas consumption above 400 000 m3 / year on the basis of an inventory of individual appliances prepared by these final customers, without production requirements with an immediate restriction of consumption to the safety and technological minimum, i.e. a zero or minimum value to ensure the safety of the sampling equipment and operators. In the case of a gas sampling device where it cannot be immediately withdrawn or reduced to a safety and technological minimum, it is necessary to determine the time shift in hours as necessary for the completion of the sampling or reduction.
(2) The inventory of gas appliances and the safety and technological minimum are set out in the relevant contract, including the labelling of appliances for which the time shift necessary for the completion or reduction of the collection is determined.
(3) For final customers, who in particular ensure the production of daily food for the population, the processing of perishable food, animal production operations with the risk of mortality, the necessary needs of health care facilities, fire protection units, water treatment plants, sanitation facilities and crematorium, the safety and technological minimum is up to 95% of the contracted daily gas consumption.
(4) If the safety and technological minima of supply is not ensured by the safe supply of gas to the population, an emergency stage shall be declared to allow the gas supply to be interrupted for all final customers.
Gas supply safety standard
(1) The safety standard of the required gas supply is to ensure safe and reliable gas supply in order to prevent and / or to prevent emergency situations for households and those final customers who cannot switch to other sources of energy, in particular for the following situations:
(a) for a partial interruption of the supply of gas for a period of 8 weeks and up to 20% of the total daily volume of all import contracts intended to ensure the supply to the final customers of the relevant trader in the territory of the Czech Republic or to ensure the consumption of the relevant customer who procures the gas himself during the winter period;
(b) for gas consumption in 5 consecutive extremely cold calendar days, the extremely cold calendar day being the day on which the average daily temperature remains below -14 ° C;
(c) to cover gas demand for all consumption options resulting from the development of outdoor temperatures during the coldest period from 1 October to 31 March that occurred in the last 20 years preceding that year.
(2) Gas traders and final customers who procure gas themselves may provide a security standard for the supply of gas to the appropriate extent attributable to that trader or final customer through their gas supplier.
(3) The security standard for the supply of gas to households and small customers is provided by the relevant supplier of the last instance from the first day of the following month after the customer requests the delivery of the last instance.
(4) Traders supplying gas to final customers and those final customers procuring gas themselves will demonstrate, before concluding a gas transport contract, that the transmission system operator ensures a safety standard for gas supply.
(5) Traders supplying gas to final customers and those final customers who procure gas themselves and do not use the transmission system to ensure supply shall provide proof to the distribution system operator of the security standard of gas supply prior to the conclusion of the gas distribution contract.
(6) Buyers supplying gas to final customers and those final customers providing gas themselves submit data on the size of the safety standard and the way in which it is secured on the first day of each month to the Bilance Centre.
Emergency plan
(1) Emergency plans are being developed to deal with and eliminate accidents in facilities for the production, transport, distribution and storage of gas and to deal with the consequences of an emergency.
(2) The emergency plan must always include:
(a) a description of the emergency situations;
(b) the name, surname and function of the member of the emergency committee, the manner in which the commission is convened;
(c) the system of transmission of information in the event of accidents;
(d) policies for the disposal of emergency situations;
(e) the merger plan and the reporting obligations of the natural gas operator;
(f) the location of the operational technical documentation.
Repeal
Decree No. 167 / 2001 Coll., on emergency situations in the gas industry, is repealed.
Efficacy
This Decree shall enter into force on 1 October 2005.
