DECLARATION
of 30 October 2003
implementing certain provisions of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related acts (Veterinary Act), as amended, and on animal health requirements for animal products
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., ("the Act ') for the implementation of Sections 18 (5), 20 (8), 21 (7), 22 (2), 24 (2), 25 (1), 27 (4) and 53 (6) (a) of the Act:
IMPLEMENTATION OF CERTAIN PROVISIONS OF THE LAW AND VETERINARY REQUIREMENTS FOR ANIMAL PRODUCTS
INTRODUCTORY PROVISIONS
Subject matter
(1) This Decree provides
(a) the animal health requirements for the organisation and equipment of undertakings, establishments or other establishments (hereinafter referred to as "the undertaking") in which meat is cut and stored and produced and stored by meat products intended for direct sale to the consumer at the place where those activities are carried out;
(b) the particulars of the application for approval and registration in accordance with Article 22 (1) (a) of the Act;
(c) animal health conditions for the sale of animal products in markets and markets and separate sales points for seasonal fish;
(d) the animal health conditions governing the direct sale to the consumer of raw, dairy-treated milk and products derived from that milk;
(e) animal health requirements for limited quantities of game delivered directly to the consumer or retailer;
(f) the assessment and labelling of animal products on the basis of their veterinary examination and their release into circulation, in so far as they are not intended to indicate their health under specific legislation, 1)
(g) labelling of raw materials and foodstuffs of animal origin coming from undertakings with a transitional period, 2)
(h) the formalities for the operating and sanitation rules;
(i) the principles of the sampling procedure for laboratory examination, the data contained in the report on the sampling carried out for the purposes of national veterinary supervision.
(2) This Decree also provides for animal health requirements for the acquisition, production, processing, treatment, packaging, storage, transport and putting into circulation of animal products (hereinafter referred to as the "treatment of animal products'), unless they are regulated by specific legislation, 1) and for the organisation and equipment of the undertakings in which those animal products are treated.
Definition of terms
For the purposes of this decree:
(a) large slaughter animals - cattle, including calves, pigs, sheep, goats and horses, asses and their cross-breeds, including foals, and jowls and cloven-hoofed game, farmed;
(b) small slaughter animals - piglets, lambs, kids, poultry and rabbits and farmed feathered game and hares and farmed wild rabbits;
(c) other animals - other animals whose meat is intended for human consumption,
(d) adult bovine animals - bovine animals weighing more than 300 kg,
(e) meat - all parts of the body of the animal intended for human consumption,
(f) changed parts - parts of meat or organs, pathologically or otherwise, which may be separated from other meat or organs,
(g) other parts - all parts of the slaughter or other animal not intended for human consumption,
(h) mechanically separated meat - meat intended for the manufacture of heat-treated meat products, obtained by the machinery separation of the residues of meat remaining on bones other than bones from frozen meat, head bones, bones of the limbs under the wrists and bones of the joints, of bovine, ovine and caprine animals, of the tail vertebrae of pigs, of poultry tread and of the tail vertebrae of rabbits, as well as of the neck skin of poultry on establishments where the bone is horny and the cell structure of the meat is broken;
(i) crochet birds - mechanical removal of part of the digestive tract of the body through the cloacal opening,
(j) the collection and inspection point (assembly centre) - the place where, in accordance with the hygiene requirements laid down, wild game caught bodies are inspected and stored prior to their transport to the game processing undertaking,
(k) eggs - eggs of birds in shell intended for direct consumption or industrial processing for human consumption,
(l) batch (s) - products of the same kind, manufactured not more than one working shift under conditions which may be considered to be the same, in particular from the same raw materials, the same technological process and on the same production facility,
(m) good hygiene practice - compliance with sanitary, technological, technical and legal requirements and standards necessary to ensure the health, safety and quality of animal products, taking into account their nature, characteristics and destination.
(1) Animal products are health-friendly if:
(a) have been obtained from healthy animals or produced from non-harmful raw materials and put into circulation in compliance with the requirements laid down by specific legislation, 3)
(b) have no impaired or altered sensory properties;
(c) the maximum levels of residues of substances and preparations which are harmful to human or animal health laid down by specific legislation4 (hereinafter referred to as "the limits set") are not exceeded if they are intended for human or animal nutrition.
(2) Animal products intended for human consumption (hereinafter "food of animal origin") are:
(a) edible if they meet the requirements referred to in paragraph 1;
(b) edible after special treatment or further processing (hereinafter referred to as "edible after treatment"), unless they meet one of the requirements referred to in paragraph 1 (a) and (b), the health reasons or changes in sensory properties do not give rise to them being inedible;
(c) non-edible if any of the requirements referred to in (a) and (b) are not met or if, for any other reason provided for by this Decree or by decision of the Regional Veterinary Administration and in the territory of the City of Prague, the Municipal Veterinary Administration in Prague (hereinafter referred to as the Regional Veterinary Administration) is not fit for human consumption, in particular because they are:
1. unfit for human consumption for health or epidemiological reasons,
2. altered, resisted or degraded in such a way that their use for human consumption is excluded; or
3rd unknown or suspicious.
(3) The foodstuffs of animal origin referred to in paragraph 2 (b) shall be treated by processing into:
(a) heat-treated products by a process which ensures that in all parts an effect corresponding to a temperature of at least 70 ° C is achieved for at least 10 minutes;
(b) a can which ensures that at least 121 ° C is effective for at least 10 minutes.
(4) The Regional Veterinary Administration may decide pursuant to Paragraph 49 (1) (m) of the Act on a procedure other than that referred to in paragraph 3 which guarantees the health of the final product.
(1) Foodstuffs of animal origin, assessed as fit for consumption after treatment, must be processed without undue delay in accordance with the animal health conditions laid down and must not be used to produce stocks. Animal products which are intended for further processing and have not been assessed in the same way as regards their health must be stored and processed either locally or on time until processing into the product. They can only come into contact with other raw materials when processed into the same product.
(2) Only the following may be recovered from the trading network:
(a) animal products which have not been taken over when the goods are taken over; or
(b) animal products which have been taken over at the time of acceptance of the goods and show a manufacturing (technological) defect, sensory undetectable at the time of acceptance of the goods without infringing the integrity of the product, provided that they have been kept until their return under the animal health conditions laid down for animal products of that kind. Such products may only be taken back by the manufacturing undertaking (supplier) provided that their proper entry back is ensured and that the traceability of these products is maintained; their further use or disposal shall be decided by the official veterinarian.
(1) If they are products intended for infant and infant use, they must be:
(a) daily sensory and laboratory checks of the milk delivered and laboratory checks of each batch of products;
(b) dispatched products only on the basis of the results of laboratory testing of samples from the batch (s) concerned.
(2) If the dose (lot) does not comply with the animal health requirements, the county veterinary administration shall determine the method of use of the products in accordance with Section 49 (1) (m) of the Act.
(1) The microbiological requirements for raw materials of animal origin intended for food and feed production are set out in Annex 1 to this Regulation.
(2) The principles of the procedure for sampling for laboratory examination and the data contained in the report on sampling carried out for the purpose of carrying out national veterinary supervision are set out in Annex 2 to this Regulation.
Application for approval and registration of an undertaking, establishment or other establishment
(1) The entrepreneur acquiring, producing, processing, treating, packaging, storing, transporting and putting into circulation animal products shall indicate in the application for approval and registration of the undertaking, establishment or other establishment, where appropriate
(a) a business firm or name, registered office and identification number, if it is a legal person, name, surname, place of permanent residence (place of business, different from place of permanent residence), and an identification number, or a business firm, if it is a natural person who attests to a business register or an extract from a business register;
(b) the address of the establishment;
(c) information on the type and extent of the activity (volume of production and sale of goods; in the case of slaughterhouses, cutting plants, cold stores, freezers, meat products, raw milk processing, actual capacity determination).
(2) The Regional Veterinary Administration shall assess the completeness of the application submitted and may require, in particular, the risk of health risks arising from animal products in the control of the undertaking, plant or other establishment, as appropriate,
(a) critical point control system (HACCP) - definition of production activity, description of the product including use, diagram of production process, hazard analysis, determination of critical points, for each critical point specified limits, monitoring method and corrective action, timing of verification procedures and internal audits, record documentation;
(b) the means of collecting and securing the collection (disposal) of waste (waste haulage contract) or the approval of waste disposal facilities;
c) a clear situation plan of the building with the layout of the establishment and with connection to the external layout;
d) a clear plan of the building with internal layout solution including technology,
(e) a brief technical report containing information on:
1. lighting, ventilation, light height, wall and floor treatment,
2. drinking water source,
3. sewerage system,
4. disposal of waste from operations (municipal, biological),
5. Number of employees,
6. sanitary facilities for employees (toilet, dressing room, day room),
7. production facilities, preparation rooms, warehouses, reception and storage places for raw materials and packaging materials used in the manufacture, packaging, storage, dispatch of finished products and washing of containers, aids and tools, including production capacities,
(f) the operating rules of slaughterhouses or the organisation of operations and the hygiene regime in other establishments;
(g) contingency plan for measures in slaughterhouses in the event of the occurrence of certain dangerous diseases and diseases communicable from animals to humans;
(h) sanitation schedule - method of sanitation of individual production premises and facilities, list of cleaning and disinfection products approved for use in food, safety data sheets, approval of devices (INNRG), concentration and method of preparation of solutions or mixtures and permanent keeping of documentation,
(i) the results of the laboratory examination of drinking water - description of the source, annual plan of water sampling according to consumption, in-service water schedule drawing, drawing of sampling points, list of sampling points, test results, measures in case of non-compliant test result;
(j) plan for disinfection, disinsection and extermination (hereinafter referred to as "PPAs") - contract with the firm performing the PPAs' activities, diagram of the location of the pitfalls on the operation plan, annual frequency of implementation of the PPAs' actions, list of means used PPAs, safety data sheets, approval of funds (SCVBL), methodology of evaluation, record of implementation, results, responsible staff,
(k) staff training plan - health cards, annual training plan, training content, trainers,
(l) own system of laboratory control of the health conditions of production and health of animal products;
(m) the approval decision.
VETERINARY CONDITIONS FOR ANIMAL PRODUCTS
General conditions for the organisation and equipment of undertakings
(1) Undertakings which treat animal products as well as undertakings which are not subject to specific legislation, (1) must be organised and equipped in such a way as to avoid pollution and contamination of animal products and to process, treat and store such products in accordance with specified hygiene and technological procedures and under appropriate microclimatic conditions.
(2) The rooms and other premises in which animal products are treated must, taking into account the type of animal products and the nature of the activity carried out therein, be:
(a) floors, walls, ceilings and, where appropriate, inner surfaces, roofing, doors and window frames easily cleaned and disinfected, made of well-maintained, smooth, impermeable and non-corrosive materials which do not adversely affect the health of animal products;
(b) floors designed to allow easy and direct drainage of water into the sewerage;
(c) the condensate discharge must be driven directly into the sewer line;
(d) the surface of walls capable of being washed up to a minimum of 2 m and in refrigerators and freezers up to at least the amount of animal products stored;
(e) round wall connection with floor,
(f) bevelled window parapets,
(g) all unbundled divorces shall result only in necessary connections;
(h) sufficient natural or mechanical ventilation and exchange and, where appropriate, filtration and conditioning of air to ensure that, depending on the temperature and the technological process, the relative humidity below the dew point is maintained, so as to avoid condensation of water vapours and to remove unwanted odours, steam, smoke and other impurities from the air;
(i) corresponding to natural or artificial lighting;
(j) a sufficient number of suitably located and equipped facilities for washing, drying and disinfection of hands with running drinking water, cold and hot water, possibly pre-mixed to a suitable temperature;
(k) adequate facilities for washing animal products with drinking water, separated from hand washing, where appropriate;
(l) equipment with running water at a temperature of at least 82 ° C for cleaning and disinfection of tools, tools, containers and work aids;
(m) a sufficient number of cloakrooms and flushing toilets for staff placed in such a way as to avoid direct entry from these places to the workplace;
(n) water supply batteries which shall not be manually operated;
(o) separate areas for washing, disinfection and storage of packaging, crates, operational and storage containers,
(p) a lockable room or cabinet for storing cleaning and disinfectants;
(q) a rendering box (safe) or marked, impermeable containers for animal confiscates, or other wastes, and disposal facilities for such confiscates, or waste,
(r) effective protection against the intrusion of insects, rodents and other animals.
(3) Lighting with a intensity of 540 lux (50 trace channels) at places of veterinary investigation of food of animal origin, 220 lux (20 trace channels) at places of performance of individual work activities and 110 lux (10 trace channels) at other places is considered sufficient.
(4) Meat and meat products from the undertakings referred to in paragraph 1 may be sold not only to consumers but also to establishments providing on-site catering services; However, the quantity of meat and meat products so sold by establishments providing on-site catering services shall not exceed 500 kg per week.
(5) For cold stores or cold stores with a capacity exceeding 3,5 tonnes, for undertakings where more than 5 tonnes of meat is cut down per week or where more than 7,5 tonnes of meat products are produced per week for direct sale to the consumer at the place where those activities are carried out, the requirements laid down in specific legislation shall apply. 5)
(1) In a cutting plant located in an area related to a factory or shop in which beef is cut must be available
(a) tables and, where appropriate, areas on which the cutting of those parts which are naturally related to the vertebral column (low spiny, sirloin and others) is carried out, except where cutting is carried out in a visa without contact with the spine with the table or the surface, and tools and work aids for cutting,
(b) weight to weigh the spine;
(c) marked, impermeable and lockable containers for the storage of vertebral column of bovine animals over 12 months of age;
(d) a refrigerated storage room for this specified risk material6 (together with other confiscates of animal origin).
(2) Immediately after receipt of the raw material, the parts of the carcases of bovine animals admitted to the cutting plant are classified in the parts of the carcases of bovine animals under 12 months of age and older than 12 months of age. When cutting parts of bovine animals over 12 months of age, care must be taken to avoid bone fragments spreading; the spine shall be placed immediately in the container referred to in paragraph 1 (c).
(3) Tables, surfaces, tools and workpieces which have come into contact with the spine must be cleaned and disinfected.
(1) Technological equipment, machinery, tools, tools, containers and work equipment which come into contact with animal products shall be so designed and equipped that:
(a) their surfaces are smooth, easy to wash and disinfect;
(b) have not been subject to corrosion and have not adversely affected the health of animal products.
(2) Technological equipment, machinery, tools, tools, containers and workpieces, made using wood, can only be used
(a) in manufacturing operations where this is necessary for technological reasons and there is no risk of contamination of products;
(b) in rooms and other premises where the said articles come into contact only with hygienically packaged animal products.
(3) Technological equipment and machinery must be deployed in such a way that easy access to them allows for proper cleaning and disinfection and repair.
(4) Technological equipment, machinery, tools, tools, containers and work equipment used in the slaughter and slaughter of animals must not be used for cutting, boning or other processing of meat.
(1) Provided that the health and quality of animal products are not compromised, the Regional Veterinary Administration may allow for the reduction of the requirements for the organisation and equipment of the undertakings referred to in Article 8 (2), namely the requirements for:
(a) round wall connection with floor,
(b) bevelled window parapets,
(c) covered distribution lines;
(d) separate treatment of raw materials and products when treated in the same room;
(e) other than manual control of water supply batteries in cloakrooms or other premises,
(f) running water at a temperature of at least 82 ° C.
(2) Provided that the health and quality of animal products are not compromised, the Regional Veterinary Administration may allow for the mitigation of the requirements for technological equipment, machinery, tools, tools, containers and working aids which come into contact with the animal products referred to in Section 10, namely the material requirements for the production of blocks used in cutting meat.
(1) The undertakings in which animal products are treated must be supplied with drinking, cold and hot water under pressure in such quantities as to fully cover its need during the production process.
(2) Steam and ice used in the treatment of animal products can only be produced from drinking water.
(3) Useful water may only be used for the production of steam for technical purposes, for cooling refrigeration equipment, for cleaning patios and roads, for extinguishing fires, or for other similar purposes where contamination of animal products cannot occur. The distribution of utility water shall be separated from the distribution of drinking water and clearly marked.
(1) The premises and facilities intended for the handling of animal products under the specified conditions, in particular the cooking, smoking, pasteurisation, drying, cooling and freezing facilities, must be equipped with reliable instruments and sensors for measuring and recording the required values.
(2) Continuous pasteurisation and other heat treatment facilities must be equipped with automatic systems which exclude the possibility of insufficient heating and ensure that heat-treated and non-heat-treated products or raw materials are not mixed.
If the packaging of animal products is not part of the production line, it shall be carried out in hygienically satisfactory spaces separated from the production and storage areas.
(1) Means of transport used for the transport of animal products must have walls and other parts which come into contact with the products being transported, with a smooth, easily washable and disinfected surface, not corrosive and not adversely affecting the health of the products being transported.
(2) The means of transport referred to in paragraph 1 must not be used for the transport of persons, live animals, game in the skin or feathers and confiscates of animal origin, or other raw materials or products which could cause contamination or contamination of the transport space.
(3) In case of transport of animal products which can only be stored at a specified temperature, the temperature of the transported animal products must not increase by more than 2 ° C during transport.
(4) Packed and unpackaged animal products can only be transported in one means of transport if their safe physical separation is ensured.
(1) Animal products are transported either suspended - halves and quarters of slaughter animals at all times, or in containers, containers or containers made of non-corrosive material and stored on shelves, mats or mats. Where containers and containers are placed on each other in the transport space, their bottom shall not touch the animal products, stored in the lower containers or containers. If the containers and containers are not fitted with a lid, the transported animal products shall be hygienically covered.
(2) Free-loaded liquid, granulated or powdered animal products are transported in closed collection tanks, tanks or containers which serve exclusively for the transport of such products and bear a visible and indelible inscription indicating the type of products transported. The ends of the intake hoses shall be secured against pollution during transport.
(1) Ramps intended for the loading and unloading of animal products must be cleaned and disinfected at least every 24 hours.
(2) Transport spaces of means of transport, containers and tanks shall be cleaned after each complete unloading and, where appropriate, before loading. Carriers, containers, shelves, mats and mats are cleaned daily. However, if the transport of foodstuffs of animal origin is not packed in such a way as to be fully protected against adverse effects on the external effects or which may cause adverse effects on other goods transported, they shall be cleaned, as appropriate, before re-loading.
(1) If a veterinary certificate is required for the transport of animal products, it must be issued at least 12 hours before loading.
(2) The animal health certificate for the transport of animal products certifies the data relating to the consignor and consignee, the products transported (type, weight, date of manufacture, result of the veterinary assessment, date and time of removal from storage, temperature, etc.), the manufacturer and the means of transport.
(3) The veterinary certificate referred to in paragraph 1 shall be valid for 72 hours.
Principles of personal hygiene
When handling animal products, the principles of operation hygiene and personal hygiene must be respected. Always need
(a) to ensure personal cleanliness, wash hands with liquid soap or other appropriate means during the working day and disinfect them with an appropriate disinfectant, namely before each restart of work, after each contamination and after each use of the toilet;
(b) wear clean working clothes, footwear, headgear and, where necessary, gloves, and, if necessary, a light-coloured neck cover, and, where necessary, change them during the working day;
(c) ensure that animal products are treated in accordance with the animal health requirements laid down for them and that their immediate contact with the exposed part of the head and neck does not occur when treated with unpackaged products;
(d) not to put down personal uppers and items of personal need in the operating areas at places not intended for this purpose and to maintain cleanliness and order in the workplace;
(e) refrain from eating, drinking, smoking and chewing or other non-sanitary behaviour in the workplace on which animal products are treated;
(f) not to leave the premises in working clothes and work footwear;
(g) have a medical certificate.
Specific conditions for the organisation and equipment of undertakings
_
The collection and viewing point (assembly centre) shall have:
(a) cold store for receiving whole bodies of game with temperature registration;
(b) an area adequately equipped for their veterinary examination;
(c) appropriate conditions for the separate storage of game carcases which have been examined and which have not yet been examined;
(d) adequate equipment for the safe storage of inedible bodies and organs;
(e) hand-operated washing and disinfection equipment and equipment for cleaning and disinfection of tools, tools, containers and workpieces, as well as suitable space for the safe storage of cleaning and disinfectants.

(1) The packing centres must have:
(a) corresponding premises
