The Constitutional Court decided under sp. zn. Pl. ÚS 39 / 23 on 29 November 2023 in plenary composed of the President of the Court of Josef Boxy and of the judges and judges of Josef Fiala, Jaromír Jirsa, Veronica Christian (Judge of the Rapporteur), Tomáš Lichovník, Kateřina Ronovska, Jan Svatona, Pavel Šámal, Vojtěho Šimíček, Jan Winter, Jiří Zemánek and Daniela Zeman on the proposal of the Ministry of the Interior to abolish Article 4 (2), Article 5 (1) of the last, Article 5 (2), Article 10 (2) and Annex No 3 in the words "Total Waste of 3.30 CZK / kg 'of the Municipality of Stachy 1 / 2022, on the establishment of the general system of waste, with the participation of Stachy 200.
as follows:
I. Article 5 (1) of the last sentence and Annex No 3 in the words "Obligation of waste 3.30 CZK / kg" of the generally binding Order of the municipality of Stachy No. 1 / 2022 on the establishment of the municipal waste management system shall be deleted from the date of the declaration of findings in the Collection of Laws.
II. The remainder is rejected.
