DECLARATION
of 30 October 2003
on the reimbursement of costs incurred in carrying out veterinary checks on animals for slaughter and meat and on the examination and assessment of animal products
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., ("the Act ') for the implementation of Section 75 (3) of the Act:
Subject matter
This decree, in accordance with the law of the European Communities (1), regulates the amount of compensation for the costs of carrying out veterinary checks on animals for slaughter and meat, the examination and assessment of animal products, and the amount of compensation for the costs of monitoring the presence of certain substances and their residues in animals and their products, which are carried out under specific legislation, (2) collected until 31 December 2006.
HIGH REFUNDS ON COSTS COVERED WITH THE EXAMINATION OF VETERINARY INFLUENCES FOR EQUIVALENT ANIMALS AND MEAT, EXAMINATION AND SUPPORT OF ANIMAL PRODUCTS, AND AMOUNT OF COSTS COVERED WITH THE IMPLEMENTATION OF CERTAIN SUBSTANCES AND THEIR RESIDENCE IN ANIMALS AND IN THEIR PRODUCTS SELECTED FROM 1 JANUARY 2005 TO 31 DECEMBER 2006
Veterinary inspection of animals for slaughter and meat, examination and assessment of animal products
(1) The reimbursement of the costs of carrying out veterinary checks on animals for slaughter and meat shall be:
(a) beef and veal:

in the case of adult bovine animals of at least 24 months old slaughtered by necessary slaughter and adult bovine animals of at least 30 months old, the amount of CZK 83 shall be increased by CZK 750 per animal;
(b) horse meat:

(c) pigmeat:

| – od 12 kg do 18 kg | 7,– Kč za zvíře, |
| – 18 kg a více | 10,– Kč za zvíře; |
(e) poultrymeat:
| na jatkách, které zpracovávají méně než 10 000 kusů drůbeže ročně | 0,33 Kč za zvíře, |
| na jatkách, která zpracovávají více než 10 000 kusů a méně než 150 000 kusů drůbeže ročně | 0,25 Kč za zvíře, |
| na jatkách, které zpracovávají více než 150 000 kusů drůbeže ročně | 0,22 Kč za zvíře; |
(f) rabbit meat, farmed game meat and game meat:
| králíci a drobná srstnatá a pernatá zvěř | podle písmene e), |
| divoká prasata | podle písmene c), |
| přežvýkavci | podle písmene d). |
(2) Where the veterinary inspection of animals for slaughter and meat is carried out at a time other than the operating time of the slaughterhouse, as laid down in their operating and sanitary rules, or, where appropriate, in the case of slaughterhouses with small capacity, at a time other than the prescribed slaughter days and hours, the reimbursement of the costs associated with its performance shall be increased to twice the costs referred to in paragraph 1 (a) in the sentence behind the semicolon.
(1) Reimbursement of costs related to the veterinary inspection of meat relating to its cutting 11) is CZK 55 per tonne of meat entering the cutting plant; This amount is added to the amounts set out in Section 16.
(2) Where cutting of meat is carried out on the undertaking in which the meat was obtained, the amount referred to in paragraph 1 shall be reduced by 55%.
The costs of carrying out the veterinary inspection of meat at its storehouse (12) shall be reimbursed at an amount corresponding to the actual expenditure relating to the inspection of the meat stored.
The compensation referred to in paragraphs 16 to 18 shall be collected in accordance with Paragraph 75 (3) of the Act in slaughterhouses, cutting plants or cold stores.
Veterinary inspection of fishery products
(1) Reimbursement of costs related to the veterinary inspection of fishery products (13) at the first marketing of fishery products is CZK 19 for the first 50 tonnes and CZK 10 for each additional tonne.
(2) Compensation for costs related to the veterinary inspection of fishery products when entering the processing undertaking is CZK 19 per tonne of fishery products.
(3) Where the working or processing of fishery products is carried out at the same place (in the same undertaking) as their first sale, the amount referred to in paragraph 2 shall be reduced by 55%.
(4) All marine or freshwater animals or parts thereof, including eggs and roes, other than aquatic mammals, frogs, aquatic animals and bivalve molluscs, shall be considered as fishery products.
The reimbursement of the costs referred to in Article 20 (1) shall be collected from the operator of the slaughterhouse or establishment which is the buyer at the first sale, the reimbursement of the costs referred to in Article 20 (2) shall be collected in processing undertakings carrying out individual activities in the processing of fishery products in which those products are subjected to veterinary inspection.
Monitoring of certain substances and residues thereof in animals and their products
(1) The reimbursement of the costs associated with the monitoring of the presence of certain substances and residues thereof in animals and their products14), if applicable
(a) live animals for slaughter and meat covered by Section 16, paragraph 1, 25, - CZK for each and every tonne of meat from slaughterhouses,
(b) fishery products covered by Section 20, CZK 2.50 for each tonne of such products put into circulation;
(c) milk and milk products, CZK 0.40 for every 1000 litres of raw milk,
(d) egg products, the amount corresponding to the actual cost of their veterinary inspection.
(2) The reimbursement of the costs referred to in paragraph 1 shall be collected in accordance with Article 75 (3) of the Act in the relevant undertaking forming part of the production chain: in the slaughterhouse, if it is for reimbursement of the costs referred to in paragraph 1 (a), in the processing undertaking, if it is for reimbursement of the costs referred to in paragraph 1 (b), in the milk treatment undertaking, if it is for reimbursement of the costs referred to in paragraph 1 (c), in the processing undertaking, if it is for reimbursement of the costs referred to in paragraph 1 (d).
FINAL PROVISIONS
Common provision
The State Veterinary Administration communicates regularly to the European Commission in accordance with Section 48 (1) (o) of the Act
(a) information relating to the distribution and use of the funds collected in the form of reimbursement of costs under this Order, including a justification for the calculation of such compensation;
(b) the conversion rate used to convert the reimbursement of the costs referred to in (a) from EUR to CZK in the relevant calendar year,
(c) the place (s) at which the reimbursement of costs is collected, including the necessary explanation.
Efficacy
This Decree shall take effect on the day of its publication, with the exception of Part II, which shall take effect on 1 May 2004, and with the exception of Part III, which shall take effect on 1 January 2005.
Validity
(1) Part I shall expire on 30 April 2004.
(2) Part II expires on 31 December 2004.
(3) This Decree expires on 31 December 2006.
