GOVERNMENT REGULATION
of 1 December 2010
amending Government Regulation No 197 / 2005 Coll., laying down the conditions for granting aid for the implementation of measures to improve the general conditions for the production and marketing of apiculture products, as amended by Government Regulation No 285 / 2007 Coll.
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Čl. I
Government Decree No 197 / 2005 Coll., laying down the conditions for the grant of aid for the implementation of measures to improve the general conditions for the production and marketing of apiculture products, as amended by Government Decree No 285 / 2007 Coll., is hereby amended as follows:
1. In Article 1 and footnote 1, the words "European Communities' are replaced by the words" European Union '.
2. In footnote 2, the sentence "Council Regulation (EC) No 797 / 2004 of 26 April 2004 on measures to improve the general conditions for the production and marketing of apiculture products' is replaced by the sentence" Council Regulation (EC) No 1234 / 2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation), as amended '.
3. in Article 4 (1) (a), the word "education" shall be replaced by "practical."
4. in Articles 4 (1) (d) and 4 (4) (d), the word "new" shall be inserted after the word "acquisition."
5. In Article 4, at the end of paragraph 1, the dot is replaced by a comma and the following point (f) is added:
"(f) the acquisition of new appendices of the type Langstroth, Dadant or type with frame dimensions 390 x 240 mm for bee breeders registered under the Breeding Code (3) first in the calendar year preceding the calendar year of application."
6. in Paragraph 4 (2) (a), the word "education" shall be replaced by "practical."
7. in Paragraph 4 (2) (d), the word "new" shall be inserted after the word "number and species."
8. In Article 4, the dot is replaced by a comma at the end of paragraph 2 and the following point (f) is added:
"(f) the number and type of new replacement hives for which it requires a subsidy, if applicable, in accordance with paragraph 1 (f), and the undertaking that the installation will hold and operate for at least 5 years."
9. in Article 4 (4) (a), "education" is replaced by "practical" and "education" is deleted;
10. in § 4 (4) (a) (1):
'1. have kept at least two speakers who have a secondary education in apiculture or, where appropriate, have a higher education, approved by the applicant or included in the list submitted to the applicant by 31 January of the calendar year in which the course is to be conducted, a civil association continuously active in the field of bee husbandry for at least three calendar years immediately preceding that calendar year; ';
11. in Article 4 (4) (a) (2), "4 hours" is replaced by "6 hours."
12. in § 4 (4) (c) (1):
'1. led by a lecturer who has a secondary education in apiculture or, where appropriate, has a higher education, approved by the applicant or included in a list submitted to the applicant by 31 January of the calendar year in which the course is to be conducted, by a civil association continuously active in the field of bee husbandry for at least three calendar years immediately preceding that calendar year; ';
13. In Article 4, at the end of paragraph 4, the dot is replaced by a comma and the following point (f) is added:
"(f) the acquisition of new apiculture hives referred to in paragraph 1 (f), where the applicant demonstrates by 31 August of the relevant calendar year at the latest the purchase of that establishment and provides evidence of the identification data of the bee breeder registered under the Breeding Act (3) first in the calendar year preceding the calendar year of the application purchased by that establishment (name, surname, last name, date of birth and address of the place of permanent residence or place of business, and the identification number, if allocated, or name, registered office and identification number of the establishment referred to in paragraph 1 (f), has been allocated for at least 5 years.";
14. in Paragraph 6 (1):
"(1) A subsidy may be granted under measures to rationalise the diving of hives for the acquisition of new or, where appropriate, new equipment for the diving of hives with a total purchase value of at least CZK 20,000 and for which no subsidy has been received."
15. in Article 6 (2), the words "or intends to implement" shall be deleted;
16. in Paragraph 6 (3):
"(3) The Fund shall grant a subsidy for the acquisition of a new bee-keeping facility referred to in paragraph 1 if, by 31 August of the relevant calendar year at the latest, the applicant demonstrates the acquisition of a bee-keeping facility referred to in paragraph 1 in respect of a bee-keeping operator referred to in paragraph 2 (a) who undertakes to hold and operate the establishment referred to in paragraph 1 for at least 5 years. ';
17. in Article 6, paragraph 4 is deleted;
18. in Paragraph 8 (1) (b), the word "State" shall be replaced by the words "Regional competent."

„§ 9
Determination of the subsidy
The amount of the subsidy earmarked for the measures provided for in paragraphs 4 to 8 shall be published by the Fund by 31 January of the current calendar year at the latest in a manner that allows remote access. ';
20. Paragraph 10, including the title, reads:
„§ 10
Amount of the subsidy per measure
(1) The amount of the subsidy for the measure referred to in Article 4 shall not exceed:
a) CZK 6,000 per individual practical course for bee breeders according to § 4 (1) (a),
b) CZK 6,000 per single seminar according to § 4 (1) (b), if it is a seminar lasting 1 calendar day,
(c) 12 000 CZK per seminar according to § 4 (1) (b), if it is a seminar lasting at least 2 calendar days,
d) CZK 3,000 per individual lecture according to § 4 (1) (c),
(e) 50% of the actual cost of the equipment referred to in § 4 (1) (d) but not more than CZK 100,000,
f) 10 000 CZK per calendar year for the organisation of lectures pursuant to § 4 (1) (e),
g) 1 000 CZK for 1 new extension hive, but not more than 4 replacement hives according to § 4 (4) (f).
(2) The amount of the subsidy for the measure under Article 5 is:
(a) 70% of the actual cost of medical or preventive measures against varroasis up to a maximum of the amount for each of the medicinal or preventive measures listed in Part B of Annex 2;
(b) 10 CZK per year for one colony to cover the costs referred to in Article 5 (1) (b).
(3) The amount of the subsidy for the measure referred to in § 6 is not more than 50% of the actual cost of the equipment under § 6 (1) but not more than CZK 150 000.
(4) The amount of the subsidy for the measure under Article 7 is:
a) 800 CZK per mede9 analysis according to § 7 (1) (a),
b) 400 CZK per honey analysis according to § 7 (1) (b).
(5) The amount of the subsidy for the measure under Article 8 is:
(a) CZK 200 per bee mother sold from a recognised breeding programme (11),
(b) not more than CZK 1 000 per new extension hive, but not more than the purchase of 2 extension hives according to § 8 (1) (b).
(6) Where the sum of all eligible entitlements referred to in paragraphs 1 to 5 exceeds the financial amount declared in accordance with paragraph 9 and adjusted in accordance with paragraph 14a, the Fund shall, as a priority, pay the subsidy referred to in paragraph 2 and reduce the remaining funds for the payment of the subsidies referred to in paragraphs 1, 3 to 5. ';
21. Article 11 to 13 shall be deleted, including the headings.
22. the following Section 14a is inserted after Section 14:
„§ 14a
If, for the calendar years 2011 to 2013, the total amount of revenue of the Fund for subsidies under this Regulation is reduced for the calendar years 2011 to 2013, the subsidy rates under this Regulation shall be reduced by the percentage by which the total amount of the Fund's budget has been reduced compared to the previous calendar year. ';
23. In the title of Annex No 1, the words "training courses' are replaced by the words" practical courses, seminars and lectures'.
24. In Annex 1, Part A, the word "educational 'is replaced by" practical'.
25. In Annex 1, Part B, "training courses' is replaced by" seminars'.
26. In Annex 1, Part C, points 1 and 2 read:
"1. Beekeeping in the Czech Republic and the European Union.
2. Issue of medium and large apiculture enterprises. '
27. In Annex 2, Part In point 6, "space 'is replaced by" equipment'.
28. In Annex 2, Part In point 9, "space 'is replaced by" space technological equipment';
29. In Annex No 2, Part A, the following points 12 to 14 are added:
'12. Equipment for the extraction of wax (fluxes, wax cookers, press on divisions).
13. Equipment for getting pollen.
14. Aids used to diagnose varroasis (varroadna, monitoring pads). "
30. Part B of Annex No 2 reads:

„Část B:

List of products for the prevention or treatment of varroasis for which a subsidy may be granted under the varroasis measures
1. VARIDOL 125 mg / ml (solution for treatment of bees and fumigation tapes).
2. MP 10 FUM (a solution to treat hives by fumigation).
3. M-1 AER 240 mg / ml (concentrate for solution for treatment of bees).
4. GABON PA 1.5 mg (hive strips).
5. GABON PF 90 mg (hive strips).
6. FORMIDOL 40 ml (hives).
7. Other means of application decided by the authority responsible for veterinary care. '
31. Part D of Annex No 2 reads as follows:

„Část D

: Types of new nomadic devices
1. Loading equipment (mechanical, hydraulic and electrical lifting equipment).
2. Trailers (specialized trailers to move hives).
3. Pallets (bases for the location of hives). '
Čl. II
Transitional provision
The grant procedure initiated before and until the date of entry into force of this Regulation shall be completed and the rights and obligations relating thereto shall be assessed in accordance with Government Regulation No 197 / 2005 Coll., as effective by the date of entry into force of this Regulation.
Čl. III
Efficacy
This Regulation shall enter into force on 1 January 2011.
