DECLARATION
of 30 October 2003
concerning veterinary checks on trade in animal products
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., ("the Act ') for the implementation of Sections 28 (5) and 31 (3) (b) and (c) of the Act:
Subject matter
This decree, in accordance with the law of the European Communities (1), regulates:
(a) the procedure for carrying out veterinary checks on animal products intended for trade at the place of origin and on arrival at the place of destination;
(b) the interaction and assistance of persons acquiring, producing, processing, treating, packaging, storing, transporting and putting into circulation animal products (hereinafter referred to as "handling animal products") provided to the veterinary inspection authorities referred to in (a);
(c) details of the measures taken by the authorities carrying out the veterinary checks referred to in point (a) on the basis of the finding that the conditions laid down for trade are not fulfilled, as well as the procedure in the event of a dispute between the person handling the animal products and the authorities carrying out the veterinary checks on arrival at destination in connection with those measures;
(d) the period within which the health certificate accompanying the animal products intended for trade, the particulars and the period of validity of that certificate may be requested, as and on the basis of which it is issued.
Definition of terms
For the purposes of this decree:
(a) veterinary checks - any physical check or administrative action concerning animal products intended to protect human or animal health directly or indirectly;
(b) undertaking - any undertaking or other establishment in which animal products are treated;
(c) the competent authority - the central authority of a Member State of the European Union (hereinafter referred to as the "Member State") authorised to carry out veterinary checks or another authority of the Member State to which that competence has been conferred;
(d) trade - trade between Member States in animal products originating in the Member States as well as in animal products originating in third countries which are in free circulation in the Member States.
Animal products subject to the specific legislation referred to in Annex 3 to this Regulation and intended for trading shall be subject to veterinary checks at the place of origin and veterinary checks at the time of arrival at destination.
Veterinary inspection at the place of origin
(1) In the performance of state veterinary supervision in accordance with § 52 of the Act, the Regional Veterinary Administration and the Municipal Veterinary Administration in Prague in the territory of the capital city of Prague (hereinafter the "Regional Veterinary Administration") shall carry out veterinary checks at the place of origin, in particular to determine whether animal products intended for trade:
(a) have been obtained, checked, labelled and labelled in accordance with the conditions laid down by the specific legislation listed in Part A of Annex 3 to this Regulation and having regard to its destination,
(b) comply with the conditions laid down in the specific legislation referred to in Part A of Annex 3 to this Regulation or, where applicable, with the animal products listed in Part B of Annex 3 thereto, the conditions of the Member State of destination,
(c) bear the original of the health certificate drawn up by the official veterinarian and / or other documents required by the specific provisions laid down in Part A of Annex 3 to this Regulation or, where appropriate, in respect of the animal products listed in Part B of Annex 3 to this Regulation, the legislation of the Member State of destination to accompany them to the final consignee.
(2) Persons handling animal products shall also ensure that the animal products intended for trade comply with the requirements laid down in paragraph 1 of Section 22 (1) (e) of the Act when carrying out their own checks on the hygiene conditions of production.
(3) In the context of carrying out veterinary checks at the place of origin, the Regional Veterinary Administration shall carry out veterinary checks on holdings in order to determine whether the animal products intended for trade comply with the requirements referred to in paragraph 1 or, where appropriate, with the cases referred to in § 5 (3), with the requirements of the Member State of destination. If it finds reasons for suspecting that this is not the case, it shall carry out further necessary veterinary checks and, if the suspicion is confirmed, issue appropriate binding guidelines in accordance with the law or declare emergency veterinary measures; These measures may include the suspension or withdrawal of approval of an undertaking [Paragraph 22 (1) (a) of the Law].
(1) Where transport involves several destinations, the animal products must be grouped into as many lots as the destination is. Each lot shall be accompanied by a health certificate or other document referred to in Section 4 (1) (c).
(2) Where animal products are intended for export to a country which is not a Member State ("third country '), their transport shall remain under customs control until the point of exit from the territory of the Member States (" Community territory').
(3) Where imports of animal products to the Czech Republic are made from a third country with which import conditions are not fully harmonised (so-called non-standard imports), the State Veterinary Administration shall inform the Commission of the European Community ("the Commission ') and the Member States thereof. Where animal products so imported into the Czech Republic are introduced into the territory of the Community by a Member State other than the Czech Republic, the inspection of the proofs of origin and destination of the products shall be carried out in that State in the manner referred to in Section 9 (1). Trade in such imported animal products (reexpeditions of such products) is only possible if they are destined to another Member State which also benefits from the possibility of such imports.
(1) When carrying out veterinary checks at the place of origin, the Regional Veterinary Administration shall establish whether persons handling animal products comply with the animal health requirements for the animal products in question at all stages of the treatment of those animal products. It shall in particular monitor whether the animal products:
(a) obtained in accordance with the specific provisions referred to in Part And Annex 3 to this decree is always checked in the same way from a veterinary point of view, regardless of whether it is intended for trading or for the domestic market,
(b) listed in Part B of Annex 3 to this Decree are not dispatched to the territory of another Member State if they cannot be used commercially in the territory of the Czech Republic.
(2) Where a breach of specific legislation has been detected, in particular where a non-compliance of the health certificate or other document with the actual state of animal products has been established, or where it has been found that the health mark has been affixed to animal products not complying with those rules, the penalties provided for by law are applied.
Veterinary check on arrival at destination
(1) In the exercise of state veterinary supervision in accordance with § 52 of the Act, the Regional Veterinary Administration may carry out veterinary checks on arrival at the place of destination. In particular, non-discriminatory random veterinary checks may verify that the requirements of Sections 4 and 5 are met; where necessary, it may take samples for laboratory examination. In addition, it may also carry out veterinary checks during the transport of animal products to the Czech Republic, including checks on means of transport, if it has evidence suggesting that there is a breach of animal health conditions of trade in animal products.
(2) Where animal products originating in another Member State are intended:
(a) for an undertaking under national veterinary supervision, the official veterinarian carrying out this surveillance must ensure that only animal products are accepted into that undertaking by its operator, the marking and accompanying documents of which comply with the requirements laid down in Section 4 or, where appropriate, in respect of the animal products listed in Part B of Annex 3 to this Regulation, only animal products accompanied by the document required by the legislation of the Czech Republic as the Member State of destination;
(b) to a registered intermediary or trader who divides lots of animal products or to a commercial undertaking with several branches or other undertaking not under national veterinary supervision, that intermediary, trader or operator of an undertaking must check the designation of the animal products and their accompanying documents in accordance with point (a) prior to or through the distribution of the animal products and any misconduct or deviation thereof, and notify the Regional Veterinary Administration,
(c) to another consignee, in particular in the case of partial unloading of animal products during transport, the lots of animal products must be accompanied by the original health certificate referred to in Article 4 (1) (c).
(3) The specific animal health guarantees required for the recipients of the animal products referred to in points (b) and (c) of paragraph 2 must be agreed in an agreement concluded by those beneficiaries with the Regional Veterinary Administration at the time of their registration. the regional veterinary administration shall carry out random veterinary checks on compliance with these guarantees.
(4) Where the provisions of the European Communities do not lay down the conditions for the animal products of the species concerned, or in respect of the animal products listed in Part B of Annex No 3 to this Regulation and the trade in which they are subject to veterinary checks under this Decree, the Czech Republic may, as the Member State of destination, require the undertaking of origin to comply with the conditions in force in the Czech Republic and verify that the relevant animal products comply with those conditions. This is also the case in reverse if required by another Member State which is the Member State of destination.
Beneficiaries who have animal products delivered to them from another Member State or who ensure full distribution of lots of such products in accordance with § 30 (3) (a) and (c) of the Act
(a) notify, in accordance with the requirements of the Regional Veterinary Administration and to the extent necessary to carry out the veterinary checks referred to in Article 7, the arrival of animal products from another Member State;
(b) keep records of the supply of animal products from another Member State;
(c) keep the health certificate and other documents referred to in Article 4 (1) (c) for at least 1 year and submit them on request to the national veterinary authorities.
(1) For veterinary checks carried out at the places where the animal products referred to in Article 3 may come from third countries in the Community, such as ports, airports and border veterinary inspection points,
(a) the proof of origin of the animal products shall be checked;
(b) the procedure is followed by:
1. originating in the Community shall be subject to the rules of veterinary control laid down in Sections 7 and 8,
2. third countries shall be subject to the rules laid down in specific legislation.2)
(2) However, all animal products transported by means of means of transport which ensure a regular and direct link between two geographical points within the territory of the Community shall be subject to the veterinary control rules laid down in Sections 7 and 8.
Measures based on the outcome of veterinary checks
(1) Where the Regional Veterinary Administration finds, when carrying out veterinary checks on arrival at the place of destination or during the transport of the consignment, the presence of the disease agents listed in Annex 1 to the Act, the disease communicable from animals to humans or other diseases, or any other possible cause of a serious threat to animal or public health, or that the animal products come from an infected area, it shall proceed in accordance with Articles 30 (2), 49 (1) (d) and 54 (1) of the Act. In accordance with Section 48 (1) (o) (2) of the Act, the State Veterinary Administration shall inform the Commission and the Member States without delay of the results of the investigation, the decisions taken and the reasons therefor.
(2) If the Regional Veterinary Administration finds, when carrying out veterinary checks on arrival at the place of destination, or during the transport of the consignment, that the animal products do not comply with the animal health conditions of trade applicable in accordance with the specific legislation, or, in the case referred to in § 7 (4), the conditions in force in the Czech Republic, it shall proceed in accordance with § 30 (2) or, as the case may be, with § 49 (1) (d) and § 54 (1) of the Act.
(3) If there is a dispute between the consignor and the Regional Veterinary Administration, both Parties may agree to submit it within a maximum period of 1 month to the expert referred to in the list drawn up by the Commission. The expert shall deliver his opinion within 72 hours of the submission of the dispute or upon receipt of the results of the necessary examination. The costs of this opinion are borne by the European Communities.
(1) Where the case referred to in Article 10 (1) or (2) is concerned, the State Veterinary Administration shall immediately inform the competent authority of the Member State of dispatch thereof, informing it of the results of its investigation, the measures taken and the reasons therefor. If these measures are not considered sufficient by the State Veterinary Administration, they shall be the subject of joint negotiation on the means of redress; they may include on-the-spot veterinary checks.
(2) The State Veterinary Administration shall inform the Commission and the Member States of the repeated errors in accordance with Section 48 (1) (o) (2) of the Act.
(3) The State Veterinary Administration may request the Member State of dispatch to reinforce veterinary checks on animal products originating in the undertaking concerned during the Commission's investigation and to require serious animal or public health reasons to suspend or withdraw the approval of the undertaking concerned. At the same time, veterinary checks on animal products originating from that undertaking may be strengthened upon arrival at the place of destination.
(4) Where the Czech Republic is the Member State of dispatch, paragraphs 1 to 3 shall apply mutatis mutandis.
(1) Where a disease is present in the territory of the Czech Republic which is not subject to compulsory notification under the law and implementing legislation to the law, (3) any disease communicable from animals to humans or other diseases, or any other possible cause of a serious threat to animal or human health,
(a) the State Veterinary Administration shall notify the Commission and the Member States without delay,
(b) the competent veterinary authority shall declare or order appropriate emergency veterinary measures in accordance with the law and implementing legislation3 and the State veterinary administration shall inform the Commission and the Member States of the measures taken.
(2) If the presence of the disease, other disease or other cause referred to in paragraph 1 is detected during the veterinary check on arrival at the place of destination,
(a) the competent authority of the veterinary administration may, in accordance with the law and implementing legislation to the law, (3) if it considers it necessary, declare or order appropriate emergency veterinary measures;
(b) The State Veterinary Administration shall notify the Commission and the Member States without delay of the measures taken and of the reasons therefor.
(3) In the case referred to in paragraph 1, the State Veterinary Administration may request the Commission to send one or more representatives to satisfy themselves on the spot of the measures taken and to give an opinion on them.
Common and final provisions
(1) State Veterinary Administration in accordance with § 48 (1) (o) (2) of the Act
(a) notify the Commission and the Member States of the conditions and procedures they apply in the trade in animal products listed in Part B of Annex 3 to this Regulation and of the trade in which they are subject to veterinary checks under this Regulation;
(b) submit to the Commission the information required for veterinary checks carried out under this Decree;
(c) communicate to the Commission and the competent authorities of the Member States, on the basis of their reasoned request for cooperation and assistance, whether the legislation in its field of competence is complied with, whether and what measures have been taken to ensure compliance with the obligations and requirements laid down by that legislation, to the extent and in a manner specified by the European Community Regulation (3a).
(2) The information referred to in paragraph 1 (b) shall be submitted:
(a) for each calendar year, no later than 1 May of the year following that in which the checks were carried out;
(b) by sector of activity listed in Annex 1 thereto,
(c) in electronic form in accordance with the model set out in Annex 2 to this Regulation.
(1) If the animal products are to be accompanied by the health certificate referred to in Article 4 (1) (c), they shall be drawn up by an official veterinarian following an inspection (examination) of the animal products using a form issued by the State Veterinary Administration in accordance with the model health certificate for the animal products of the species concerned laid down by the provisions of the European Communities. This certificate must be drawn up in at least one of the official languages of the Member State of dispatch (origin) and at least one of the official languages of the Member State of destination on a single sheet; However, where this is not possible and the certificate is made out on several sheets, such sheets shall be suitably joined and labelled to form an indivisible whole. The health certificate shall be for one consignee.
(2) The health certificate shall bear the stamp and signature of the official veterinarian in a colour different from that of the other text and the reference number.
(3) In the absence of specific legislation, (4) or regional veterinary administration, taking into account in particular the type of animal products, the manner and duration of their transport, the health certificate shall be valid for 10 days from the date of issue. If, in accordance with Article 49 (1) (l) of the Act, the Regional Veterinary Administration determines a different period of validity of the health certificate, it shall indicate it in that certificate.
(4) The issue of the health certificate referred to in Article 4 (1) (c) must be requested within a period of at least:
(a) 14 days before the date of intended dispatch of the animal products, if they are products to be examined for laboratory testing;
(b) 2 working days before the date of their intended dispatch in other cases.
Efficacy
This decree shall take effect on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.

SPECIFIC LEGISLATION RELATING TO ANIMAL PRODUCTS SUBJECT TO THE TRADE OF VETERINARY CHECKS REFERRED TO IN THIS STATEMENT
1. Act No. 166 / 1999 Coll., on veterinary care and amending certain related laws (Veterinary Act), as amended, Decree No. 201 / 2003 Coll., on animal health requirements for fresh poultrymeat, rabbit meat, farmed game meat and wild game meat, as amended, Decree No. 202 / 2003 Coll., on animal health requirements for fresh meat, minced meat, meat preparations and meat products, as amended, and Decree No. 203 / 2003 Coll., on animal health requirements for milk and milk products, as amended, as transposed by Council Directive 2002 / 99 / EC of 16 December 2002 laying down animal health rules for the production, processing, distribution and importation of products of animal origin intended for human consumption.
2. Regulation (EC) No 853 / 2004 of the European Parliament and of the Council of 29 April 2004 laying down specific hygiene rules for food of animal origin, as amended.
3. Decree No 379 / 2003 Coll., laying down animal health requirements governing trade in and imports into the Community of animal products not subject to specific legislation and the animal health conditions governing their importation from third countries in which Council Directive 92 / 118 / EEC of 17 December 1992 laying down animal health and veterinary requirements governing trade in and imports into the Community of products not subject to specific Community rules referred to in Chapter I of Annex A to Directive 89 / 662 / EEC is transposed and, as regards pathogens, to Directive 90 / 425 / EEC.

Other animal products not covered by the specific legislation referred to in Part And neither this Annex nor Annex 3 to Decree No 372 / 2003 Coll., concerning veterinary checks on trade in animals, which have been determined in accordance with the procedure laid down by the European Commission.
1) Council Directive 89 / 662 / EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market. Council Directive 92 / 67 / EEC of 14 July 1992 amending Directive 89 / 662 / EEC concerning veterinary checks in intra-Community trade with a view to the completion of the internal market. Council Directive 96 / 93 / EC of 17 December 1996 on certificates for animals and animal products. Directive 2004 / 41 / EC of the European Parliament and of the Council of 21 April 2004 repealing certain Directives concerning food hygiene and the health conditions of production of certain products of animal origin intended for human consumption and repealing Council Directives 89 / 662 / EEC and 92 / 118 / EEC and Council Decision 95 / 408 / EC.
