Federal Ministry of Foreign Affairs
The Federal Ministry of Foreign Affairs stated that on 13 September 1990, the Federal Assembly agreed on the access of the Czech and Slovak Federal Republic to the Agreement on the International Monetary Fund negotiated in Washington on 22 July 1944, the Agreement on the International Bank for Reconstruction and Development negotiated in Washington on 22 July 1944, the Agreement on the International Financial Corporation negotiated in Washington on 25 May 1955, the Agreement on the Multilateral Investment Guarantee Agency negotiated in Washington on 11 October 1985 and the Agreement on the International Development Association negotiated in Washington on 26 January 1960, as amended.
Those agreements were ratified on 13 September 1990 by the President of the Republic.
DECISION
President of the Czech and Slovak Federal Republic
of 14 September 1990
on the access of the Czech and Slovak Federal Republic to the Agreement on the International Monetary Fund, negotiated in Washington on 22 July 1944, to the Agreement on the International Bank for Reconstruction and Development, negotiated in Washington on 22 July 1944, to the Agreement on the International Financial Corporation, negotiated in Washington on 25 May 1955, to the Agreement on the Multilateral Investment Guarantee Agency, negotiated in Washington on 11 October 1985, and to the Agreement on the International Development Association, negotiated in Washington on 26 January 1960
Since, on the proposal of the Government of the Czech and Slovak Federal Republic of the Federal Assembly of the Czech and Slovak Federal Republic on 13 September 1990, it agreed to the Agreement on the International Monetary Fund, including participation in the Special Drawing Rights Board and the Agreement on the International Bank for Reconstruction and Development, the International Financial Corporation, the Multilateral Investment Guarantee Agency and the International Association for Development, which I ratified on 13 September 1990 and I adopted the terms and conditions of the resolutions of the relevant governors of those organisations issued in connection with the membership of the Czech and Slovak Federal Republic in these organisations, I issue, by virtue of the provisions of Article 61 (1) (a) of the Constitutional Act No. 143 / 1968 Coll., on the Czechoslovak Federation, as amended by this
decision
1. I empower the Minister of Finance of the CSFR to sign the agreements on the International Monetary Fund, the International Bank for Reconstruction and Development, the International Financial Corporation, the Multilateral Investment Guarantee Agency and the International Development Association, as amended, and to deposit the instruments of access to these agreements, as well as the other instruments that may be required in this context.

a) Ministry of Finance of the Czech and Slovak Federal Republic
- is a financial institution and an information point for the above mentioned organisations authorised to negotiate on behalf of the Czech and Slovak Federal Republic all transactions and transactions under the above agreements,
- is entitled to negotiate on behalf of the Czech and Slovak Federal Republic all operations, including the acceptance of any amounts which may be paid or transferred to the Czech and Slovak Federal Republic in such operations and transactions,
(b) Czechoslovak State Bank
- is the storage place for the funds of the above mentioned organisations in Czechoslovak currency.
3. I empower the President of the Czechoslovak State Bank to
- make all payments with the above mentioned organisations, provide loans or otherwise provide the means to secure payments resulting from the obligations of the Czech and Slovak Federal Republic to those organisations,
- issue non-transferable and non-interest-bearing bonds where necessary or necessary for membership of the Czech and Slovak Federal Republic in the above mentioned organisations,
- has made payments in connection with the membership of the Czech and Slovak Federal Republic in the International Monetary Fund Special Drawing Rights Board.
4. The Government of the Czech and Slovak Federal Republic appointed the Governor of the Czech and Slovak Federal Republic in the International Monetary Fund as Chairman of the Czechoslovak State Bank and Governor in the International Bank for Reconstruction and Development and in the Multilateral Agency for Investment Guarantees of the Minister of Finance of the Czech and Slovak Federal Republic. At the same time, the Government of the Czech and Slovak Federal Republic has appointed the Governor of the International Monetary Fund, the Minister of Finance of the Czech and Slovak Federal Republic, and the Governor of the International Bank for Reconstruction and Development and the Multilateral Investment Guarantee Agency of the President of the Czechoslovak Bank.
These agreements are fully effective on the territory of the Czech and Slovak Federal Republic from the date of their signature and the deposit of relevant access documents.
The Czech and Slovak Federal Republic shall take all necessary steps to enable it to fulfil all its obligations under agreements and resolutions in connection with membership in the above mentioned organisations.
This Decision shall take effect on the date of its signature.
