GOVERNMENT REGULATION
of 1 December 2010
amending Government Regulation No 75 / 2007 Coll., on the conditions for granting payments for natural handicaps in mountain areas, areas with other handicaps and Natura 2000 areas on agricultural land, as amended
The Government mandates pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll. and Act No. 291 / 2009 Coll., to implement § 2c (2) (a) of the Act, and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:

Government Decree No. 75 / 2007 Coll., on the conditions for granting payments for natural handicaps in mountain areas, areas with other handicaps and in Natura 2000 areas on agricultural land, as amended by Government Decree No. 113 / 2008 Coll., Government Decree No. 83 / 2009 Coll., Government Decree No. 480 / 2009 Coll. and Government Decree No. 111 / 2010 Coll., are amended as follows:
1. in Articles 1, 6 (5), 9 (6) and 12 (6), the words "the European Communities" shall be replaced by the words "the European Union."
2. The sentence "Commission Regulation (EC) No 1122 / 2009 of 30 November 2009 laying down detailed rules for the application of Council Regulation (EC) No 73 / 2009 as regards cross-compliance, modulation and the integrated administration and control system under the direct support schemes for farmers provided for in that Regulation and Council Regulation (EC) No 1234 / 2007 as regards cross-compliance under the direct support scheme for the wine sector, as amended, is added to footnote 2. '.
3. In Article 2 (1), the comma at the end of point (e) is replaced by a dot and point (f) is deleted.
4. in Article 5 (2) (a), point 6 shall be deleted;
5. Paragraph 6 (3) is deleted.
Paragraphs 4 to 7 shall be renumbered paragraphs 3 to 6.
6. In Article 6 (4), "paragraph 4 'is replaced by" paragraph 3';
7. In Section 9 (6) of the introductory part of the provision, the words "Section 6 (4) 'are replaced by the words" Section 6 (3)'.
8. In Annex 1, the following entries are deleted:

Čl. II
Transitional provisions
1. The procedure for applications submitted pursuant to Government Regulation No 75 / 2007 Coll., as effective until the date of entry into force of this Regulation by a Government which has not been definitively terminated before the entry into force of this Government Regulation, shall be completed in accordance with existing legislation.
2. Paragraph 12 (1) of Decree No 75 / 2007 Coll., as effective until the date of entry into force of this Regulation, shall not apply to a legal or natural person,
(a) if, in calendar year 2011, it is in breach of a written undertaking pursuant to Article 6 (1) (b) (1) of Government Regulation No 75 / 2007 Coll., as effective until the date of entry into force of this Regulation, as a result of the exclusion of municipalities, their cadastral territories or, where applicable, the cadastral territories of parts of municipalities from Annex 1 to Government Regulation No 75 / 2007 Coll., as effective until the date of entry into force of this Regulation; and
(b) if they operate on soil blocks or parts thereof in a less favourable area as defined by Government Decree No. 75 / 2007 Coll., as effective until the date of entry into force of this Regulation, at least 1 hectare of grassland agricultural land registered in the land register for that legal or natural person.
Čl. III
Efficacy
This Regulation shall enter into force on 1 January 2011.
