laying down technical solutions by which a genetically modified organism may be created and technical solutions which do not lead to the creation of a genetically modified organism
The Ministry of the Environment, in agreement with the Ministry of Health and the Ministry of Agriculture, provides pursuant to Section 24 (a) of Act No. 153 / 2000 Coll., on the Management of Genetically Modified Organisms and Products and on the amendment of certain related laws:
§ 1
Genetically modified organisms may occur when used
(a) recombinant nucleic acid techniques which create new combinations of hereditary material by inserting a nucleic acid section prepared in any way outside the organism into any virus, bacterial plasmid or other vector system and subsequently integrating it into the body of the recipient in which it is not normally present but in which it is able to reproduce further;
(b) techniques introducing hereditary material prepared in any way outside the body directly into the recipient's body, including micro-injections, macroinjections, biolistic methods, microencapsulation and artificial chromosomes; or
(c) the techniques of cellular fusion (including fusion of protoplasts) or hybridization of cells in which viable cells with a new combination of hereditary material are produced by fusion of two or more cells by means of methods or means which do not occur naturally.
§ 2
(1) The following technical solutions may not lead to the formation of genetically modified organisms unless they are involved in recombinant genetic material (deoxyribonucleic or ribonucleic acid) or genetically modified organisms arising from the application of the techniques referred to in § 1,
(a) in vitro fertilisation;
(b) bacterial conjugation, transformation, transformation and similar natural processes;
(c) induction of polyploidy and haploidy;
(d) mutagenesis; or
(e) crossing.
(2) For the purposes of the contained use, the following technical solutions may not lead to the development of a genetically modified organism unless they are involved in recombinant hereditary material (deoxyribonucleic or ribonucleic acid) or genetically modified organisms arising from the use of the techniques referred to in § 1,
(a) fusion of cells or protoplastics of prokaryonic organisms which may exchange hereditary material through known physiological processes; or
(b) the fusion of cells or protoplasts of eukaryonic organisms, including the formation of hybrids and the fusion of plant cells.
(3) Furthermore, for the purposes of the introduction into the environment of a genetically modified organism, the technique of fusion of plant cells or protoplastics may not lead to the formation of a genetically modified organism if the resulting organism can also be obtained by traditional breeding methods, unless it is involved in recombinant genetic material (deoxyribonucleic or ribonucleic acid) or genetically modified organisms arising from the use of the technical solutions referred to in § 1.
§ 3
This decree shall take effect on 1 January 2001.
