DECLARATION
of 3 December 2024
amending Decree No 79 / 2022 Coll., on technical and economic parameters for the determination of reference ransom prices and green bonuses and implementing certain other provisions of the Act on Supported Energy Sources (Technical and Economic Parameters), as amended by Decree No 275 / 2023 Coll.
According to Article 53 (2) (a), (b) and (l) of Act No. 165 / 2012 Coll., on Supported Energy Sources and on the Amendment of Certain Acts, as amended by Act No. 131 / 2015 Coll. and Act No. 382 / 2021 Coll.:
Decree No. 79 / 2022 Coll., on Technical and Economic Parameters for the Determination of Reference Ranking Prices and Green Bonus and on the implementation of certain other provisions of the Act on Supported Energy Sources (Technical and Economic Parameters Order), as amended by Decree No. 275 / 2023 Coll., is amended as follows:
1. In Section 4, "6,12 'is replaced by" 6,21';
2. In Annex 1, Table 1, including the title, reads:

"Annex No 3
Method of creating equivalent heat price to determine the maintenance support of heat using geothermal energy
The equivalent heat price is derived from the reference price of heat produced in a natural gas boiler with an installed output of 1 MWt. The price is determined as the sum of fuel costs, operating costs, investment costs and reasonable profit according to the formula
ECTE = ZPcenaηPK3.6 + OÚ + INVPKDZ * RVT + INVPK * ROARVT
where
ECTE [CZK / GJ] is the equivalent price of heat,
Paid [CZK / MWh] is the price of natural gas (in calorific value) according to the formula
Priced = price-regulated + commodity price,
where
the price-regulated [CZK / MWh] is the price of the related gas service determined from the average prices of the distribution system service of regional distribution system operators, which includes the price for the activities of the market operator including the fee for the activities of the Office; the prices of the distribution system service are determined in accordance with the price ratio of the regulated gas supply prices of the Authority in the year in which the maintenance heat support is determined;
the price of the commodities [CZK / MWh] is the arithmetic average of the available final prices (settlement price) of EEX-THE Cal-YY for the period January to June of the calendar year in which the maintenance heat support is determined, plus EUR 4 / MWh to take into account the reasonable sales costs of the trader,
η PK [-] is the reference efficiency of a natural gas boiler, determined in accordance with the directly applicable European Union Regulation, reviewing the harmonised efficiency reference values for the separate production of electricity and heat 2), of 0,92,
OÚ [CZK / GJ] are the costs of repair and maintenance of the boiler in the amount of 16 CZK / GJ,
INVPK [CZK] is the reference value of the investment in the gas boiler in the amount of CZK 5 500 000,
DJ [years] is the life of the boiler set for 15 years,
RVT [GJ] is the annual heat production of the boiler of 11 880 GJ,
ROA [-] is the rate of return determined according to the Office's price scale for thermal energy prices effective in the year in which the maintenance heat support is determined.
(2) Commission Delegated Regulation (EU) 2015 / 2402 of 12 October 2015 reviewing harmonised efficiency reference values for separate generation of electricity and heat in application of Directive 2012 / 27 / EU of the European Parliament and of the Council and repealing Commission Implementing Decision 2011 / 877 / EU, as amended. ';
Transitional provision
For electricity, heat and biomethane plants put into service or upgraded from 1 January 2024 to 31 December 2024, the technical and economic parameters referred to in Decree No 79 / 2022 Coll., as effective before the date of entry into force of this Decree, shall apply.
Efficacy
This Decree shall take effect on 1 January 2025.
