GOVERNMENT REGULATION
of 19 December 2007
amending Government Regulation No. 133 / 2005 Coll., on technical requirements for the operational and technical interconnection of the European rail system
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Laws ("the Act '), as amended by Act No. 71 / 2000 Coll. and Act No. 205 / 2002 Coll., to implement Sections 12 paragraphs 1 and 3 and Article 13 paragraph 6 of the Act:
Government Regulation No. 133 / 2005 Coll., on technical requirements for the operational and technical interconnection of the European rail system, is amended as follows:
1. footnote 2 shall read:
"(2) Articles 2, 4, 8 to 16, 18 and 20 of Directive 2001 / 16 / EC of the European Parliament and of the Council of 19 March 2001 on the interoperability of the conventional rail system, as amended by Directive 2004 / 50 / EC of the European Parliament and of the Council. Commission Directive 2007 / 32 / EC of 1 June 2007 amending Annex VI to Council Directive 96 / 48 / EC on the interoperability of the trans-European high-speed rail system and Annex VI to Directive 2001 / 16 / EC of the European Parliament and of the Council on the interoperability of the trans-European conventional rail system. ';
2. In the second sentence of Article 6 (1), the words "or its authorised representative 'shall be inserted after the words" subsystem operator'.
3. The following Section 6a is inserted after Section 6:
(1) The subsystem operator, the subsystem manufacturer or their authorised representative may, at the design stage or at the production stage, request the notified person to issue a provisional opinion on the examination of the subsystem type or provisional opinion on the verification of the subsystem if the subsystem can be tested on the test equipment before the subsystem is put into service.
(2) The Notified Person shall carry out a conformity assessment of the subsystem for those subsystem elements whose characteristics can be verified at a given stage on the test equipment before the subsystem is put into service. When drawing up the provisional opinion on the examination of the subsystem type or the provisional opinion on the verification of the subsystem, the notified person shall assess the subsystem project, its compliance during production and the quality of his own production on the basis of the results of the tests carried out on the test equipment. The preliminary conformity assessment of the subsystem shall be carried out in accordance with Annex 2 to this Regulation.
(3) The subsystem operator or his authorised representative shall, on the basis of a provisional opinion issued on the examination of the subsystem type or an interim opinion on the verification of the EC subsystem, issue a declaration of provisional verification of the subsystem which shall be forwarded to the Dresden Office for registration. ';
4. In Annex No 2, Part I, point 3:
"3. CERTIFICATE
When issuing a certificate of review of the subsystem type and a certificate of verification of the subsystem issued by an interim opinion on the review of the subsystem type or an interim opinion on the verification of the subsystem, the person shall take into account:
(a) for the verified subsystem, a provisional opinion was issued at the design or production stage;
(b) the production of the subsystem corresponds to a proposal for which an interim opinion has been delivered, if the opinion has not been issued at the stage of manufacture,
(c) the other elements of design and production which have not been the subject of an assessment in the context of the provisional opinion at the design or production stage comply with the technical specifications of interoperability. "
5. In Annex No 2, Part I, at the end of point 4, the dot is replaced by a comma and the following point (f) is added:
"(f) the interim opinions on the review of the subsystem type or the interim opinion on the verification of the subsystem, where available, including the EC declaration of interim verification of the subsystem and the results of the check on their validity by the notified person.";
6. In Annex No 2, Part I, at the end of point 7, the dot is replaced by a comma and the following points (d) and (e) are added:
"(d) provisional opinions on the verification of the subsystem issued,
(e) rejected applications for provisional opinions on verification of the subsystem.
7. In Annex No 2, Part II, first sentence, the words "Type examination certificate and subsystem verification certificate 'are replaced by the words" subsystem type review certificate and subsystem verification certificate, provisional opinion on subsystem type verification and provisional opinion on subsystem verification'.
This Regulation shall enter into force on 1 January 2008.
