THE LAW
Czech National Council
of 6 September 1990
on the salaries and allowances of Members of the Czech National Council
The Czech National Council decided on this law:

Members of the Czech National Council (hereinafter referred to as "the Member") are entitled to a parliamentary salary (hereinafter referred to as "the salary") of CZK 16100 per month, starting on the first day of the month in which he took the constitutional oath. He still holds his salary three months after the end of his parliamentary mandate.
FUNCTION ADJUSTMENTS
(1) The President of the Czech National Council has a functional surcharge of CZK 22400 per month in addition to the salary provided for in § 1.
(2) The Vice-President of the Czech National Council, who is the first to represent the President of the Czech National Council, has a functional surcharge of CZK 18600 per month in addition to the salary provided for in § 1.
(3) The Vice-President of the Czech National Council has a functional surcharge of CZK 17400 per month in addition to the salary provided for in § 1.
(1) The chairman of the Czech National Council committee is entitled to a functional surcharge of CZK 6200 per month in addition to the salary provided for in § 1.
(2) The Vice-President of the Committee of the Czech National Council has a functional surcharge of CZK 2500 per month in addition to the salary provided for in § 1.
(3) The secretary of the Committee of the Czech National Council has a functional surcharge of CZK 1250 per month in addition to the salary provided for in § 1.
(4) The President of the Czech National Council, in addition to the salary provided for in § 1, has a functional surcharge of CZK 2500 plus CZK 600 for every 10 members of the club.
(5) The members of the Board of the Bureau of the Czech National Council belong to the same functional surcharge as those of the Committee of the Czech National Council, if the Bureau of the Czech National Council so decides.
(6) The functional surcharge referred to in the preceding paragraphs shall apply to Members as from the first day of the month in which they were elected. The functional allowances provided for in this provision shall not lie with the Member to whom the functional allowances provided for in Article 2 are due.
(1) In the calendar year in which he was actually in office for at least nine months, Members are entitled to an additional salary equal to the monthly parliamentary salary, including a functional supplement (hereinafter referred to as "additional salary").
(2) The next salary is payable together with the month of December. If entitlement to another salary is due only later, the last day of December shall be due.
(3) Members who did not participate in the proceedings of the Czech National Council or its bodies to which he was elected in the calendar year without a proper apology are hereby reduced. Paragraph 8 shall apply mutatis mutandis to the reduction.
TRAVEL REFUNDS
(1) Members are entitled to a monthly flat-rate allowance, according to the distance of their permanent residence from the seat of the Czech National Council, starting on the first day of the month in which they made a constitutional oath.
(2) Members who are resident on the territory of the City of Prague are entitled to the 2000 Kčs diet referred to in paragraph 1.
(3) Members who are resident outside the City of Prague are entitled to a diet of 4000 CZK.
(4) Members shall also be entitled to compensation for accommodation at a proven rate if they are travelling in connection with the performance of the parliamentary function.
(5) Travel refunds for travel to the borders relating to the performance of the parliamentary function are determined by the Bureau of the Czech National Council.
(1) A Member may use public transport facilities free of charge in the Czech Republic.
(2) If, for serious reasons, a Member is unable to use a public vehicle, the Bureau of the Czech National Council may grant him reimbursement of the cost of the journey at a proven level.
(3) Public air transport aircraft may be used free of charge by a Member of the Parliament both there and back
(a) for trips to meetings of the Czech National Council and its bodies; or
(b) for journeys to which he has been entrusted by the Bureau of the Czech National Council or by the President of the Czech National Council; or
(c) for journeys to which the Committee of the Czech National Council or the Committee of the Bureau of the Czech National Council has been entrusted, if the President of the Czech National Council so agrees.
REFUNDS ON OTHER EXPENDITURE
Members shall receive a flat-rate refund of CZK 7000 per month, starting on the first day of the month in which they took the constitutional oath, to cover in-kind expenses and, where applicable, the costs of services required for the performance of their duties.
(1) The President of the Czech National Council shall have the right to use a reasonably equipped apartment free of charge during the term of office.
(2) The Vice-Presidents of the Czech National Council have this right only if they reside outside the seat of the Czech National Council.
(3) The functionalists referred to in paragraphs 1 and 2 are entitled to:
(a) free use of a service vehicle with or without an assigned driver for the performance of its duties or in connection with, and at the disposal of, a person;
(b) free establishment and use of one participating telephone station to ensure immediate availability at any time.
(4) Chairmen of the Czech National Council committees and chairmen of the Czech National Council parliamentary clubs have the right to:
(a) the free use of a service vehicle without an assigned driver for the performance of his duties or in connection with it and to allow contact with the family; the extent to which they are entitled to compensation for fuel consumed in the relevant calendar year shall be determined by an internal regulation of the Czech National Council responsible for the Czech National Council,
(b) free establishment and use of one participating telephone station to ensure immediate availability at any time.
(5) The Member shall have the right to establish a participating telephone station.
COMMON AND FINAL PROVISIONS
(1) If a Member so requests, the employer shall provide him with a job vacation.1) Reimbursement of the employer's salary is not his responsibility.
(2) Members who are in a working or similar relationship are entitled to pay (remuneration) for the work they have done under generally binding legislation.
(3) The working or similar ratio of a Member may be terminated against his will only with the prior agreement of the Bureau of the Czech National Council; This also applies to the 12 months following the expiry of the parliamentary mandate. Otherwise, the termination of an employment or similar relationship shall be void.
For a period when a Member is temporarily not performing his duties, the benefits provided for in Sections 1 to 3, in Section 4 (1), in Section 6 and compensation for fuel consumed pursuant to Section 7 (4) (a) shall be reduced in proportion to that period.
(1) Members are involved in sickness insurance (2) and social security (3) as well as workers in employment.
(2) At the time when the Member does not perform his duties for the disease, he shall be entitled to the salary provided for in Paragraph 1, but for a maximum period of six months, for which period he shall not be entitled to the sickness benefit.
(3) A Member who does not perform her duties on grounds of maternity leave, 3a) shall be entitled to the salary provided for in Paragraph 1; for that period, she shall not be entitled to maternity allowance. Similarly, where Members are entitled to maternity assistance under special rules, they shall proceed. (3b)
(4) Members shall be entitled to child allowances in the amount and under the conditions laid down in the generally binding legislation.4)
(1) Postal salary (§ 1) and functional supplement (§ 2 and 3) are subject to income tax.
(2) Diets and flat-rate compensation (Sections 4 and 6) are not subject to tax.
(3) The benefits referred to in paragraphs 1 and 2 are due on the 15th day of the month for which they belong.
Members are not entitled to claims under this law for as long as they are a member of the Government of the Czech Republic. The same applies if he is acting as Head of the Central Authority of the State Administration, Deputy Minister or Deputy Head of the Central Authority, Officer of the Office of the President of the Czech Republic or official of the Supreme Audit Office of the Czech Republic.
(1) The office of the Czech National Council is responsible for the damage suffered by the Member in the performance of the parliamentary mandate or in direct connection with it, under the labour law. 6)
(2) The Member is responsible to the Office of the Czech National Council for the damage caused to him or her in the performance of the parliamentary mandate or in direct connection with him, under the labour law. 6)
Section 24 to 27 of the Act of the Czech National Council No. 36 / 1989 Coll., on Members of the Czech National Council are repealed.
Members who exercise their office as Members on the date of application of this Act shall be entitled to the rights under this Act from the first day of the month in which the Act became effective.
This Act shall take effect on the day of its publication.
