DECLARATION
of 12 December 2023
amending Decree No. 31 / 2001 Coll., on driving licences and on the register of drivers, as amended
The Ministry of Transport provides, pursuant to Article 137 (2) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended by Act No. 478 / 2001 Coll., Act No. 53 / 2004 Coll., Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 274 / 2008 Coll., Act No. 133 / 2011 Coll., Act No. 297 / 2011 Coll., Act No. 230 / 2014 Coll., Act No. 150 / 2023 Coll., Act No. 249 / 2016 Coll., Act No. 199 / 2017 Coll., Act No. 193 / 2018 Coll., Act No. 103.
Decree No. 31 / 2001 Coll., on driving licences and on the register of drivers, as amended by Decree No. 154 / 2003 Coll., Decree No. 177 / 2004 Coll., Decree No. 194 / 2006 Coll., Decree No. 27 / 2012 Coll., Decree No. 243 / 2012 Coll., Decree No. 1 / 2014 Coll., Decree No. 9 / 2015 Coll., Decree No. 43 / 2015 Coll., Decree No. 75 / 2016 Coll. and Decree No. 456 / 2017 Coll., are amended as follows:
1. Paragraph 10a, including the title, reads:
List of States
The list of States which, on a reciprocal basis, recognise driving licences and groups of vehicles corresponding to groups of vehicles under the Road Traffic Act is set out in Annex 6a to this Decree. '.
2. Paragraph 14 (4) reads as follows:
"(4) Pursuant to paragraphs 2 and 3, the municipal authority of a municipality with extended scope shall not proceed where the expiry of the driving licence or international driving licence is due to the invalidity. ';
3. In Article 17 (2) (g), the words "against road safety and continuity 'are replaced by the words" under the Road Traffic Act'.
4. Paragraph 17 (2) (l) reads as follows:
"(l) data on lost, stolen, damaged or destroyed driving licences and international driving licences and data on issued driving licences for lost, destroyed or unfit driving licences,"
5. in Article 17 (2) (q) and (r):
"(q) records of transport psychological examinations carried out;
(r) particulars of the execution order in execution by suspension of the licence; ';
6. In Article 17, the following points (s) to (z) are added at the end of paragraph 2, including footnote 6:
"(s) data on issued driver's proficiency certificates under another legislation (6) or data on driver's professional competence recorded on the driver's licence;
(t) details of certificates issued for teachers of teaching and training under another legislation (6);
(u) data on participation in regular training of drivers under another legislation (6);
(v) details of the detention of the driving licence;
(w) data on the mentor;
(x) details of the completion of the training of the initial driver and of the transport psychological interview;
(y) details of completion of the therapeutic programme;
(z) the data relating to the request for each change in the score.
6) Act No. 247 / 2000 Coll., on obtaining and improving professional competence to drive motor vehicles and amending certain laws, as amended. '
7. In Article 17 (3) (f), the words "an application for a duplicate of a driving licence or a duplicate of an international driving licence for a driving licence or an international driving licence for a lost, stolen, damaged or destroyed licence and 'are deleted.
8. in Article 17 (3) (h), the words "or subgroups" shall be deleted;
9. In Article 17 (3) (j), the words "against road safety 'are replaced by the words" under the Road Traffic Act'.
10. in Article 17 (3) (l), the words "on-the-spot order" and the words "against the safety and continuity of road traffic imposed by the competent authority in block management" shall be replaced by "under the Road Traffic Act";
11. in Article 17 (3) (m), the word 'penalty' is replaced by 'administrative penalty';
12. in Article 17 (3), point (o) is deleted;
Points (p) to (u) shall be renumbered as points (o) to (t).
13. in Article 17 (3) (p), "5" is replaced by "7."
14. in Article 17 (3) (s) and (t):
"(s) an assessment of the results of the transport psychological examination and a certificate of completion of the therapeutic programme;
(t) a certificate of completion of a transport psychological interview and a certificate of completion of training for starting drivers, ';
15. at the end of paragraph 3, the following points (u) to (y) are added:
'(u) an execution order in execution by suspension of a driving licence;
(v) evidence of participation in regular training of drivers completed under another legislation (6);
(w) the application for registration of the mentor and the documents relating to the revocation of the mentor,
(x) request to send information on any change in the score;
(y) other official records and documents relating to the driver. ';
16. The following Section 17a is inserted after Section 17:
Information about any change in the score can be sent
(a) a short text message to a telephone number registered in the population register; or
(b) to the e-mail address indicated in the population register. ';
17. The following Section 18d is inserted after Paragraph 18c, which includes the title:
Traffic psychological interview
(1) Transport psychological interview consists of an individual part within 30 minutes and a group part within 210 minutes.
(2) The individual part consists in an interview of a psychologist with a participant in a transport psychological interview without the presence of other persons and focuses on the participant's description of the causes and circumstances of the infringement of road traffic rules, for which he is participating in the traffic psychological interview.
(3) The group part consists in an interview of a psychologist with all participants in a transport psychological interview, where the psychologist is based on information obtained from individual participants in individual sections and focuses on providing information on:
(a) psychological and social causes of the most common infringements of road traffic rules and the reasons for the occurrence of accidents;
(b) the specificities of young or starting drivers with regard to their reduced experience in driving, psychological development, tendency to risk and influence the environment and the impact of these aspects on the occurrence of road accidents;
(c) road accidents arising in connection with exceeding the maximum permissible speed, failure to respect the safe distance and the driver's response time;
(d) the use and impact of alcohol and other addictive substances on road accidents;
(e) not to engage in driving and its impact on the occurrence of accidents;
(f) the recommended strategy for preventing risk behaviour in road traffic, preventing traffic accidents and preventing and addressing road emergency situations; and
(g) the consequences of an emergency in road traffic or accident on the driver's personality.
(4) A transport psychological interview shall be conducted with the participation of a participant in the workplace of a psychologist mentioned in the accreditation for carrying out a traffic psychological examination. The individual part may also be performed in a way that allows remote access.
(5) The maximum number of participants in the group part of the transport psychological interview is 12 persons.
(6) The model of the certificate of completion of the transport psychological interview is set out in Annex 12 to this Regulation. "
18. In Annex 4, the word "penalties' is replaced by" administrative penalties'.
19. in Annex 5, Part II. National codes for the words "115. Connector enhancer." insert the words "117" on a separate line. Driving a category B motor vehicle until the age of 18 with only a mentor. '
20. In Annex 5, Part II. National codes with the words "160. Exemptions from the age of category A1, A2 or A of a person holding a licence for a motorist athlete granted only for driving in a sports competition. ';
21. The heading of Annex No 6a reads: "List of States which recognise driving licences on a reciprocal basis and groups of vehicles which correspond to groups of vehicles under the Road Traffic Act."
22. in Annex 6a, Tables 1 and 2, "§ 81" is replaced by "§ 80a."
23. Table 3 is added at the end of Annex 6a, including the title:

Transitional provision
The forms of applications for a driving licence and the forms of applications for a driving licence provided for in Decree No. 31 / 2001 Coll., as effective before the date of entry into force of this Order, may be used until their stocks are exhausted, but no later than 30 June 2024.
Efficacy
This Decree shall take effect on 1 January 2024.
