THE LAW
of 19 October 2016
amending Act No. 13 / 1997 Coll., on roads, as amended
Parliament has decided on this law of the Czech Republic:

1. Paragraph 36 (4) reads as follows:
"(4) In the built-up territory of the municipality, the lines may be located on a longitudinal basis, except in the cases referred to in paragraph 3 and under the conditions referred to in this paragraph, in the pavements and in the adjacent green belts of the transit section of the road or in local communication with the greatest possible respect for vegetation. In cases where the possibility of another technical solution is excluded, the lines may also be located on the roads of these infrastructures. '
2. In Paragraph 40 (1), the words "the Regional Office and the Regional Office of the Municipality with extended scope 'are replaced by the words" the Regional Office, the Municipal Office of the Municipality with extended competence and the Municipal Office'.
3. In Paragraph 40 (4), at the end of the text in point (a), the words "and the competence of a special construction office in local communications matters' shall be added.
4. Paragraph 40 (5) reads:
"(5) Municipal Office
(a) decide on the classification of infrastructure as a local road category and the exclusion of local road from that category;
(b) exercise the competence of the Road Administration Office in local communications matters, with the exception of those decided by the municipal authority of the municipality with extended competence. "
5. § 44a reads:
The powers laid down by the Regional Office, the Municipal Office of the Municipality with extended competence or the Municipal Office under this Act are the exercise of the delegation. '
Transitional provision
Proceedings initiated prior to the date of the entry into force of this Act and until that date, shall be completed and the rights and obligations relating thereto shall be assessed in accordance with Act No. 13 / 1997 Coll., as effective in advance of the entry into force of this Act.
Efficacy
This Act shall take effect 30 days after its publication.
