amending Act No 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended
Parliament has decided on this law of the Czech Republic:
Čl. I

„§ 78
Common part of the graduation exam
(1) The experimental subjects of the common part of the graduation examination are:
(a) Czech language and literature,
(b) the foreign language chosen by the pupil from the tender provided for in the implementing legislation; the pupil may choose only a foreign language which is taught in the school to which he is a pupil; and
(c) mathematics.
(2) The common part of the graduation exam consists of a Czech language and literature exam and a second exam for which the pupil chooses one of the test subjects referred to in paragraph 1 (b) and (c) on the application for the graduation exam.
(3) Testing of the test subject Czech language and literature and testing of the test subject Foreign language are composed of partial tests conducted
(a) by means of a didactic test;
(b) written work; and
(c) oral before the Trial Graduate Committee.
(4) The test of the test subject of mathematics is carried out in the form of a didactic test. For the purposes of this Act, a didactic test shall mean a written test which is uniformly entered and centrally evaluated in accordance with the criteria laid down in the implementing legislation.
(5) The pupil may also apply in the common section for two optional examinations of the subjects referred to in paragraph 1 (b) and (c). "
2. In Paragraph 78a (1), the words "and the level of test difficulty 'are deleted.
3. Paragraph 78a (4) reads as follows:
"(4) Secondary examinations in the form of a didactic test and oral form may be carried out by the pupil if he has successfully completed the last year of secondary education. ';
4. In Article 80 (2), "§ 169 'is replaced by" § 169a';
5. In Article 80 (3) (d), the words "and the form of oral 'are replaced by the words" from the Czech language and literature and sub-examinations held by the form of oral'.
6. In Article 80 (3) (h), the words "of a foreign language 'shall be inserted after the words" works'.
7. in Paragraph 80 (5) (b):
"(b) appoint evaluators of written works from Czech language and literature and contracting entities,"
8. In the second sentence of Paragraph 80a (5), the words "from a foreign language 'are inserted after the word" work'.
9. In Paragraph 81 (2), the third sentence is deleted and the eighth sentence is replaced by the sentence "Similarly, the successfully completed part of the examination is recognised by a pupil who was unable to complete the final examination within the proper time, because he failed to complete the final year of education."
10. in Article 81 (11) (a), the words "and the supply of optional test subjects" shall be replaced by the words "v."
11. in § 81 (11) (a), the words "the dates for selecting the level of difficulty of the common part of the final examination," shall be deleted;
12. in Article 82 (1) to (3):
"(1) Everyone who acted
(a) final examination,
(b) a graduate examination, except for a part-time examination of the common part in the form of a didactic test, or it has been excluded from carrying out such examinations;
may in writing request the Regional Authority to review the course and outcome of this test or exclusion decision. The Regional Authority shall decide on the application within 30 days of its receipt by changing the test result or cancelling and ordering the re-examination if it finds that the legislation has been infringed or other serious deficiencies have occurred which may have had an impact on the proper conduct or test result; Otherwise, the test result shall be confirmed. The school in which the pupil held the graduation exam, the Czech School Inspectorate and the Centre in the performance of the tasks referred to in § 80 (3) provide cooperation to the Regional Office in the examination of the application. The re-examination, with the exception of the partial examination of the common part of the graduation examination in writing, shall take place no later than 15 days after the date of the decision, before the examination committee appointed by the Regional Office. Repeating the partial examination of the common part of the graduation examination in writing shall take place as soon as possible, as provided for in the implementing legislation.
(2) Anyone who has passed a common part of a graduate examination in the form of a didactic test or who has been excluded from the course of that examination may request in writing the Ministry to review the outcome of that examination or to review the decision on exclusion from the examination. The Ministry shall send the applicant a written notification of the outcome of the examination no later than 30 days after the date of receipt of the application.
(3) The application referred to in paragraph 1 or 2 may be submitted to the competent administrative authority within 20 days of the end of the period laid down in the implementing legislation for the conduct of the relevant final or graduation examination or, in the case of partial tests, of the common part of the graduation examination from the end of the period laid down in the implementing legislation for the performance of the relevant partial examination. ';
13. in § 90 (12) and in § 102 (9), "§ 82 (1), (2) and (4)" shall be replaced by "§ 82 (1) and (4)";
14. In Paragraph 151, at the end of paragraph 3, the sentence "Where the possibility of exercising the right to hold a graduation examination, final examination, discharge in a conservatory or discharge has not been ensured in this way, the final examination, discharge in a conservatory and discharge in a school designated by the Regional Office shall be carried out in a school designated by the Regional Office in agreement with the Centre. '
15. in Article 163 (2), the words "counties, municipalities and" shall be deleted;
16. in Article 169a (1) (b), "§ 78a (4)" is replaced by "§ 80 (2)."
17. In Paragraph 178, paragraphs 6 to 8 are deleted.
18. in Article 179 (2) (b), the part of the sentence after the semicolon, including the semicolon, is deleted;
19. Paragraph 179 (3) is deleted.
Paragraph 4 shall become paragraph 3.
20. In Paragraph 180 (1), the words "primary schools in this school district and school establishments serving them 'are replaced by the words" primary school establishments in this school district'.
21. in Paragraph 184 (1), the words "and the evaluator and senior assistant" shall be deleted and the words "Section 206 (4) and (5)" shall be replaced by "Section 206 (3) and (4)."
22nd Paragraph 184 (2) reads as follows:
"(2) The performance of the chair of the final examination panel, of the discharge in the Conservatory and discharge, of the chair of the examination committee, of the Commissioner and of the evaluator of the written work shall be remunerated. The remuneration, other than the remuneration of the Commissioner and the external language writer, shall be provided by the legal person performing the school's activities; in the case of the Commissioner and the evaluator of the written work from a foreign language, the Centre shall provide the remuneration. The amount of remuneration and the rules governing its provision shall be laid down by the Ministry by decree. ';
23. Paragraph 185 (9) is deleted.
Paragraphs 10 to 26 shall be renumbered paragraphs 9 to 25.
24. Paragraph 185 (25) is deleted.
Čl. II
Transitional provisions
1. The Ministry of Education, Youth and Sports publishes the catalogues of the examination requirements of the common part of the graduation examination according to § 78a (1) of Act No. 561 / 2004 Coll., as amended by this Act, by 30 April 2013. These catalogues shall be used for the first time for the graduation examinations held after 1 January 2015 and shall also apply for the replacement and repair examinations of pupils who passed the graduation examinations for the first time before 1 January 2015. For graduation examinations held in 2013 and 2014, catalogues issued before the entry into force of this Act shall be used for the basic level of difficulty.
2. Pupils who have performed a joint part of the graduation examination for the first time in 2011 or 2012 and are entitled to a repair or replacement examination shall perform this examination in accordance with Act No. 561 / 2004 Coll., as amended by that Act. For the repair and replacement test, catalogues issued before the entry into force of this Act shall be used in 2013 and 2014 for the basic level of difficulty. The assessment of pupils in the sub-tests successfully carried out before the entry into force of this Act at a higher level of difficulty shall be considered to have been achieved in the test at the basic level of difficulty. These pupils may only apply for part-examinations which have not yet been successfully completed, or they may take all part-examinations of the subject.
Čl. III
Efficacy
This Law shall take effect on the day of its publication, with the exception of the provisions of Article I (15), (17) to (20), which shall take effect on 1 January 2013.
