on the proficiency test for the professional supervision of the use and protection of natural medicinal and mineral resources
According to Article 46 (1) (i) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Medical Spa and Spa Points and on the Amendment of Certain Related Laws (Spa Act) ("the Act '):
(1) The certificate of professional competence of a natural person for the exercise of professional supervision of the use and protection of natural medical and mineral water resources (hereinafter referred to as "professional supervision") is obtained by verifying professional knowledge through the examination of the professional competence of a natural person for professional supervision (hereinafter referred to as "professional competence").
(2) The application for a proficiency test (hereinafter referred to as "the application") is submitted by a natural person intending to exercise professional supervision (hereinafter referred to as "the tenderer"). The Ministry of Health (hereinafter referred to as "the Ministry ') shall, no later than 30 calendar days before the date set for the examination (§ 2 (1)). The applicant shall indicate in the application:
(a) the name, surname, title, birth number or identity card number (1) and the address of the permanent residence, telephone number, fax number or electronic connection, where applicable;
(b) the educational attainment, the type and duration of the practice and the field in which it was carried out.
(3) The application shall be accompanied by documents certifying the facts referred to in paragraph 2 (b) and, where appropriate, by certified copies of those documents.
(1) The proficiency test (hereinafter referred to as the "test") shall take place before the Examination Committee (Section 4) at the dates specified by the Ministry. The dates of the examinations shall be published by the Ministry of Health in the Ministry of Health Bulletin and on its website by 1 March of each calendar year at the latest, so that the first date of the examination is set not earlier than 60 calendar days from the date of its publication.
(2) The test is done orally. Test to verify knowledge
(a) legislation relating to the use and protection of natural medicinal and mineral resources;
(b) hydrogeology of mineral waters;
(c) the foundations of pelology;
(d) cytotoxics;
(e) accumulation, treatment and use of mineral waters;
(f) extraction, storage, treatment and preparation for use of pelloids;
(g) natural medicinal gases;
(h) basic indicators of the quality of natural medicinal resources, their determination, evaluation and sampling for control;
(i) dealing with emergency situations;
(j) keeping documentation related to the performance of professional supervision.
(3) The test shall be assessed by "passed" or "failed." The result of the examination shall be decided by a majority of the members present. In the event of a tie, the President of the Commission shall vote. The results of the examination shall be notified to the candidate by the chairman of the examination committee on the day of the examination. In the event that the tenderer has not complied, the chairman of the examination committee shall inform the candidate of the reasons for the evaluation. A record of the test shall be made indicating the date and place of the test, the questions, the evaluation of the responses and the result of the test. The record shall be signed by the Chairman of the Examination Committee. The alert shall include an application and a copy of the certificate.
A candidate who did not show up for the test for serious reasons and who duly excused his non-participation not later than on the day of the examination shall pass the test at the alternate time specified by the Ministry in the agreement with him. If the tenderer has not shown up for the test without a serious reason and a proper apology, he may only take the test on the basis of a new application.
(1) The panel shall have an odd number of members, at least 3. At least one member of the Examination Committee shall be an expert in practice. A practitioner shall mean a natural person normally with a higher education degree who carries out professional supervision or expert activities or an assessment activity in the field of exploitation and conservation of resources for at least 10 years.
(2) The Ministry shall appoint and remove the Chairman of the Examination Committee, the Vice-President, who shall represent the Chairman of the Examination Committee in his absence, and other members of the Examination Committee and of the alternate, from experts in the field of the exploitation and protection of natural medicinal and mineral resources, from among his staff and from practitioners. Only a natural person who has given his consent to this appointment may be appointed as a member of the Examination Board.
(3) A committee of examination with three members is quorum if all its members are present; in other cases, a quorum shall be capable if at least two-thirds of the members are present. A practitioner must always be present.
(4) The membership of the Examination Committee referred to in paragraph 2 shall cease to exist by revocation, resignation or death.
This decree shall take effect on the day of its publication.
