GOVERNMENT REGULATION
of 22 January 2003
on remuneration for the performance of the duties of members of the councils
The Government orders the implementation of Act No. 128 / 2000 Coll., on Municipality (municipal establishment), as amended by Act No. 273 / 2001 Coll., Act No. 320 / 2001 Coll., Act No. 450 / 2001 Coll., Act No. 450 / 2002 Coll., and Act No. 313 / 2002 Coll., Act No. 131 / 2000 Coll., Act No. 312 / 2002 Coll., Act No. 145 / 2001 Coll., Act No. 273 / 2001 Coll., Act No. 320 / 2001 Coll., Act No. 450 / 2001 Coll., Act No. 450 / 2001 Coll., Act No. 311 / 2002 Coll., Act No. 312 / 2002 Coll., Act No. 145 / 2001 Coll., Act No. 273.
Monthly remuneration
Monthly remuneration to members of the council
(1) The vacant members of the councils1) shall have a monthly remuneration of 2) as set out in Annexes 1, 2 and 3 to this Regulation.
(2) The monthly remuneration shall be granted as from the date on which the members of the representatives of the Council have been elected or appointed to the office for which the remuneration is due.
(3) The monthly remuneration increases to the elected members of the councils (3)
(a) in municipalities with extended scope and in urban districts or parts of urban areas of territorial subdivided statutory cities and in urban areas of the capital city of Prague, to whose offices at least part of the jurisdiction of the municipal authority of the municipality with extended scope has been transferred by statute or law;
1. to the mayor by an amount of CZK 3,000,
2. to Vice-Mayor (Deputy Mayor) of CZK 2,500,
3. members of the Board not mentioned in points 1 and 2 by the amount of CZK 2,000,
(b) in municipalities with entrusted municipal offices and in urban districts or parts of urban areas of territorial subdivided statutory cities and in urban areas of the capital city of Prague, to whose offices at least part of the jurisdiction of the entrusted municipal office has been transferred by statute or law;
1. to the mayor for an amount of CZK 2,500,
2. to the Vice-Mayor for an amount of CZK 2,300,
3. members of the Board not mentioned in points 1 and 2 by the amount of CZK 2,000,
(c) in municipalities with a construction office or with a matrix office, and in urban districts or parts of urban subdivided statutory cities and in the urban parts of the capital city of Prague, the authorities of which have been transferred by law or statute to at least part of the office of construction or matrix office by an amount of CZK 2,000;
d) If you are members of the City Council of Prague, you will need an amount of CZK 3,000.
(4) In the event of a confluence of claims pursuant to paragraph 3, the member of the council shall be entitled to an increase in the monthly remuneration of the highest amount.
Monthly remuneration to non-released members of the council
(1) A monthly remuneration of up to the amount laid down in Annexes 1, 2 and 3 to this Regulation may be granted to non-released councils4) unless otherwise specified.
(2) A monthly remuneration of up to 0,6 times the monthly remuneration laid down in Annex 1 to this Regulation for the elected member of the representative of the municipality which performs the duties of mayor may be granted to the non-released member of the council of the municipality.
(3) Monthly remuneration shall be granted from a date to be determined by the representative.
Common provisions
(1) If the members of the Councils do not perform their duties throughout the calendar month for the reasons set out in the Act, (6) they shall be paid a monthly remuneration equal to the number of days of actual service.
(2) The monthly remuneration to members of the Councils shall not apply from the day following the date on which the mandate expired or they have been withdrawn or have given up the post for which they were paid.
(3) The monthly remuneration calculated in accordance with Annex 1 to this Regulation, columns 1 to 8, and Annex 3 to this Regulation, columns 1 to 6, shall be rounded up to the whole crown.
Transitional and final provisions
Transitional provisions
(1) An additional remuneration of half of the amount to which they would otherwise have been entitled under this Regulation is payable to the elected members of the Councils in 2003. An additional remuneration of half of the amount which could otherwise have been granted under this Regulation may be granted to non-released representatives in 2003.
(2) Monthly remuneration under this Regulation shall be granted for the first time in January 2003.
Repeal
The following shall be deleted:
1. Government Decree No. 358 / 2000 Coll., on remuneration for the performance of the duties of members of councils.
2. Government Decree No. 173 / 2001 Coll., amending Government Decree No. 358 / 2000 Coll., on remuneration for the performance of the duties of representatives.
3. Government Regulation No. 122 / 2002 Coll., amending Government Regulation No. 358 / 2000 Coll., on remuneration for the performance of the duties of representatives, as amended by Government Decree No. 173 / 2001 Coll.
4. Government Decree No. 386 / 2002 Coll., amending Government Decree No. 358 / 2000 Coll., on remuneration for the performance of the duties of members of councils, as amended by Government Decree No. 173 / 2001 Coll. and Government Order No. 122 / 2002 Coll.
Efficacy
This Regulation shall enter into force on the day of its publication.
