of 29 June 1972
on district and regional agricultural administrations
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
Regional agricultural administrations
(1) The regional agricultural administration is the body of the state economic management of agriculture in the district.
(2) The Regional Agricultural Administration, as a budgetary organisation, is established by the Minister for Agriculture and Nutrition of the Republic in general for the district district.
(1) The Regional Agricultural Administration shall, on its territory, exercise control over single agricultural cooperatives, state goods with the exception of branch and central management, common agricultural holdings, other cooperative groups serving agricultural production, provided that they are the socialist organisations under the responsibility of the Ministry of Agriculture and Nutrition, agricultural construction undertakings and agricultural machinery stations, with the exception of branch and central management.
(2) The Minister for Agriculture and Nutrition of the Republic may submit to the regional agricultural administration and to socialist organisations other than those referred to in paragraph 1.
(3) When managing cooperative organisations, the district agricultural administration shall act in accordance with the specific rules governing agricultural cooperatives.
(1) The Regional Agricultural Administration shall manage and ensure the development of agricultural production and agricultural services for the managed organisations (Section 2) in accordance with the needs and interests of the company expressed in the national economic plans, with a particular focus on increasing the concentration and specialisation of agricultural production. In carrying out this task, district agricultural administration
(a) develop long-term concepts and proposals for medium-term and implementing plans for the development of agricultural production and organise the implementation of such plans;
(b) take similar measures which are the responsibility of the Central Article of the Procedure Body in the planning process and in the field of socio-economic information;
(c) ensure the application of economic instruments for the development of agricultural production under the relevant legislation;
(d) organise cooperative and integration relations for the development of agricultural production;
(e) coordinate customer relations with particular attention to the needs of food industry organisations;
(f) ensure the implementation of the principles of national technical policy and ensure that the latest knowledge of science and technology is put into practice;
(g) provide legal assistance to managed organisations;
(h) carry out control activities in managed organisations in order to respect socialist legality, planning and contractual discipline;
(ch) ensure the safety of work, increase the culture and hygiene of work and the working environment; and
(i) ensure the effective distribution and rearing of beakers.
(2) The district agricultural administration also carries out activities resulting from specific rules for agricultural production administrations and, where appropriate, regional agricultural associations.
(3) The district agricultural administration only carries out economic activities to the extent necessary for the performance of its tasks.
The Regional Agricultural Administration shall cooperate closely with the National Committees in securing agricultural production for individual farmers and shall, to this end, draw up relevant documents for the National Committees.
The head of the district agricultural administration is the Director; appoint and recall him, on a proposal from the Director of the Regional Agricultural Administration, the Minister for Agriculture and Nutrition of the Republic.
(1) In the district agricultural administration, the Director of the Regional Agricultural Council acts as an advisory body.
(2) The main task of the Regional Agricultural Council is to contribute to a high level of agriculture by applying the most progressive experience of cooperative peasants, workers of state goods and other agricultural centres, thereby helping to establish consistency between the principles of state economic governance and cooperative democracy.
(3) The Regional Agricultural Council is discussing proposals for essential measures in the agriculture management sector in the district, in particular:
(a) long-term concepts and proposals for medium-term and implementing plans for the development of agricultural production;
(b) proposals for the use of economic instruments;
(c) proposals for the application of forms of cooperation in ensuring the concentration and specialisation of agricultural production.
(1) The head of the district agricultural council shall be the head of the district agricultural administration.
(2) The members of the district agricultural council are elected from two thirds by representatives of managed organisations (§ 2); one third of the members shall be appointed by the director of the district agricultural administration from the officials and staff of other socialist organisations and state bodies. Membership of the Regional Agricultural Council is an honorary function.
Regional agricultural administrations
The regional agricultural administration is the body of the state economic management of agriculture in the region; establish it as a budget organisation by the Minister for Agriculture and Nutrition of the Republic.
(1) The Regional Agricultural Administration is managed by the Regional Agricultural Administrations.
(2) The Minister for Agriculture and Nutrition of the Republic may entrust the Regional Agricultural Administration with the management of certain socialist agricultural organisations referred to in Article 2 if their economic importance goes beyond the framework of the district or if their management is more effective by the Regional Agricultural Administration. These organisations are subject to the same jurisdiction as the regional agricultural administration vis-à-vis its managed organisations.
The Regional Agricultural Administration shall manage and ensure the development of agricultural production and agricultural services in the region in accordance with the needs and interests of society expressed in the national economic plans. As part of this task, the Regional Agricultural Administration primarily:
(a) drawing up long-term concepts, proposals for medium-term and implementation plans for the development of agricultural production in the region, outlining the tasks of the plan and indicative indicators for each district agricultural administration and directly managed organisations;
(b) ensure, in accordance with the relevant legislation, the use of economic instruments within the region;
(c) contribute to rationalising the investment development of agriculture, helping to develop cooperation and integration relations in the region in order to ensure the concentration and specialisation of agricultural production and the social division of labour between agricultural and food sector organisations;
(d) ensure the reproduction of labour in agriculture and the effective organisation of cadre education;
(e) control the activities of district agricultural administrations, in particular how they comply with planning, financial, price and other rules; in the case of detected defects, take corrective measures.
Regional agricultural administrations are managed by the Ministry of Agriculture and Nutrition of the Republic.
The head of the Regional Agricultural Administration shall be the Director; appoint and dismiss the Minister for Agriculture and Nutrition of the Republic.
(1) In the regional agricultural administration, the Director of the Regional Agricultural Council acts as an advisory body to discuss fundamental issues falling within the competence of the Regional Agricultural Administration. Its members shall be appointed by the Minister for Agriculture and Nutrition of the Republic on a proposal from the Director of the Regional Agricultural Administration.
(2) The Chairman of the Regional Agricultural Council shall be the Director of the Regional Agricultural Administration.
(3) Membership of the Regional Agricultural Council is an honorary function.
Provisions common and final
(1) In exercising their responsibilities, regional and regional agricultural administrations shall cooperate with national committees and assist each other in the performance of their tasks.
(2) Regional and regional agricultural administrations are discussing draft plans with the regional and national committees, including the requirements for the provision of agricultural needs and services which the national committees directly provide; provide the National Committees with the necessary documentation for regional plans.
(3) The competence of the national committees on the agricultural sector, as laid down in specific regulations, remains unaffected.
In the interests of the smooth development of agricultural production, the regional and regional agricultural administrations cooperate with other organisations of the agricultural and food industry in their district.
(1) The Governments of the Republic shall specify the scope and tasks of district and regional agricultural administrations, their relationship with and the scope of cooperation with national committees.
(2) The Ministry of Agriculture and Nutrition of the Republic provides:
(a) the principles governing the organisation of district and regional agricultural administrations;
(b) the tasks and manner of work of the Regional and Regional Agricultural Council, the method of election and the appointment of their members, the duration of their term of office, the number and composition of the members of the Board and the conditions for their termination of their membership;
(c) in agreement with the Ministry of Finance of the Republic, the measures necessary to abolish existing regional agricultural associations or production agricultural administrations.
The provisions of Act No. 32 / 1963 Coll., on the Organisation of Agriculture Management, and Government Regulation No. 33 / 1963 Coll., excluding certain organisations and establishments from the management of national committees, are hereby repealed.
This Act shall take effect on 1 September 1972.
