GOVERNMENT REGULATION
of 19 December 2007
amending Government Regulation No 622 / 2004 Coll., on the provision of a supplement to pensions to mitigate certain injustices caused by the Communist regime in the social field, as amended by Government Regulation No 405 / 2005 Coll.
The Government orders pursuant to § 8 of Act No. 198 / 1993 Coll., on the illegality and resistance of the Communist regime:
Government Regulation No 622 / 2004 Coll., on the provision of a supplement to the pension to mitigate certain injustices caused by the Communist regime in the social field, as amended by Government Regulation No 405 / 2005 Coll., is amended as follows:
1. In Article 1 (1), the word "or 'shall be deleted at the end of point (a).
2. In Article 1 (1), the word "or 'shall be added at the end of point (b).
3. in Article 1 (1), the following point (c) is inserted after point (b):
"(c) persons who, between 25 February 1948 and 31 December 1989, died in an attempt to leave Czechoslovakia with a violent death caused by the State, receive a widow's or widower's pension from Czech pension insurance,"
4. In Paragraph 1 (2), the first sentence is replaced by the following: "In addition, nationals of the Czech Republic whose parent died in an attempt to leave Czechoslovakia in the period 25 February 1948 to 31 December 1989 with a violent death caused by state power, if they did not reach the age of 18 at the date of death and receive a pension from Czech pension insurance."
5. In the third sentence of Article 1 (2), the words "or the second 'shall be inserted after the words" first'.
6. in Article 1, the following paragraph 3 is added:
"(3) In addition, citizens of the Czech Republic whose spouse was subject to the death penalty imposed for the offence referred to in paragraph 1 (a) and who receive a pension from Czech pension insurance are entitled to the surcharge. The premium referred to in the first sentence shall not apply where the surcharge referred to in paragraph 1 (b) applies. ';
7. In Paragraph 2, the sentence "The supplement to the widow's or widower's pension shall be increased by CZK 3,000 per month if the spouse of the beneficiary has been subject to the death penalty imposed on him for the offence referred to in § 1 (1) (a), or the spouse of the entitled person died at the time of the imprisonment or detention of the offence referred to in § 1 (1) (a)."
8. In Paragraph 2 (3), the words "the first sentence 'shall be inserted after the words" paragraph 2'.
9. In Paragraph 2, at the end of paragraph 3, the sentence "This surcharge increases by CZK 2,400 per month."
10. In Article 2, the following paragraph 4 is inserted after paragraph 3:
"(4) The supplement to the pension due under § 1 (1) (c) and § 1 (3) shall be set at CZK 3,000 per month. The supplement to the pension due under the second sentence of Paragraph 1 (2) shall be set at CZK 2,400 per month."
Paragraphs 4 to 6 shall be renumbered paragraphs 5 to 7.
11. in Article 2 (6), "up to 3" is replaced by "up to 4" and "second" is replaced by "third."
12. in the second sentence of Article 3 (1), "paragraph 6" is replaced by "paragraph 7."
Transitional provisions
1. The supplement to the pension to mitigate certain injustices caused by the communist social regime to which entitlement has been granted under Government Regulation No 622 / 2004 Coll., as effective from the date of entry into force of this Regulation, shall be due, on written request, from the payment of the pension to which this supplement belongs in the calendar month in which this Regulation takes effect.
2. The pension supplement to mitigate certain injustices caused by the Communist regime in the social field shall be increased in accordance with Article 7 (2) of Regulation (EU) No 1306 / 2013. I, points 7 and 9, following a written request from the payment of the pension to which this supplement belongs, due in the calendar month in which this Regulation takes effect.
Efficacy
This Regulation shall enter into force on the first day of the calendar month following its publication.
