laying down the procedure of the Czech Office for the Testing of Weapons and Ammunition in the classification of a type of weapon or ammunition
The Ministry of Industry and Trade provides, pursuant to § 79 (4) for the implementation of § 3 (3) of Act No. 119 / 2002 Coll., on firearms and ammunition and amending Act No. 156 / 2000 Coll., on the verification of firearms, ammunition and pyrotechnic articles, and on the amendment of Act No. 288 / 1995 Coll., on firearms and ammunition (Law on firearms), as amended by Act No. 13 / 1998 Coll., and Act No. 368 / 1992 Coll., on administrative charges, as amended, and Act No. 455 / 1991 Coll., on business (Trade Act No. 13 / 1998 Coll.), (Act on arms) (hereinafter referred to as "Act '):
§ 1
Subject matter
This decree sets out the procedure of the Czech Office for the Testing of Weapons and Weapons ("the Office '), which in doubt decides to include a type of firearms (" the weapon') or ammunition in the relevant category.
Procedure for the classification of a type of weapon or ammunition
§ 2
(1) At the request of the person in doubt requesting the inclusion of a type of weapon or ammunition in the category concerned (hereinafter referred to as "the applicant"), the Office shall initiate a procedure in which to decide on the classification of a type of weapon or ammunition in the category concerned, in accordance with § 3 to 7 of the Act. The application shall contain:
(a) the applicant's identification data (name and surname, permanent residence with a natural person or name or business name, registered office and identification number with a legal person);
(b) the particulars of the weapon (type, manufacturer's mark, model, calibre, serial number, if known to the applicant) and its description,
(c) the ammunition (type, manufacturer's mark, calibre) and its description;
(d) the reason for the request.
(2) The applicant shall accompany the application:
(a) the weapon or ammunition to be categorised if the size or weight allows its attachment, otherwise it shall communicate the location of their storage and ensure access by the Office's staff to the weapon or ammunition; and
(b) technical, drawing, publicity, advertising or other documentation relating to the weapons or ammunition referred to in (a), where available.
§ 3
(1) When classifying a type of weapon or ammunition, the Office shall base itself on the technical criteria set out in Sections 3 to 7 of the Act and in the Annex to the Act, and in particular on:
(a) the permitted production of a weapon or ammunition;
(b) the functional and shooting characteristics of the weapon;
(c) the appearance of the weapon;
(d) the year of development or manufacture of the weapon;
(e) the total length of the weapon;
(f) the number of rounds in the arms submission system;
(g) achieved kinetic energy of the bullet at the mouth of the barrel;
(h) tension forces for a mechanical weapon;
(i) the functional principle of the weapon complement;
(j) the type of ammunition fire;
(k) ammunition used in arms;
(l) the type of bullet in the bullet.
(2) The Office shall assess the type of weapon or ammunition submitted in accordance with the aspects referred to in paragraph 1 and shall issue a decision to categorise the type of weapon or ammunition.
(3) The decision to classify a type of weapon or ammunition in the category is also sent by the Office to the Ministry of the Interior and the Czech Republic's Interim Presidium. The Authority publishes the decision at its address in a publicly available information system (Internet).
§ 4
Efficacy
This Decree shall take effect on 1 January 2003.
