Decree on the implementation of certain provisions of the Act on aid in material need

DECLARATION
of 22 September 2025
on the implementation of certain provisions of the Act on aid in material need
The Ministry of Labour and Social Affairs provides pursuant to Section 80 of Act No. 111 / 2006 Coll., on aid in material emergency, as amended by Act No. 382 / 2008 Coll., Act No. 366 / 2011 Coll. and Act No. 152 / 2025 Coll., (hereinafter, Act ") for the implementation of Sections 29, 50a (2), 50b (1) and 63 (3) of the Act:
§ 1
Increasing the livelihood of a person due to diet
(K § 29 of the Act)
(1) The amount of livelihood of a person whose medical condition is recommended by a competent specialist requires increased dietary costs is increased monthly
(a) for a low protein diet of CZK 1 511,
(b) for a dialysis diet of CZK 1,095,
(c) for a low-cholesterol diet in hypercholesterolaemia or hyperlipoproteinaemia by CZK 1,150,
d) for a diabetic diet of CZK 1,238,
e) for diet in phenylketonuria by CZK 2 431,
f) for diet in celiac disease by CZK 3 066,
g) for a diet during osteoporosis, if the whole body bone density has fallen by more than 25% and the T-score is worse than -2.5, by CZK 1,194,
h) in the case of a diet for lactose intolerance of 1,172 CZK,
i) for a diet in pregnancy and breastfeeding up to 1 year of age of a child of CZK 1,205.
(2) Where a person's medical condition requires more than one diet, the amount of a person's livelihood shall only be increased once by an amount corresponding to that of the diets for which the increase referred to in paragraph 1 is the highest.
(3) The doctor responsible for confirming the need for a particular type of diet is meant for a diet
(a) a low protein doctor providing specialised outpatient care in the field of internal medicine or nephrology;
(b) on dialysis, the physician responsible for the medical establishment where the person is in the dialysis programme,
(c) low cholesterol in hypercholesterolaemia or hyperlipoproteinaemia by a physician providing specialised outpatient care in internal medicine or endocrinology;
(d) a diabetic doctor providing a person with specialised outpatient care in the field of diabetes, or a registered practitioner who has a person with regard to this diagnosis in dispensary care,
(e) in the case of phenylketonuria, a doctor providing a person with specialised outpatient care in the field of internal medicine or gastroenterology, in children and youth, a doctor providing a person with specialised outpatient care in the field of paediatric gastro-enterology and hepatology, or a registered practitioner for children and adolescents who has a person with regard to this diagnosis in the dispensary care, or another doctor who has a person with regard to that diagnosis in the dispensary care,
(f) in the case of celiac disease, a doctor providing specialised outpatient care in the field of internal medicine or gastro-enterology, in children and youth, a doctor providing a specialist outpatient care in the field of paediatric gastro-enterology and hepatology, or a registered practitioner for children and adolescents who have a person with regard to this diagnosis in the course of dispensary care;
(g) in the case of osteoporosis, a doctor providing a person with specialised outpatient care in the field of internal medicine, endocrinology, rheumalogy, orthopaedic or gynaecology and obstetrics,
(h) in the case of lactose intolerance, by a doctor providing specialised outpatient care in gastroenterology;
(i) in pregnancy, a doctor providing specialist outpatient care in the field of gyno and obstetrics,
(j) when breast-feeding up to 1 year of age, its registered physician for children and adolescents.
§ 2
Specifications of communication between emergency assistance authorities and the monetary institution and the format, content and structure of the data message
(Paragraph 50a (2) of the Law)
The specifications of communication between the body of assistance in material distress and the bank, the branch of a foreign bank, the savings and credit cooperative, electronic money institutions, the branch of a foreign electronic money institution, the issuer of electronic money of small scale, the payment institution, the branch of a foreign payment institution or the payment service provider of small scale (hereinafter referred to as the "monetary institution ') and the format, content and structure of the data report are set out in Annex 1 to this Regulation. All XML files exchanged are sealed with a qualified electronic seal (the seal).
§ 3
Specifications of communication between the body of assistance in material distress and the employer and the format, content and structure of the data message
(K § 50b (1) of the Act)
The communication specifications between the body of assistance in material distress and the employer and the format, content and structure of the data report are set out in Annex 2 to this decree.
§ 4
Specifications of communication between the department of emergency assistance and the gas or electricity supplier and the format, content and structure of the data message
(K § 50b (1) of the Act)
The communication specifications between the emergency assistance authority and the gas or electricity supplier and the format, content and structure of the data report are set out in Annex 3 to this Decree.
§ 5
Forms of the licence of a staff member authorised to carry out social work activities
(Paragraph 63 (3) of the Law)
The document of a member of the staff of a municipality assigned to an authorised municipal office or municipal office of a municipality with extended competence as a social worker and of a member of the State assigned to work in a central office as a social worker who is shown on entry to a residence for the purpose of carrying out social work activities shall contain the following particulars:
(a) the name and, where appropriate, the name, surname and title of the staff member;
(b) a photograph of the staff member;
(c) the term "social worker,"
(d) the identification of the competent authority which issued the licence, the imprint of the official stamp and the signature of the manager of the staff member;
(e) the period of validity of the licence.
§ 6
Efficacy
(1) This Decree enters into force on 1 October 2025.
(2) Paragraph 1 shall expire on 30 April 2026.

Annex No 1
Specifications of communication between emergency assistance authorities and the monetary institution and the format, content and structure of the data message
A) Specifications of communication between the monetary institution and the body of assistance in material distress
1) The assistance authority shall send a written request as a message containing a call document and an XML file from the data box of the assistance authority in a material emergency to the money institution data box. Only the text "XMLOPHNSOC 'shall be inserted by the body of assistance in material distress into the subject of the data message.
2) The Money Institute will send a message with the XML file with the required data to the data box of the Office of Assistance in a material emergency from the money institution data box at the written request of the assistance authority. To create an XML response file, the money institution uses its own technical means. Only the text "XMLOPHNSOC 'shall be inserted into the subject of the data message.
B) Format and structure of the data message
The data message for communication between the emergency assistance authority and the money institution is exclusively in XML format. XML file is encoded in UTF-8. The name of the file shall consist of the code of the assistance body in material emergency, money institution code and unique identifier created by the body in material emergency assistance in the creation of a query, according to the following rules:

Error element is created in case of error caused by the response processing. A) Specifications of how the employer responds to the call for assistance in material distress
1) The employer shall use the following ways to respond to the call for assistance in material distress:
(a) sending a reply to an XML file from the employer's data box;
(b) sending a reply via a web form; or
(c) sending a reply through a direct call to a GovTalk-based service.
2) Specifications of how the employer responds to the call of the body to assist in material distress, using the sending of the additional XML file from the employer's data box:
a) To send an additional XML file, an employer's data box or a person's data box, which the employer authorises through the electronic service "Full Power Management" of the Czech Social Security Administration, will be used and the XML file will be addressed to the data box designated by the body of assistance in a material emergency in the call.
b) To supplement the XML file, it is possible to use your own technical means or freely available online editor of the aid body in a material emergency.
3) The specification of the employer's response to the call for assistance in material distress by means of a web-based form, available in the reference contained in the call when using the web-based form, requires the authentication of the employer via the Data Box Information System or by the data box of a person who will be authorised by the employer through the electronic service "Full Power Management" of the Czech Social Security Administration.
4) Specifications of the employer's response to the call for assistance in material distress by means of direct call of a GovTalk-based service:
a) Authentication and electronic signature of data for the service is carried out exclusively by a qualified certificate registered with the Czech Social Security Administration.
(b) For submission by direct call of service, the data theorem shall be inserted into the envelope in the format GovTalk version 2.
c) The data theorem is part of the XML item.
d) The structure of the envelope, which is published on www.mpsv.cz at the date of sending the employer's reply to the invitation of the institution to help in a material emergency.
B) Format
The employer's reply is accepted exclusively in XML format by the body of assistance in material distress.
C) Content and structure of the data message

1) The gas or electricity supplier sends a response to the request of the body of assistance in material distress as JSON file in the format according to Part B from the data box of the gas or electricity supplier.
2) Specifications of the response method of the gas or electricity supplier to the call of the emergency assistance authority using the JSON file sent in the format according to Part B from the gas or electricity supplier's data box:
(a) The data box of the gas or electricity supplier shall be used to send the JSON file.
b) To create a JSON file, the gas or electricity supplier shall use its own technical means.
B) Format
The gas or electricity supplier's reply is accepted exclusively in JSON format by the aid body in material distress.
C) Content and structure of the data message
