DECLARATION
of 17 December 2015
amending Decree No 129 / 2012 Coll., on the details of the marketing of seed and planting plants, as amended by Decree No 409 / 2013 Coll.
The Ministry of Agriculture provides, pursuant to § 3 (11), § 3a (11), § 3b (7), § 3c (5), § 4 (15), § 5 (8), § 6 (8), § 6a (7), § 7 (6), § 7a (5), § 8 (3), § 12 (8), § 12a (4), § 12b (6), § 13 (6), § 14 (6), § 15 (6), § 16 (11), § 17 (14), § 18 (12), § 19 (15), § 22 (8) of Act No 219 / 2003 Coll., on the circulation of seed and seedding plants, and amending certain laws (Act on the circulation of seed and seed and seed).
Decree No. 129 / 2012 Coll., on the details of the marketing of seeds and propagating plants, as amended by Decree No. 409 / 2013 Coll., is amended as follows:
1. In footnote 1, the words "Commission Directive 93 / 17 / EEC of 30 March 1993 on the definition of Community grades for basic seed potatoes and the conditions and labelling of those grades' are deleted and the words" Commission Implementing Directive 2013 / 63 / EU of 17 December 2013 amending Annexes I and II to Council Directive 2002 / 56 / EC as regards minimum requirements for seed potatoes and seed potato lots' are added at the end of footnote 1.
Commission Implementing Directive 2014 / 20 / EU of 6 February 2014 on the definition of Union grades for basic and certified seed potatoes and the conditions and labelling of those grades.
Commission Implementing Directive 2014 / 21 / EU of 6 February 2014 on the minimum conditions and classes of Union seed potatoes prior to basic seed potatoes.
Commission Implementing Directive 2015 / 1955 / EU of 29 October 2015 amending Annexes I and II to Council Directive 66 / 402 / EEC on the marketing of cereal seed. ';
2. In Article 19, at the end of paragraph 2, the sentence "Garlic seed may only be put into circulation in closed containers to prevent the content from being confused effectively."
3. In Annex No 1, Part III, Section 2, Subsection 1, Table No 3.2a, the row "barley 'is as follows:

4. In Annex No 1, Part III, Section 2, Subsection 2, the words "except for barley hybrids produced using cytoplasmic pollen sterility (CMS), 'shall be inserted after the words" barley'.
5. In Annex No 1, Part III, Section 3, Subsection 1, Explanatory note No 18, the words "except for hybrid varieties of barley produced using cytoplasmic pollen sterility 'shall be inserted after the words" varieties'.
6. In Annex No 1, Part III, Section 3, Subsection 2, point 4, the words "except for barley hybrids produced using cytoplasmic pollen sterility 'shall be inserted after the words" barley'.
7. In Annex 1, Part III, Section 3, Subsection 2, point 5:
"5. for seed of hybrid varieties of wheat, barley, except for hybrid varieties of barley produced using cytoplasmic pollen sterility, oats and self-pollinated triticale produced without the use of a chemical hybridization agent, the minimum varietal purity (% hybridization) of seed of category C is 90%, for seed of hybrid varieties of barley produced using cytoplasmic pollen sterility is the minimum varietal purity (% hybridization) of seed of category C is 85% and the maximum quantity of mixtures other than the renewal of fertility is 2%, checked by an official subsequent vegetation test;"
8. In Annex No 1, Part III, Section 3, Subsection 2, point 6, the words "and hybrid varieties of barley produced using cytoplasmic pollen sterility 'shall be inserted after the words" rye'.
9. In Annex No 1, Part III, Section 3, Subsection 2, the following point 8 is inserted after point 7:
"8. in the case of seed of hybrid varieties of barley using CMS, the maximum permitted number of plants of different types in seed production of category E shall be 0,1% in the case of the maintenance and restoration of fertility, 0,2% in the case of pollen-sterile parent component and 0,5% in the case of seed production of category C in the case of fertility and pollen-sterile parent component; The minimum level of pollen sterility of the parent component is 99,7% for seed production and 99,5% for seed production. Compliance with the requirements of this point shall be assessed by an official subsequent growing test. Category C seed may be produced during the cultivation of a mixture of a pollen-sterile parent component with a component restoring pollen fertility. ';
10. in Annex No 3, Part V, Section 2, Subsection 2, Table No 5.2b, the row "Eastern hams," the column "germination" is replaced by "60."
11. in Annex 5, Part V, Section 3, Subsection 1, Table 5.3, row "Len," column "Harmful organism" the word "exiqua" is replaced by "exigua."
12. Annex 7 shall read as follows:

1 - PBTC generation is intended for pre-generation material PB, the plants and tubers of which have been grown in a protected establishment and in a growing substrate free from harmful organisms. The mother plants must be free from Pectobacterium spp., Dickeya spp., Potato cob virus and viruses A, M, S, X and Y. The mother plant is an identified plant from which propagating material is used, the mother plant means microtubers, when microvegetative propagation is used, and clone material, when clone selection is used.
2 - The maximum number of generations of RM pre-stages planted in the field is 4 and the total maximum number of combined generations of seed before basic seed in the field and basic seed potatoes is not more than 7.
3 - The maximum number of generations of the basic RM category is 3 and the total maximum number of generations of the basic RM and RM pre-stages combined is 7 (cannot be multiplied from generation to generation).
4 - Maximum number of generations of certified RM is 2 (cannot be multiplied from generation to same generation).
5 - If it is not indicated on the official label of the generation, the seed potatoes shall be considered to be the last generation authorised in that category.

Requirements for land properties and soil properties
1. prior to planting, a survey on the presence of Globodera rostochiensis (Wollenweber) Behrens and Globodera pallida (Stone) Behrens must be carried out with negative results;
2. the land must not be affected by exceptional plant health measures ordered as a result of the presence of Clavibacter michiganensis subsp. sepedonicus (Spieckermann et Kotthoff) Davis et al. and Ralstonia solanacearum (Smith) Yabuuchi et al., concerning the prohibition of planting,
3. propagation on one parcel shall be permitted not earlier than 3 years after the previous potato crop.

1. each propagation crop shall be clearly separated from the adjacent crop by at least one unplanted potato line or at least 10 m long unplanted stripe in the width of the seed at the beginning and at the end of the propagation crop;
2. the selected plants not removed on the day following the selection shall be considered as non-compliance with the minimum distance between the seed crops from other potato crops;
3. the prevalence of viral diseases in the growing of potatoes in closed areas must be up to 10,0%.

6 - When calculating the percentage of missing plants, in the case of a line width of 70 - 75 cm, the number shall be based on the number. 50,000 individuals per 1 ha and, in the case of a 90 cm line width, 45 000 individuals per 1 ha.
7- Each thorn on which new shoots of more than 5 cm are grown after early termination of vegetation shall be considered as one giant.
8 - The date of early termination of vegetation shall be decided on the basis of local conditions by the supplier and shall inform the relevant seed inspector no later than 5 days after its designation.
9 - The percentage of the occurrence of the growths to which samples may still be taken for post-harvest tests directly from the crop may be taken after harvest if there is a higher incidence.
1. It must not be planted with potatoes.
2. A cut-off seed shall not be used to establish the crop.

1. During the show, the unremoved mother tubers and the unremoved new seed tubers are assessed as a plant with symptoms of virus infestation.
2. In the case of selection by postponement, when live non-winged aphids are present, each of the selected thorns left in the crop is assessed as a plant with symptoms of virus infestation.
3. The maximum levels for the occurrence of symptoms of virus infestation apply only if they are viral diseases caused by viruses common in Europe.

10 - Potato seed can be produced in a generation B only if the initial propagating material used contains not more than 5,0% of the tubers of the infected virus.
11 - the determined value of the virus tested is multiplied by 0,16.
12 - the determined value of the virus tested is multiplied by 0,025.
13 - seed intended exclusively for use in the next generation with the same propagator to establish the production area of potatoes; the label of such seed potatoes which have not been tested for viroses by laboratory shall indicate this together with the information that this material may be used exclusively for the same propagator to establish the production area of the potatoes.

Requirements for the characteristics of propagation crops and propagating material according to the standard for seed potatoes of the United Nations Economic Commission for Europe (UNECE)
Requirements for the characteristics of propagating material
1. Seed Size
(a) tubers not exceeding 3%
(b) tubers not exceeding 3%
(c) be determined by sorting on square nets with a minimum size of 25 x 25 mm and a maximum size of 60 x 60 mm; where nets of more than 35 mm are used, the difference between the nets is divisible by 5; the maximum difference in mesh size within one lot is 25 mm.
(d) tubers of all sizes in a balanced proportion must be represented in one lot of seed.

5. Originators of the diseases listed in Table 5:
(a) soft rot of potato tubers -Pectobacterium spp., Dickeya chrysanthemi (Burkholder et al.) Samson et al., Pythium spp., possibly other agents,
(b) dry rot of potato tubers-Fusarium spp., Alternaria spp., Phoma foveata (Foister) Aveskamp, Gruyter et Verkley or other agents of rot,

6. The seed potatoes shall not be put into circulation if the means to prevent germination have been treated.
Label
The official label of seed potatoes of the pre-stage propagating material or breeding material shall contain the following particulars:
1. designation of the Constitution and the Czech Republic or abbreviation thereof
2. the designation "EU rules and standards"
3. trivial and botanical name of species
4. name of variety
5. the designation of the category "pre-stage propagating material" or "breeding material"

Maximum authorised weight of small packages of seed potatoes
The maximum weight of the propagating material in one small package is 10 kg (without additives).
Labelling of small packages
The supplier's label or inscription on a small package of seed potatoes of the category of basic propagating material or certified propagating material shall include the following:
1. marking "Small packages"
2. name and address of supplier
3. the designation of the Constitution and the Czech Republic or their abbreviations
4. lot number
5. trivial and botanical names of species
6. name of variety

13. In Annex 9, the models of the forms referred to in (b) Application for recognition of the seed crop, (d) Result of mechanical analysis of seed potatoes, (n) Application for registration of persons and (s) Protocol on repackaging, carry-over, seed presentation shall read:
"Application for recognition of the crop
14. in Annex 10, the following point (c) is inserted after point (b):
"(c) a certificate of acceptance for seed potatoes,"
Points (c) to (k) shall be renumbered (d) to (l).
15. in Annex 10, the following point (j) is inserted after point (i):
"(j) the decision not to recognise the seed potato crop;"
Points (j) to (l) shall be renumbered as points (k) to (m).
